"SSPMS Ground, Near Le Meridien," I told autowala.

"Yeh hui na lakhon ki baat!," said autowala and started the rickshaw.

I took out my mobile and started playing Angry Birds.

"Do you have SEAC Environmental Clearance Status - on your mobile," while waiting at the signal, the autowala said.

"What?," I asked him.

"SEAC E C Status!," said the autowala.

"No. I have Angry Birds, Cut the Rope, Fruit Ninja, Doodle Jump," I said.

"Do you have - Fool the Flat Buyers?," said the autowala.

"No. I don't have it," I said.

"It's most popular game in Pune," said the autowala.

"Do you play games on your mobile?,"  I asked.

"No. On my mobile, I offer 3 minutes free advice about buying a home in Pune," said the autowala.

"That's great! I am going for booking a 4 BHK flat - what free advice will you give me?," I asked.

"Just did that!," said the autowala.

"Sorry. I didn't get you," I said,

"You will - eventually," the autowala said.

"By the way, what is your good name?," I asked autowala when we reached SSPMS Ground.

"Ravi Karandeekar," said the autowala.

"What a coincidence! I am also Ravi Karandeekar," I said.

"Don't tell your name to anyone at the exhibition - my free advice," said the autowala.

"Why?," I asked.. But without giving answer the autowala took a U turn and went away.  I didn't mind it much. But, why didn't he take the auto fare from me? I was confused. Obviously, I called my wife. Told her everything.

"Better follow autowala's advice. Don't tell your name," my wife said.

"Okay. Please, suggest a name for me," I said.

'Stupid! Use his name," said my wife.

"Darling, you are a genius," I said.

"I know!," said my wife.

At the entrance of the exhibition there was a long queue.

When I reached the reception, I peeped in and realized that
there were  no properties in the exhibition.

What is this?

Autos are displayed in an auto exhibition.
Furniture is displayed in a furniture exhibition.
Paintings are in a painting exhibition.
Why properties are not in the property exhibition?

I got confused and called my wife.

"There are no properties in the property exhibition!," I said.

"Yes. I know. That's why I didn't come with you," said my wife.

'But how can I book a flat without seeing a flat?," I asked.

"By looking at the pictures!," said my wife.

"How can I decide by looking at the picture?," I said.

"How did you decide to marry me?," my wife asked.

"By looking at your photo," I said.

"And that was the best decision you have ever made in your life. Right?," my wife asked.

"Yes, of course!," I said.

"Go ahead and make one more! Book a flat. Save 2 Lakhs," said my wife.

As suggested by my wife, I gave autowala's name at the registration counter and entered the venue safely.

At every stall there was a big crowd. So, I kept on walking.

One gentleman in the crowd noticed that I was lost. He asked me,"What is your requirement?"

"I want to book a flat. But, I can't find any stall selling flats. Are they selling buildings?," I said.

"Flats are inside the buildings!," said the gentleman.

"Yes of course," I said and joined the crowd in one stall.

"What is your requirement?," a smart young man asked me.

"4 BHK Flat," I said.

"Come on here - this way," the smart young man said and took me to a sofa in the corner.

Stuffing a brochure in my hand, he said, "Give me a second, please"

"Okay," I said and started browsing the brochure.
I reached the last page but the smart young man didn't turn up.

I was about to get up and go, when I realized that after a long time
- I was reading something printed on a paper.

And you know what?
It was a pleasure to hold, handle, look and read a brochure printed on glossy paper.
Much more pleasurable than the Kindle, mobile & laptop.

I read the entire brochure once again.
But, when I reached the bottom of the last page,
the 'disclaimer' - in fine print - gave me the shock of my life.

The disclaimer was -
The information given herein is presented as general information about the project and no representation or warranty is expressly or impliedly given as to its accuracy, completeness or correctness.

In that state of shock, I got up and called my wife,

"There are no properties in this property exhibition. They are only colorful photos and brochures. And you know what? All these images & information is not true & not correct. Without valid - authentic - information - tell me - how can you expect me to make a decision to book a flat?," I asked.

"Baby, first, stop crying. Find out, what others are doing. And, don't come home without booking a flat," my wife said.

I sat down. Gulped some water from my bottle.  Helplessly went on looking around.

At last, the smart young man came back and said, "Sorry to keep you waiting"

"No issues. Those were a few valuable minutes. I read the brochure. Including the fine print. I have a few questions. Can I ask?," I said.

"Yes! Go ahead," the smart young man said.

"After reading the disclaimer - I am finding it difficult to make a decision. I need your help to decide. Can you?, " I asked.

"Sure. That's why I am here. Feel free to ask," said smart young man.

"I asked - Can you help me to make a decision?," I said.

"Trust! Ignore the disclaimer and trust me," said the smart young man.

"Are all these people doing the same thing?," I asked.

"What else can they do? If they want to own a home - they have no option but to trust the builder," said the smart young man.

