How to verify land and property details on Maharashtra Government's websites

Mr. Vijay Kumbhar at Moneylife Foundation:



The Real Estate (Regulation and Development) Act, 2016 (RERA) in Maharashtra (MahaRERA) was brought to ensure transparency and efficiency in realty deals, especially in the sale of plots, apartments, buildings or real estate project and also protect interest of consumers.

However the way MahaRERA is being used by the vested interest, I see no hope for common buyers who are not alert to its issues, says Vijay Kumbhar.

The Pune-based right to information (RTI) activist was speaking at Moneylife Foundation on 'How to use RTI for Property Matters and Land Plotting Schemes”.

Since RERA does not provide all the answers, Mr Kumbhar guided people on how they could verify land and property details themselves on government websites that already upload key information that is easily accessible to all.

Mr Kumbhar strongly urged people investing in property to make the effort to use tools and information that are already available in the public domain.

He pointed out how his entire investigation into the D S Kulkarni Developers fraud and their dubious property transactions were unearthed by using public tools, without even having to file Right to Information (RTI) applications.

What is the most serious problem in Pune real estate market?

No communication between builder and flat buyers
is the most serious problem in Pune real estate market:

Builders in Pune treat their flat buyers like shit.

Why wouldn't they! I ask myself.

Pune flat buyers don't know basics of real estate business.

The flat buyers are the employers and the builder is their employee.

The flat buyers are the owners of the project and the builder is their "Sevak" - the service provider.

The flat buyers are the majority stockholders of the company and the builder is a minority shareholder and a chief executive officer.

Instead of that the flat buyers in Pune think & behave as if the builder is a king and the flat buyers are his subjects.

Pune flat buyers accept that the builder is their all powerful ruler and flat buyers have no power - no rights - no voice.

When you yourself accept that you are low life scum - why would your builder respect you!

Is't it obvious that your builder treats you like a shit!!

We all know that only babies play with poop.

Not adult rulers.

Rulers rule their subjects.

Rulers give orders.

Rulers don't communicate.

That's why there is no communication between builders and flat buyers in Pune.

And that's the most serious problem in Pune real estate market.

Pune flat buyers - like the unhappy customer of Tesla - don't Tweet complaint.

And if someone dares - the builders in Pune - not only ignore it - but some even threaten the flat buyer.

If the builder doesn't threaten - the other flat buyers in the project - become angry with the complainant flat buyer for making builder angry!

Result is both - builders and flat buyers - suffer because of no communication.

DSK has to beg for more time to complete the project.

Rakesh has to request me to talk to the builder and find out about possession date.

A builder in Wagholi didn't pay the bill and flat buyers had to live without power - in the dark - without water - without lift.

Only flat buyers can save themselves from this type of abuse.

Change your attitude.

Understand who you are.

What is your role.

What are your rights.

How you should be treated.

Start relationship with your builder on the right note.

Don't book a flat because the builder is offering -

"Gharavar Ghar Free - Buy 1 Flat Get 1 Flat for Free".

"Sone Ki Barish" - Gold with a flat.

"Interest Free Homes"

"No EMI till Possession"

"No GST"

"Free Furniture, TV, Fridge etc"

"Trip to Switzerland"

"No Stamp Duty & No Registration Charges"

Instead of that, book a flat with

1) a builder with whom you can talk on the landline phone or on Skype in office hours

2) a builder who will personally reply to your email in 24 hours

2) a builder who will meet you in his office for 30 minutes at least once in a month

2) a builder with whom you can chat on Facebook Messenger

3) a builder whom you can send direct message on Twitter and expect reply in 12 hours

4) a builder who is available on Indian Real Estate Forum

5) a builder who arranges all flat buyers meet on first Saturday of a month between 4pm and 5pm

(For example, a builder like Mr. Jitu Sir of Pethkar Projects Siyona at Punawale!)

If you do this, for sure, you will not have to face the most serious problem in Pune real estate market - no communication between builder and flat buyers.

Withdraw the GST applied on the Co-Operative Housing Society Maintenance Payments

Petitioning Chief Justice of India:



As we know that 18% GST is made applicable on the maintenance payment made by very own members of the cooperative housing society to the same co-operative housing society managed by the same members themselves.

