The 5 skills of DSK every Pune builder needs to master in post-RERA Regime

My life has changed after DSK mentioned me along with Mr. Vijay Kumbhar in that video shot at Economic Offences Wing of Pune Police. Suddenly all builders in Pune realized that Ravi Karandeekar is very knowledgeable & powerful blogger in Pune real estate market.

"Ravi Sir, you are closely following how DSK is dealing with the threat of the MPID. Please, share with me DSK's set of skills which will be useful for me to deal with MahaRERA & complaining flat buyers," one after another builders in Pune started requesting me on 919860044110.

"I speak for free for only 3 minutes! To share DSK's skills I need more than 3 hours!!..." I said.

"Yes! Yes!! Money is not a problem!! And, certainly, I want personal - private - 1 on 1 - coaching," the builder said.

"But DSK is not a one man show! It's a couples game! You can become a Bunty - but what will you do about a Babli?," I asked.

"I have an old fat bitch at home and one young n dumb bitch in the office, Ravi! I am not an exception. Every builder has minimum 2 bitches - home bitch screws the builder - office bitch screws the flat buyers - so Babli is not a problem!," the builder said.

"Yes, of course, you just want to raise your game," I said.

"Yes! I want to become the master player whom no one can catch!!," the builder said.

"Yes, of course, you know how to commit a crime - now you want to master the art of how to cover your crimes and remain out of the jail. Right?," I asked.

"Right! How to cover your crimes - How to convert your crimes into social initiatives - How to buy your victims sympathy - How to divide & neutralize your victims - these are "social skills" - with money you can buy politicians, bureaucrats, and police - but if you want to remain out of the jail you need to learn these 'social skills'. What do you think?," the builder asked.

"Perfect! But you are making one mistake. You are completely ignoring one important factor," I said.

"Which factor?," the builder asked.

"Vijay Kumbhar!," I said.

"You know what happened to Satish Shetty. We builders know how to deal with RTI activists. They don't last long," the builder said.

"Oh! Yes!! Death toll of RTI activists has gone up to 56 - since the law came into force in 2005. And Maharashtra tops the list. Certainly you know how to deal with RTI Activists," I said.

So, the point is, it looks like I may have to make a presentation to all promoters, builders, Bandhkam Vyavsayik in Pune and teach them the top 5 skills of DSK which will help them in post-RERA Regime.

If this really happens, then I have to be prepared. So, please, help me.

If you are planning to buy a flat in Pune real estate market - I am sure - you must have studied RERA Act and must be keeping yourself updated about the orders issued by MahaRERA. So, you may have opinion about the effectiveness of MahaRERA.

Since you are living in the age of social media - I am sure - you must have seen YouTube videos of DSK and must have heard about his mastery on social skills.

Just imagine - what will happen to you if your builder masters the skills of DSK!

Please, have a look at my list of the top 5 skills of DSK every builder needs to master in post-RERA regime and contribute your inputs in the comments:

1) Keep on diverting funds to your personal accounts & proprietary firms:

MahaRERA is all about not diverting funds. That's why MahaRERA compels the builder to keep 70 per cent of moneys received from the flat buyers in the account of the firm under which the builder is developing the project.

Instead of focusing on 70 percent, better focus on those 30 percent which RERA allows you to divert in your personal account.

It means that RERA lets you 'earn' 30 percent of the project cost before you complete the project!

Now, let us look at those 70 percent. Follow DSK Dream City pattern and hike the land prices by using proprietary firms.

It allows you divert money in your personal accounts before you develop that land.

Blotted valuation of land lets you earn huge amounts of moneys from the banks & financial institutions. At the same time, you get permanent permission to divert money as a land price from 70 percent account.

Use your private companies as contractors & consultants to officially divert moneys from 70 percent account.

In short, follow the age old principle - Profit First. Construction Last.

It means that MahaRERA can not stop you from diverting funds.

Before RERA you were diverting funds because profit margins were huge.

Post RERA you have to divert the fund because profit margins are low.

Post-RERA you will be able to earn good profits only if you divert the funds and let the project remain incomplete.