"But why don't you give valid - authentic - information about the property and firm commitment - legal offer?," I asked.

"Because - our interests are different - our focus is not the same - you buyers are interested in property. We builders are interested in property agreement. We want your commitment to pay - an agreement to pay us. For us - builders - what we get is more important than - what we give. And, we don't hide our intentions. We want your money to grow our business," said the smart young man.

"Okay. Can you tell me what is the intention behind organizing - participating in - this exhibition?," I asked.

"To collect maximum number of commitments of  payments - to sign & register maximum number of agreements," said the smart young man.

"Means this is not an exhibition of properties - this is an exhibition of property agreements - fair enough - after all these are two sides of the same coin," I said.

"Right - 2 sides of the same coin," said the smart young man.

"But why don't you show the property agreements? How can you expect me to book a flat without authentic information about the property and without the final draft of agreement?," I asked.

"That's not my problem! That's your problem!!," said the smart young man.

"You are right," I said and got up.

I came out and called my wife,"I am sorry. I can't do it. Can I come home?"

My wife disconnected the phone.
I tried again. Again. And again.

No 'Live-in Relationship'

Be a True Owner of Your Home!

Generally, a typical builder in Pune takes your money, somehow constructs a flat and lets you live in it. But - as long as - he can, a typical builder avoids giving you true ownership of your home.

Yes! A typical builder insists on signing an agreement to sale. Only because, banks give money against this legal document. Otherwise, a typical builder avoids all legal & municipal formalities.

Most of the home buyers do not know that, in simple terms, an agreement to sale is just an engagement - an exchange of rings - a promise to marry. Not a marriage!

In real estate, "Conveyance" is the "Marriage". After the conveyance, you become a true owner of your flat and of the land on which your flat is constructed.

Result is, today, most of the home buyers are not true owners of their homes in which they are living. They are paying equal monthly installments - EMIs - of a flat - which is not theirs. Their builder is the actual owner.

Without conveyance - the transaction is not complete. The 'engagement' - a promise to marry - is not fulfilled. They are living in a home - not as legally married. It's just a 'live-in relationship'.

However, yesterday, I met a builder who doesn't force 'live-in relationship' on his property buyers. He believes in legal relationship. In Marriage. In conveyance. Your complete ownership of your home!

The name of this builder is Mr. Ankush B. Asabe. He is the founder and promoter of Shree Venkatesh Group (www.venkateshbuilders.com). Yesterday, I met him at Venkatesh Lake Vista at Ambegaon in PMC limits.

After witnessing "real estate gaming" at Lake Shire, I wanted to visit a project where homes are constructed to raise a family and live happily ever after.

When I told this to Manoj Adkar of Media Vinspa, my friend and leading real estate branding consultant, he said,"Let us visit Venkatesh Lake Vista at Ambegaon! They have ready for possession 1 BHK, 2 BHK & 3 BHK Flats for sale!!"

"Yes! I am very much interested in visiting Lake Vista!! It was looking beautiful from Jambhulwadi Lake!! Constructing around 670 flats in less than 30 months from the launch is awesome. Let us go!," I said.

"Why do you always have ready for possession flats?," I asked, what I always wanted to ask Mr. Ankush Asabe.

"Because, that's our business model! We construct as per our construction schedule. For example, at the launch of Lake Vista, we opened booking of only 4 buildings - but we started construction of all 12 buildings!," said Mr. Ankush Asabe.

"But what about funds for construction?," I asked.

"We don't divert funds. Use all funds generated from the sale to develop the same project. Not to buy a land for the next project! Plus, we invest our own funds - raise project finance - target is to complete the project efficiently," said Mr. Ankush.

"Financially sound builders have realized the benefits of selling ready possession properties! God knows when the property buyers will stop booking and start buying ready for possession flats!," I said.

"Looking at the response to Lake Vista & Sharvil - I feel that the buyers - actual end users - have realized the benefits of buying ready possession flats - no VAT - no Service Tax - is big saving. Avoid paying rent + pre-emi is a big relief. Considering the safety and comfort - they find my ready possession property prices reasonable!," said Mr. Asabe.

"What about you? You must be earning windfall appreciation by selling ready for possession flats!," I asked.

"We look for reasonable profits - not for 'windfall' - our property prices prove this - 1 BHK for 35 Lakhs, 2 BHK for 45 - 49 Lakh, 3 BHK for 63 - 66 Lakh at Lake Vista - our job is to complete the ongoing project and start the next - you can see it in our 'declaration deed' - we do the 'sale deed' of every flat - give the ownership of the flat - proportionate area of the land - not only that - the balance FSI and the rights of any future FSI - to every flat buyer. We only keep rights on the roads - otherwise - we give away all rights to the flat owner - along with completion certificate," pointing at the respective pages in the sale deed, Mr. Asabe said.

"It means that every flat owner at Lake Vista becomes a true owner of his home! This is overwhelming - beyond expectations - so must be an unbearable experience for the buyer," I said.