I feel that this decision of the Government is not in line with the basic concept and principles of co-operative housing societies in India.

Hence, through this PIL, I appeal to Honorable Supreme Court of India to withdraw the GST (Goods and Service Tax ) applied by the Government of India on the Maintenance Payment made by very own members of the cooperative housing society to the same co-operative housing society managed by the same members of the housing society themselves.

There are following valid questions to be considered before making GST applicable to the maintenance payment of the flats / house in Co-operative Housing societies:

1. The Co-Operative Housing / Residential societies in India are maintained by the very own members of these co-operative societies.

These members of the societies come forward voluntarily to serve themselves through their own services to their own flats / houses in the society.

These members are neither paid any salary nor monitory benefits for their services provided by them to themselves in the co-operative societies.

Meaning, members are providing their own services to themselves.

So, if I am providing the service to me and that service is also consumed by me only, then why should I pay the GST tax on it to the Government for the same?

What actually happened at DSK Anandghan flat owners meeting on 21st September 2017

1) DSK promised to arrange funds and restart construction of DSK Anandghan on 15th November 2017 and give possession in 2 years time - means in 2019.

2) Ms. Hemanti Phadke Kulkarni offered Rs. 10,000 per month as a compensation for delayed possession for the period between the date of possession in the agreement and the actual possession of the flat.

3) The DSK Anandghan flat owners clarified that they had heard Ms. & Mr. DSK. They haven't accepted their promises & offers.

4) In short, nothing happened as I had imagined in my blog - "Breaking News! Flat owners takeover DSK Anandghan!!"

Tomorrow's News Today Bureau / Sep 21, 2017, 08.40 AM IST / Pune- At a grand ceremony organized at 11am at Maratha Chamber of Commerce on Tilak Road in Pune, Mr. Shirish Deepak Kulkarni, Managing Director and Chief Executive Officer of D S Kulkarni Developers Ltd, handed over the development rights of DSK Anandghan, the stalled premium housing scheme of 1 BHK & 2 BHK flats within DSK Vishwa on Sinhagad Road in Pune, to the ad hoc committee of DSK Anandghan flat buyers.

"Construction of a housing project is like gardening. It needs a lot of personal involvement of the developer. It's very clear that for the rest of our lives I & my family would be preoccupied with the legal matters. Hence DSK family will not be able to devote enough time and resources to complete the ongoing housing projects of the group. That's why I am handing over the responsibility to complete DSK Anandghan to it's true owners. The flat buyers!," said Mr. Shirish Kulkarni and handed over the legal documents.

"MahaRERA is here to promote real estate business. MahaRERA is not a big boss. MahaRERA is a big brother of the all builders in Maharashtra. Whenever there is an issue between the builder and the allottees - you come to the big brother - because you know that Gautam Chatterjee is square and fair. That's why when more than 60 percent allottees in DSK Anandghan approached me and expressed their desire to complete the project - I told Shirish - who is like a son to me - consider the offer seriously. If you do it voluntarily - you will be able to retain trust & respect your legendary father - Mr. DSK - has gained over the years. Otherwise, I will have to exercise my authority & force you to handover the project to the allottees. Shirish proved that he is not afraid to take a tough decision. He agreed immediately! I salute the allottees & Shirish from my heart!," said Mr. Gautam Chatterjee, MahaRERA Regulator, who presided over the ceremony.

"On behalf of all flat owners in DSK Anandghan, I thank Mr. Gautam Chatterjee, MahaRERA Regulator for convincing Ms. Hemanti Phadke Kulkarni to give us compensation for the delayed possession. It was Mr. Chatterjee who firmly said that - "Ms. Hemanti, you have to pay penalties for delays beyond what is stipulated in the registered agreement for sale. The possession date will not be based on the date submitted as the revised date at the time of registering the project with MahaRERA. It means that, Dear Hemanti, you have to pay for the period between 31-8-2018 - the possession date in the agreement - and 30-4-2021 - the revised date of possession submitted to MahaRERA!," said Mr. Deshpande, chief promoter of DSK Anandghan Co-Operative Housing Society.