Incomplete & stalled project not only creates strong bond between the builder and the flat buyers - it opens the doors of funding from private equity firms.

What if you fail to get private equity?

Don't worry! Stalled projects of DSK - like DSK Anandghan and all - had proved that the bond between the builder and the flat buyers becomes more strong!

In short - Don't bother about completing the project and giving flat possession.

Profits are more important than flat possession.

2) Learn Acting:

Always remember this - All the world is a stage, And all the men and women merely players!

Of course, yours is a one man show. You are not only an actor but you are also the scriptwriter and the director of your show.

To succeed like DSK - a builder needs to be a versatile actor.

At the launch of a project you have to play the role of a hero. Mostly a romantic hero.

When the flat buyers start complaining about the progress of the project a builder needs to play the role of a villain.

When you abandon a project you have to play the role of a tragedy king.

A role of a hero, villain are short and easy to perform.

Whereas playing a tragedy king is a tough job. Mainly because in this role you have to make people cry.

If you want to follow acting style of DSK - you need to learn to cry instantly. In an instant a lot of tears must start flowing from your eyes. This needs a lot of practice.

Of course, you need to master all variations of crying. For example - in one on one meeting with a flat buyer you have to weep - means you have to cry silently - only tears - no sound.

Against that when you are confronted by a group of flat buyers in the office or in a police station - you need to do a lot of loud sobbing so that everyone in a group can hear you. Here tears are useless. Instead of that - along with sobbing loudly - you have to use your chest and heavy breathing to communicate your pain to a group. This works wonders if you continue to perform and create an impression that you may have a heart attack.

When you are on the stage addressing the get together of the flat buyers - you must cry like a baby - shed a lot of tears - use your handkerchief freely - keep on sobbing loudly - go on beating your chest - try to loosen the knot of your tie - breath as heavily as you can in the microphone - continue gasping for breath. Since you want to touch the hearts of the angry flat buyers sitting in the last row - you have to do over acting.

Along with the tears, loud crying & sobbing, heavy breathing and all - what you say in the particular situation is very important.

You need say something which will create an impression that you are crying for the flat buyers. Not for yourself.

You are crying because you can not bear the pain and suffering of the flat buyers.

You have to continue crying till someone says - "Saheb, please, don't cry - we trust you!"

3) Learn the art of telling lies:

We all are liars.

We all are afraid of truth.

No one can tolerate silence.

That's why we love to hear & tell lies.

These are the basic principles of communication.

No one wants to hear the truth - I am not going to get my money back - I am not going to get the possession of my flat.

That's why you have to tell lies - I have arranged 4 crores - you will receive part of your interest in the next couple of days - I am talking to a private equity firm which is ready to loan me money required to complete the project.

Your victims love to hear these lies. They find it comfortable to believe in these lies.

Of course, they buy your lies only if your lie doesn't sound like a lie.

Telling lies which doesn't sound like a lie is an art of speaking. You need a lot of practice to master the art of telling lies.

You are fortunate. As a builder you get a lot of scope to practice the art of telling lies. Use every opportunity to excel in the art of telling lies.

Develop confidence in your ability of telling lies.

Make sure that your lies are reasonable, to the point and based on the well known facts. Like Demonetization. RERA. Economic slowdown. Accident.

Use the right amount of truth & lie to frighten your victims. For example - "If I am sent to jail - you will not get your money / your flat."

Jail is a truth. Not getting money / flat is a lie. But naive victims take it as a complete truth.

If MahaRERA sent me to prison - you will not get your flat.

Every morning stand in front of your bathroom mirror & speak this sentence 100 times.

Practice is the only way to master the art of telling lies.

4) Learn Psychological & Emotional Manipulation Techniques:

Business is not about manufacturing, producing and providing services.

Business is all about psychological & emotional manipulation of your customers.

The entire political & business economy is based on psychological & emotional manipulation of the people.

So, stop talking about location, floor plans, specifications & amenities and focus on psychological & emotional manipulation of the flat buyers.

For example - DSK never talked much about a property - a flat - a house - Ghar.

He talked about "Gharpan". He called himself "Gharala Gharpan Denari Manase".

And you have seen the results - People paid exorbitant rates & bought his MHADA type houses!

