Mi casa está en camino de Kesnand Wagholi!

Fingers speak louder than words!


At MiCasaa, 1 BHK, 1.5 BHK & 2 BHK Flats, opposite Ayurvedic College, on Kesnand Road, Wagholi Pune 412207, everyone was speaking Spanish!

"Buenas tardes, Sr. Ravi Karandeekar!," the watchman at the main gate said.

"Bienvenido a mi querida!," the receptionist at the show flat said.

And you know what? I don't know how - but, I said "Me gustó su piso piloto mucho!"

"Mostrar solo plano o algo más también .." asked the receptionist.

"Se ve bien .... puede que lo demuestran ...," my eyes told her more than my words.

"Claro, pero no aquí..," she said and started walking.

I followed her to the pandal. But, lost her in the crowd.

"Cuál es su necesidad?," a sales executive grabbed my hand & asked.

"Cuáles son los presupuestos?," I asked.

"1 BHK 27 - 28 Lakhs, 1.5 BHK 31 - 32 Lakhs, 2 BHK 42 Lakhs, 2.5 BHK 47 - 48.5 Lakhs & 3 BHK 58.5 Lakhs," the salesman said.

I don't know what happened. But I couldn't utter a single word. Neither in Spanish. Nor in Hindi. So, i used my finger. You know which. To communicate my feelings about the property prices.

On the rainy morning of Saturday, Sachin Kulkarni, M. D. of Vastushodh Projects Pvt. Ltd. (www.vastushodh.co.in) and developers of AnandGram (www.anandgram.co.in) & UrbanGram (www.urbangram.in), welcomed me at the site of UrbanGram Chakan.

Thanking me for sparing my valuable time, Sachin gave me a brief intro of the project and took me to the venue of Bhoomi Poojan. Taking my seat in the beautifully decorated pandal, I said, "This is too much - please, stop treating me like a VIP. After all, we are old friends!"

Till Mrs & Mr Sachin Kulkarni started performing Bhoomi Poojan, every member of his family proved that all of them are perfect hosts. So, I didn't notice that the pandal was almost house full until someone sitting at my table asked me, "I am in C. Which is yours?"

"I don't know!," I gave my favorite answer and asked him, "How did you find out about C?"

"I received the call. I went to the office. Since, i was amongst the first few - got the flat of my choice - in the C Building!," he said.

"But, why did you receive the call?," I asked.

"Because, I applied for a 2 BHK Flat for 20 Lakhs at UrbanGram Chakan in Vastushodh Gruhsandhi Yojana. After the scrutiny - my application was short listed - so, they called and allotted the flat!," he said.

"Lucky you!," I said and got up.

Pretending to be a photographer, I went to every table in the pandal. Introducing myself as, "C Building" and asking, "Yours?" Stopping only to take a call from my friend. Who wanted to book a flat. Coming out of a pandal, I asked him, "What is your budget?"

"Not much - say - 20," my friend said.

"Well - well! Now a days, if your budget is around 20 - 25 lakhs - you apply for a flat. After the scrutiny - if your application is short listed - you are allotted a flat - those who are allotted - are invited for the Boomi Poojan Ceremony - this is the new way of buying a property in Pune real estate market!," I told my friend.

"But - where to apply?," my friend asked.

"Good question! However, - when to apply - would have been better!," I said.

"OK. When to apply?," my friend said.

"May 2013!," I said and requested him to call me some other time. I needed sometime to accept that I was not the guest of honor at UrbanGram Chakan.

Maharashtra Housing (Regulation and Development) Bill 2012 - "The Trap is Set!"

"It’s a game changer Bill,” Sachin Ahir, Minister of State for Housing


Yesterday, Monday, 16th July 2012, Maharashtra Legislative Assembly passed Maharashtra Housing (Regulation and Development) Bill 2012. Maharashtra Legislative Council, the upper house, for sure, will pass the same in this session only. Then The Bill will be sent to the President of India. The President's consent is expected in six months time. After the President's assent the law will come into force.

It means that, the trap is set! With the tempting bait of Housing Regulatory Authority and Housing Appellate Tribunal!! To lure the naive property buyers - to book a flat by giving away their hard earned money (mostly 20 per cent of the property price) to the builders and - spend next 20 years - or more - as the slaves of housing finance companies.

Yes! It's a game changer bill!! For years, the buying of a flat was only a 'mind game'. To win the game, builders & banks were spending crores of rupees to brainwash the property buyers to book a flat just by looking at the artist's impressions printed on glossy papers. Now, with this Bill, the mind game of buying a flat - is going to turn into a legal battle.

I was shocked to read what Minister of State for Housing said after the Bill was passed in the lower house. Mr. Sachin Ahir said that because of this Bill, the popular perception about the Maharashtra Government and public representatives would change. Now, the citizens of Maharashtra will never say that we favor the developers.

Come on, Mr Minister! Do you think 'hum doodh peete bacche hai?' Every citizen of Mumbai knows that Maharashtra Government works hard for the home buyers. Not only the current government but the past governments too. Way back from 1986! How can anyone forget Maharashtra Government's kind gesture of giving away 230 acre land in Powai Mumbai at the rate of Re 1 per hectare to Mr. Niranjan Hiranandani to develop affordable housing?

Out of 1,48,000 Mumbai Mill Workers, ask anyone about 6,984 houses constructed by Maharashtra Government. The mill worker will tell you that "Bhagwan Ke Ghar Der Hai Andher Nahin Hai" but in the Government of Maharashtra there isn't even Der. True, 1982 to 2012 is not really much time!