"On behalf of all flat owners in DSK Anandghan, I thank Pune Police Commissioner Rashmi Shukla for explaining MPID Act to Ms. Hemanti Phadke Kulkarni and successfully convincing her to cancel "The Deed of Mortgage" by which she mortgaged the plot of land of DSK Anandghan - Gat No 186 Part 187 and 188 in Kirkatwadi - without obtaining our - the flat owners - consent! Not only that!! Ms. Shukla and Mr. Chatterjee also convinced Ms. Hemanti to give audited report of receipts - monies paid by the flat buyers to DSK - and deposits balance amount in escrow account - as per the 70% rule of RERA," said Mr. Deshpande, the deputy chief of DSK Anandghan Society.

"When Mr. Chatterjee came to me with the proposal of the DSK Anandghan flat buyers - I felt as if - once again - I am standing in Kurukshetra! Brothers are fighting with brothers!! However, I gave Mr. Chatterjee go ahead. Because, Modiji, my leader, Tweeted me - That is what you have done in the last life and that is what you are doing in this life. Karma. I congratulate all for upholding the rule of law," the guardian minister, Mr. Girish Bapat, read this special message of Chief Minister Mr. Devendra Fadnavis.

"If I have not taken initiative this would not have happened! It was me who persuaded DSK Sir to handover the reigns to Tarunai - to youth - to Shirish. It was me who persuaded Shirish to accept the reality and do not try to prolong this issue till 30-4-2021 - MahaRERA possession date. That's why he agreed to accept the proposal of Gautam Chatterjee & DSK Anandghan flat owners. This is my constructive reply to all Punekars who criticized me for taking the side of DSK Sir. Once again, I have proved that "Revolutions starts at a big Home and then it percolates in the small homes". This has happened in Baramati. Now, it is happening in Pune. Only because I am responsible for Pune," said Mr. Abhijeet Pawar, who presided over the function.

Save Wagholi - Provide Better Infrastructure & Basic Amenities

Wagholi Housing Societies Association (WHSA) is petitioning Prime Minister of India - Shri Narendra Modi and 11 Others including Chief Minister of Maharashtra - Shri Devendra Fadnavis !



The construction of housing societies, big factories, warehouses are in full swing here.

Speed with which new constructions are being permitted by authorities and people moving in,
the infrastructure of the area should have drastically changed too
but believe us it remains the same as it was 10-15 years ago.

No proper roads,

No water by authorities,

No garbage collection,

No drainage system,

Load shedding every other day by MSEDCL,

Goondaism by localites,

No police patrolling,

No traffic lights,

No street lights,

No speed breakers

and WHAT ELSE NOT.


Grievances from Housing Societies:


1) No Water from Grampanchayat / Corporation.
Societies are forced to purchase water from tanker mafia who charge big time

2) No Garbage collection from GP.
Societies are forced to arrange dumping on their own.

3) Dumping and burning of garbage beside one society or the other without their knowledge that not only stinks but also increases health issues.
Note: GP does collect garbage from native Wagholi residents as if only they are humans and not citizens living in societies.

4) No Drainage System from GP at all.
Societies are forced to arrange waste drainage on their own into natural and nearby river streams.

5) No Street Lights on roads making them scary for residents to cross during nights.

6) No Proper Roads / Countless Potholes and
residents of housing societies are forced to live in a tribal like conditions.

7) No Police Patrolling at day or nights.

8) No Police Station or Police Chowki.
Nearest is Lonikand police station which is 6-8 kms away and is as good as reaching more into another village.

9) No Traffic Control at all.
Traffic Imagine a crossing without traffic signal and without any traffic police.
Chaos on every other crossing of Wagholi at peak time.

10) Heavy Encroachment that leads to more narrower roads impacting the free movement of traffic.

11) Incapability of Wagholi GP in handling vast number of societies in providing services
and hence they do not register any new housing societies.

12) Regular load shedding from MSEB.
Old transformers, lines need revisit, servicing, replacement etc.

Maple Aapla Ghar Sanaswadi - Ready Possession 2 BHK Flat for Sale

Which is certainly a smart & people friendly decision.

He has taken the risk of booking it when there wasn't anything at the site.

There was a huge uncertainty about completion & possession.

But the one who will buy his ready possession flat today has to take minimum risk.

Everything is there in black & white. One can inspect and decide.

Giving someone this type of an opportunity is certainly a people friendly decision.