If you ask anybody - "What is the exact meaning of "Gharpan"?"

"Gharpan" means "Gharpan"! Simple!!" , mostly you will get this answer.

What you feel when you are at your home - safe, secure, loved, protected, familiar, at ease, in control of your destiny - is the real & complete answer of that question.

It means that DSK has built his business based on the emotions.

But did he really offer safety, security, love?

No! He just created false impression about delivering these emotions.

Not only that!

DSK called himself "Manus" - a human being - a gentleman!

When the entire world knows that builders are criminals - inhuman creatures - DSK successfully convinced the people that he is a gentleman whose heart is full of humanity!

Obviously, to expand his business - DSK manipulated these emotions - and the result is - people blindly kept their hard earned money in his unsecured & illegal fixed deposits.

Now, these flat buyers & fixed deposit holders have realized that they have made a big mistake.

But they are finding it difficult to accept their mistakes.

They are feeling ashamed of themselves.

They are feeling guilty for succumbing to schemes like Aadhi Ghar Paise Nantar and booking a flat in DSK projects.

F D Holders are feeling guilty for risking their hard earned money for 2 - 3 per cent more interest and investing in his illegal companies.

Now, both are in denial mode.

According to Freud, denial is a primitive and unconscious defense against unbearable emotional pain.

That's why though Mr. Vijay Kumbhar has proved that DSK is not in a position to repay the fixed deposits and complete the stalled projects - these guys in denial are refusing to accept that MPID is the only way to recover their monies & flats. Every week these victims go to Economic Offences Wing and come back without registering FIR!

The condition of DSK's victims is like a lady in this famous story by Dr. George Simon -
A woman has been married to the same man for 40 years. She has just rushed him to the hospital because, while they were out in the yard working, he began having trouble speaking and looked in some distress. The doctors later tell her that he has suffered a stroke, is virtually brain-dead, and will not recover. Yet, every day she is by his bedside, holding his hand and talking to him. The nurses tell her that he cannot hear, but she talks to him anyway. The doctors tell her he will not recover, but she only replies, “I know he’ll pull through, he’s such a strong man.”

This woman is in a unique psychological state – the state of denial. She can hardly believe what has happened. Not long ago she was in the yard with her darling, enjoying one of their favorite activities. The day before, they were at a friend’s home for a get-together. He seemed the picture of happiness and health. He didn’t even seem that sick when she brought him to the hospital. Now – in a blink of an eye – they’re telling her he’s gone. This is far more emotional pain than she can bear just yet. She’s not ready to accept that her partner of 40 years won’t be coming home with her. She’s not quite ready to face a life without him. So, her unconscious mind has provided her with an effective (albeit most likely temporary) defense against the pain.

So like DSK if you want to remain out of jail you need to learn the techniques of psychological & emotional manipulation of the people.

5) The system is designed to protect those who have power - political & financial power:

DSK had contested Lok Sabha election on the ticket of Bahujan Samaj Party (BSP). Why?

Because DSK knew that the entire system is designed to protect those who have political & financial power - even if they are criminals.

That's why DSK feels that no one will take any action against him.

SEBI will not take action against him even if he hasn't fulfilled his commitment of paying interest to Non Convertible Debenture Holders or will not prosecute him for taking fixed deposits in the name of companies which do not have legal permission to do so.

Economic Offences Wing of Pune Police will not prosecute him until he lets them do it.

Till he can manage the so call 'leaders' of F D Holders - DSK don't have to worry about MPID case.

And most important - the mainstream media - Newspapers & TV Channels - bothers about advertisers and not the readers. Whatever advertisers feed - mainstream media publishes.

Not only that!

I have heard that even Mumbai Grahak Panchayat had sent some representative to Pune F D Holders to convince them not to file case against DSK under MPID.

DSK believes that when you are so safe in this system what is the point in leaving the country - like Vijay Mallya!

So, the point is, dear Pune builders, advertise in the newspapers - local as well as national - advertise on TV Channels - Regional as well as National - not for selling property but to buy
protection from them. Consider it as your insurance policy!

When the entire system is with you why bother about some Vijay Kumbhar & Ravi Karandeekar?