Same with the survivors of those who lost their lives in the Samyukta Maharashtra Movement - to form the state of Maharashtra. On this 52nd anniversary of Maharashtra, the governor announced free homes for them. Someday, we all know, they might get them too!

Every citizen of Republic of India knows that Maharashtra Government does not care only for the citizens of Maharashtra but also for the soldiers of the Indian Army. Particularly those who fought the Kargil war. Forgetting what they did for the Adarsh Housing Society is nothing more than humbleness of the all ex-chief ministers of Maharashtra. But the citizens of India will never forget their contribution.

Same with Pune! Kakade City on Karve Road proves that Maharashtra Government's target - I mean - interest is a common man.

Point is with Maharashtra Housing (Regulation and Development) Bill 2012, Government of Maharashtra has widened it's catchment area. Now, Maharashtra Government's interest is not only limited to a few lakh citizens of Mumbai or Pune, or a few hundred soldiers of Indian Army but every property buyer in Maharashtra.

Maharashtra Housing (Regulation and Development) Bill 2012 - "It's a Trap!"

3 Years' Jail for the Builder!


In the last budget session, Maharashtra Government introduced the Maharashtra Housing (Regulation and Development) Bill 2012. In a great hurry. Without inviting comments from the citizens. Activists called it pro-builder Bill.

So, a 19-member joint select committee of the Maharashtra state legislature was formed to give "property buyer friendly paint" to the Bill. This joint committee has recommended a few "attractive" amendments to the Maharashtra Housing (Regulation and Development) Bill 2012. Like 3 years imprisonment for the builder for not obeying the Housing Appellate Tribunal!

Sachin Ahir, minister of state for housing, is going to reintroduce "The Bill", along with the recommendations, in the legislative assembly today. "The Bill" will replace the Maharashtra Ownership of Flat Act (MOFA) that has been in force since 1962.

If you look at the recommendations, you will realize that The Bill is nothing but the government's way of decorating the trap set by the builders to catch the naive property buyers. An effort to make the scared property buyers "feel safe" to give away hard earned money - for free - to finance the builder's business.

The Maharashtra Housing (Regulation and Development) Bill 2012 is nothing but Maharashtra Government's contribution towards promoting the idea of 'booking a flat' and helping the builders to take prisoners. Assisting housing finance companies to convert the property buyers into slaves for life. To trap the vulnerable property buyers who are threatened by the irrational property price rise and are desperate to own a home at any cost.

All these efforts, to establish a 'Housing Regulatory Authority' and a 'Housing Appellate Tribunal', 'Maharashtra Housing (Regulation and Development) Bill 2012', are nothing but Maharashtra Government's way to pay back to it's partners - builders & banks - for the revenue it earns from the stamp duty, registrations charges & VAT from the property buyers.

The government always plays the role of 'a good cop' when it deals with it's citizens. So, now, there would be a Housing Appellate Tribunal. In case of a dispute with the builder, a flat owner can go to the tribunal. If the builder disobeys the tribunal, he can face 3 years imprisonment.

This provision of 3 years imprisonment existed in the old Maharashtra Ownership Flats Act (MOFA, 1963) too! But do you know of any builder who was imprisoned? No! Because regulating the real estate industry is just a farce. Main motto of the government is to promote the idea of booking and to assure uninterrupted supply of interest free funds from the property buyers to the builders.

Risks Involved in Booking a Flat:


So, for me Maharashtra Housing (Regulation and Development) Bill 2012 is nothing more than the a warning to all those who are not aware about the risks involved in booking a flat. To get the idea, please, have a look at the recommendations:

1) The builder cannot make any alteration to a flat once it is sold - without the flat purchaser's consent.

2) The builder cannot add a floor or a wing to a building - without the flat purchaser's consent.

3) Any amenity promised - such as a garden - cannot be altered.

4) If the builder fails to give possession of a flat within the promised period or abandons a project, he will not only have to refund the amount with 15% interest, but also have to pay a penalty.

5) If the housing regulator is satisfied that the builder is unable to complete a project, the regulator can let the property buyers come together and appoint contractors and consultants to complete construction of the project.

6) A flat purchaser can demand rectification of any defect within five years of the purchase.

7) Preserving open space is mandatory, it cannot be used as a parking lot.

8) Fire safety systems in high rise buildings are mandatory too.

9) The builder can not make changes to recreation facilities without the consent of the property buyers.

10) If the purchaser fails to pay any outgoings for over three months, the builder can cut off essential services - like water, power and gas - only after the matter is heard by a competent authority.

11) The builder cannot sell 10 per cent flats in each building. These flats will be retained by housing regulatory body till the completion & occupation certificate is obtained by the builder. The list of these 10 per cent flats will be displayed on the government website so that no property buyer will buy them.

12) No pre-launch bookings! As per The Bill, the builder can not sell the flats , accept the bookings, before the plans are approved by the authority.

Now, the builder has to submit the plans, get sanctions & commencement certificates, display the plan on government's website and then only can accept bookings.

Moral of the story:


So on & so forth. In short, it's not about a Maharashtra Housing (Regulation and Development) Bill 2012 or about a good builder and a bad builder. It's all about the way you buy the property. When you book a flat, you buy a concept on paper. While implementing that concept, anything can happen. Sometimes, may be because of genuine, valid reasons. But, for sure, mostly, at your cost. However, your builder would not be sent to jail even for a day. But, you suffer for life. Am I right, Mr. Sachin Singh, the first citizen of Nanded City Pune?

So, point is, don't get trapped! Let the builder build, obtain the completion & occupation certificate, and send a limozin for you!!