"Memorable experience - look at those people - they are my old customers - are here to give me Gudhi Padwa wishes!," Mr. Ankush Asabe said.

Baap ka maal

Legal Charges to be paid in cash at the time of registration of property agreement at Pune:

Look what I found in "Pittara" !

While going through the property price lists collected in PROFEST 2013, organized by Credai Pune Metro, I realized that construction service providers - works contractors - in Pune expect us to pay "Legal Charges". Some call it 'Miscellaneous expenses". But, at the time of registration of agreement of your flat, you are supposed to pay this amount in cash.

Don't ask why in cash! Corruption and black money is the life line of those who are in power.

However, we all know that Choron ki bhi neeyat hoti hai.

May be because of that the biggest builder in Pune real estate market, which registers highest number of property agreements - gets a bulk discount. So, "Legal Charges" for a flat in Kumar Properties' any project are only Rs. 3,500.

Whereas, majority of the builders expect you to pay Rs. 5,000 - in cash.

So, if you are booking a flat in UrbanGram Kirkatwadi, UrbanGram Pirangut, UrbanGram Chakan, Nirman Viva - Sai Mystique - Lake Vista at Ambegaon, D' Wisteria Park at Vadgaon, Splendid Square Lohegaon, Kushal Nivriti Kondhwa, Supreme Estado Baner - you have to pay Rs. 5,000 in cash. Irrespective of the price of property!

A 3 BHK Flat in Supreme Estado Baner goes for Rs. 1.01 to 1.07 Crore and a 2 BHK Flat at UrbanGram Kirkatwadi costs between Rs. 32.74 and 35.66 Lakhs - but Legal Charges for both are the same. Rs. 5,000 - in cash. Why? May be, because, all are equal before the law!

Some builders are given special concessions by these "men in power". That's why legal charges of Dwarka at Chakan are Rs. 2,300 & Lakeshore Residency at Talegaon - Rs. 2.500. KUL Nation at Manjri Rs. 4,000.

I have understood 'Modus Operandi' of these "Men in Power'. I was almost convinced. But when I saw that Aapla Ghar at Ranjangaon & Sanaswadi were asking Rs. 8,000 legal charges for a 1 BHK Flat of Rs. 11.35 / 11.88 Lakh and for a 2 BHK Flat between Rs. 16.81 and 17.98 Lakh - I got confused.

What is this? Rs. 8000 for a common-man's home and Rs. 10,000 for IT Professionals' home - this is not fair. Mr. Men in Power, apne baap ka na samjho maal.

You can take Rs. 10,000 legal charges in cash from an IT professional who wants to register his flat in Eastern Ranges Keshav Nagar Mundhwa, BA Vermont Wagholi, 43 Privet Drive Balewadi, Yash Wisteria & Latitude at Wakad. But don't demand Rs. 8,000 legal charges from a common man who is buying a home in Aapla Ghar Housing Colony at Ranjangaon & Sanaswadi or a 2 BHK Flat costing between Rs. 27.82 to 29.56 Lakh in Savali Homes at Uruli Devachi, near Hadapsar.

Never forget that Choron ki bhi neeyat hoti hai.

Mr. men in power, please, be fair to honest & hard working construction service providers - works contractors in Pune. They are not like other builders in this country. They feel shy to ask legal charges in cash from their paymasters - home buyers in Pune. You know what? Most of the time, builders in Pune - pay you from their own pockets.

Point is, Mr. men in power, legal charges in cash is not aapke baap ka maal.

Dear readers, how am I doing? I am not blaming and bashing the builders. Because, builders are innocent. 'System' is the evil. What say you? Please, let me know in the comments.

Die for a Politician & Live for a Builder

Anna Hazare's movement for the Jan Lokpal Bill has proved that we can do more than what we are supposed to do - die. Die for a motherland and let the men in power live a long life.

For the first time, we found a leader, Anna Hazare, who was ready to die for us. So, that we can have a 'say' and live a respectable life.

What politicians had to accept, for sure, builders can't refuse. Like politicians, the builders have to accept that we, the property buyers, are the masters.

Now, builders have to stop exploitative abuses. Builders can't go on exploiting us, anymore. Builders can't take disadvantage of their collective dominant position of the only source of housing to abuse property buyers. (Read More)

An agreement of your flat is a 'sugar teat'...keep on sucking till you get possession, baby!

On the day "Competition Commission of India (CCI)" fined DLF Rs. 630 crore, everybody realized that the property agreements are one-sided - completely in the favor of builders. With these agreements - builders brutally disregard consumer rights and indulge in 'unfair' trade practices!

In it's editorial The Economic Times cried- "To end an unequal relationship between the property buyers and builders - Indian real estate needs a regulator". A Super-Nanny - to take care of the innocent babies!

Innocent babies who have bought the builders' day dreams. Innocent babies who had ignored the disclaimer printed on the brochure and had payed for the fairy tale as if it's a legal offering. (Read More)