But what about some 4000 plus F D Holders & more than 1200 flat buyers?

Don't worry about them!

They know well that when some accidents takes place - like a train or airplane accident or a bridge or a building falls down - common man dies.

They have already accepted that fall of DSK is some type of an accidents and they are bound to lose their life. Period.

Point is - builders in Pune, follow DSK and don't bother about MahaRERA or any act.

DSK keeps on threatening & emotionally manipulating Fixed Deposit Holders

Thanks to a deafening silence of Economic Offences Wing (EOW) of Pune Police, Securities and Exchange Board of India (SEBI) and Stock Exchanges!







Pune-based DS Kulkarni group that had defaulted on repayments to thousands of investors is still trying to buy more time.

In fact, Deepak S Kulkarni, the group promoter, continue to promise several things to investors.

This includes promise for repayment by March 2018 and also threat to commit suicide if investors file a first information report (FIR) against him.

However, neither Mr Kulkarni nor DS Kulkarni Developers Ltd, the group's listed unit, is ready to reveal source of this funding.

In fact, D S Kulkarni Developers is mandated to update stock exchanges about every price sensitive information.

However, there is no update from the company on BSE or NSE websites.

Has DSK managed to find a source from where to pay depositors?

That would be a significant development and it is mandatory for a listed company to inform shareholders of any significant corporate development.

If DSK does not have the money to pay, it is simply misleading its shareholders.

One would expect the market regulator Securities and Exchange Board of India (SEBI) and stock exchanges to question DSK about these statements but they are silent.

The builder files a police complaint against the residents of Aarohi at Sus

The fight between Teerth Realties and the residents of Aarohi at Sus continues:

The builder of Arohi society has filed a complaint against its residents, alleging that they damaged his construction material worth Rs 9 lakh.

While the fight between the builder and the residents is not new, the complaint filed on Friday has left citizens in a fix.

They are claiming that the builder has intentionally filed this complaint as they are fighting for basic amenities the builder is yet to provide them at the society.

But the builder insists that the residents have threatened and beaten up his employees as well as damaged his property.

Residents of Arohi society have long been at loggerheads with the builder over the two vacant plots in the society which, according to them, had been allotted for parking and a tennis court.

“The builder had promised that he would set up a tennis court and parking space in these two empty plots. Now, he is planning to sell off these plots for construction. Hence, to block the plots, he ended up dumping all the construction material there. But it was becoming difficult for us to stay in all this filth. So, we decided to clean the area. All the residents participated and cleaned this patch,“ shared Manish Hissaria, one of the residents.

On his part, builder Vijay Raundal, owner of Teerth Builders, claimed that it was the residents who were harassing him instead. “We got an increased FSI for the buildings. I am constructing the buildings based on the previously approved plan. But these residents do not want this to happen.So they are running from pillar to post to ensure that I am not able to go ahead.........

Pune real estate market is in a phase of prolonged slowdown - CRISIL

Reasons for slowdown in Pune real estate market:
1) Fear of job losses in IT/ITeS sector
2) No significant creation of fresh jobs
3) Expectations of prices coming down keeping consumers on the edge

Pune real estate market is in a phase of prolonged slowdown - CRISIL

According to ratings agency Crisil, the realty market is in a phase of prolonged slowdown.

While it did not give city wise decline, the agency said absorption of new homes in top 10 cities (Pune included) has slipped by 8% each year since 2011.

The agency said one of the major reasons for this is investors staying away from realty purchases as prices have stagnated over the last few years.

It said people are also preferring to stay on rent.

“The sector has witnessed a decline in area booked and area launched over the last few years. Developers have been majorly focusing on mid-category luxury premium housing projects. This has created a wide gap in demand-supply dynamics, resulting in pent-up demand for affordable housing units and a huge unsold inventory of unaffordable units across most micro markets,“ Crisil said in its report.

In a sad news for those looking for a respite, the agency forecasted that “any respite is unlikely in the near future“.

MahaRERA orders Runwal Homes to pay back Rs 1.94 crore with interest to a flat buyer

Runwal Homes to challenge the order in the Bombay High Court -
'Since the sale agreement was executed in 2014,
MahaRERA did not have jurisdiction
as the Act came into effect in May 2017':

Complainants Avinash Saraf and Neha Duggar Saraf, approached the regulator after the developer did not hand over possession as stipulated in the sale agreement.

They paid Rs 1.74 crore between October 2014 and January 2017, to book a flat in Runwal Greens project in Mulund (West).

They said the flat was to be given to them on or before August 2016 as stipulated in the sale agreement. But the developer failed to do so.

The complainants said they paid 97% of total consideration of the flat.

They further contended under subvention scheme promoted by the developer, Runwal paid interest up to August 2016 under the tripartite agreement.

Thereafter the bank recovered instalments with interest from the complainants.

The Sarafs demanded the amount with 21% interest as compensation.

“When the complainants showed their willingness to cancel the booking, the respondent (Runwal) offered to refund amounts received, by its e-mail dated 1.03.2017. But the complainants insisted the developer pay interest at the rate of 21% and therefore, the matter could not be resolved,“ said the order.

“The complainants are entitled to get consideration amount of Rs 1,74,17,986, Rs 8,86,800 as stamp duty and registration charges and Rs 11,00,000, which is the amount of interest paid by complainants to bank during 30.09.2016 to 31.07.2017 with interest,“ said the order.

Baner Balewadi Residents are Angry with Pune Municipal Corporation

The residents of Baner and Balewadi - distressed by an ongoing water supply crisis - have refuted a statement by Pune Municipal Corporation (PMC), which claimed that it had sent letters to residents asking them to attend meetings to discuss the problem:

On Wednesday, the Bombay High Court lifted the stay on granting occupancy and commencement certificates to new constructions and building projects at Baner and Balewadi.

In its arguments, the PMC told the High Court that residents' associations in the area had not turned up for meetings that were called to discuss the water problem.

The statement has sparked anger among the residents.

“We have sent hundreds of letters to the PMC about the water crisis - something that has been on for the past 10 years. But instead of responding to our requests, the civic administration said societies had not turned up for discussions. This statement lacks logic. The civic administration must first understand that the water problem still persists in Baner and Balewadi,“ said Sarang Wable, of the Baner Balewadi residents' association.

Rajendra Sinha of the Aundh, Baner, Balewadi Vikas Manch said residents' associations were now planning to file a petition before the court on the water problems. He said the petition would name housing societies in the area as co-petitioners and demand the PMC compensate them for money spent on purchasing water tankers until now.

The petition would also demand a waiver of property tax and a stay on building permissions until water problems were resolved, Sinha said.

Darode Jog faces penalty for delayed possession of Padmanabh at Moshi

Maharashtra Real Estate Regulatory Authority (MahaRERA) issues order against Darode Jog Homes

1) Darode Jog has to pay Rs 17,44,291 to Pravin Hiwale and Rs 23,03,630 to Anand Mutha with interests - marginal costs of funds based lending rate of SBI at 8.15% plus 2% with effect from May 1.

2) Darode Jog has to pay compensation to the complainants at 9% from the date of respective payments till April 30, 2017.

3) Darode Jog has to pay the complainants Rs 20,000 towards the cost of lodging the complaints.

The order states that Hiwale had signed the sale agreement with the developer on October 10, 2014.

The developer had agreed to deliver the possession of Flat no B2-808 on or before December 2016 or within two-and-a-half years from the date of agreement, whichever is later.

In the case of Mutha, the sale agreement was done on November 28, 2014.

Hiwale was supposed to get possession of the in April and Mutha in May - 2016.

The developer, while registering the project with MahaRERA, mentioned the date of completion as December 31, 2018.

Bombay High Court lifts ban on issuance of commencement and occupancy certificates for housing projects in Baner & Balewadi

In the last 6 months, after Bombay High Court issued the stay order,
no individual flat-owner or housing society in Baner Balewadi
came forward with the complaints about water shortage!



The Pune Municipal Corporation (PMC)'s advocate said it wrote letters to housing societies, asking their representatives to attend meetings but nobody had turned up.

“If there is any violation, we can take action. I'm waiting for the last six months. Water is something you cannot stay without,“ said the Chief Justice (CJ) Manjula Chellur.

“We are surprised to hear that none of such meeting (sic) were attended by (housing) societies or occupants. If there was really a water problem, as severe as expressed by the petitioners, the persons affected would have approached this court,“ the judges said in their order.

They - Chief Justice (CJ) Manjula Chellur and Justice Nitin Jamdar - added, “We cannot totally shut our eyes or opine that there is no water problem. It may not be to the extent expressed by the petitioners but there is bound to be water problem with so many flats coming up."

The court was hearing a public interest litigation (PIL) filed by corporator Amol Balwadkar.

Earlier (in May 2017), the court had restrained the Pune Municipal Corporation (PMC) from doling out these - commencement and occupancy - certificates - to the new buildings, while hearing the PIL.

The petition stated that over 200 societies were facing problems in securing basic amount of water - 150 litres per person - which is provided by the PMC on daily basis.

The overall requirement is 165 lakh litres. However, the PMC only provided 60 lakh litres, which is far from adequate.

The report also stated that it had supplied 21,533 water tankers in these areas between 2015 and 2016.

Apart from this civic body help, the residents had arranged for 1.40 lakh tankers at the cost of Rs 12 crore in the same duration to replete their supply.

After hearing the case on Tuesday, Chief Justice Manjula Chellur and Justice Nitin Jamdar asked for formation of a committee to keep an eye on water supply and the availability scenario, a report of which has to be submitted every two months.

"Let us see how this committee works,“ said the CJ, adding that the PIL would be kept pending.

Slowdown in Pune real estate market to continue

According to Cushman & Wakefield, Knight Frank & Gera Research Reports:



Demonetisation, Real Estate Regulatory Act and GST combined has had a telling effect on new property launches in the city.

As per a study by Cushman & Wakefield (C&W), real estate services firm, Pune saw a decline of 28% in property launches in the affordable segment (definition of which has changed).

Overall, the city has witnessed a dip of 41% in new launches.(see box)

This the third such report that points to a slowdown in new property launches.

In July , a study by property consultancy firm Knight Frank had shown a year-over-year decline of 9% in new home launches in the first half of 2017 and a sequential fall of 30%.

Later, home developer Gera's research report pointed to a similar trend in its half-yearly survey.

The report had shown that new unit launches fell by 26% in the period between January and June 2017 over the same period the previous year.

The agency - Cushman & Wakefield - also predicted that the scepticism to launch new projects will continue for some more time.

Flat buyers will now be covered in case builder goes `bankrupt'

Amended Rules Give A Say To All Stakeholders - including the flat buyers:



The Insolvency & Bankruptcy Board of India (IBBI) has amended rules to mandate that any resolution plan for a company has to explicitly state how it has dealt with interests of all stakeholders--a move aimed at protecting the interests of home buyers of real estate players such as Jaypee Infratech and some of the entities of Amrapali Group.

The revised rules were notified by the regulator for insolvency and bankruptcy proceedings last week and will ensure that banks and other creditors do not get away by protecting their interests at the expense of others who are impacted by the action. Banks are part of the creditors' committee, the key decision-making body after a company is admitted for bankruptcy.

“The change in the rules has plugged a gap as flat buyers are of the view that there is nothing to protect their interests,“ said a lawyer specialising in bankruptcy cases.

Some builders in Pune haven't gone out of business yet

PNB Housing Finance Property Expo Pune 2017, organized on 7th & 8th October, proves that some builders in Pune are still in business!



The response was poor. Mainly because of the poor promotion. One sales executive said.

The venue was wrong. The other sales executive said.

Paranjape Schemes rules on Prabhat Road, Bhandarkar Road, Law College Road. Not Kolte-Patil - Solitaire - Pate - Pristine - Siddhashila - ABIL. Some sales executive said.

If HDFC had been the organizer - response would have been better. One more sales executive said.

What is your opinion, Ravi? Someone asked me.

In the current market, how many builders participate in the exhibition is more important than how many people visit it. I said.

Cheer up guys! All of you still have your jobs. Your builders are still in business. What more do you want? I said.

What say you?
