Better buy a plot at Pirangut & construct a bungalow

My dream home:




Is a 28 - 29 year old young boy buying his own home a sign of prosperity? A symbol of success, status & wealth?

Or is he a victim of debt based economy which needs a lot of people to be in debt all the time?

Are the property exhibitions really about the properties?

Or are these exhibitions really organized to sell homes or
to force the young people to prevent from saving their salary and become a debtor of a bank for life?

After talking with Ms & Mr Kulkarni at Sakal Vastu - I started wondering.

It was obvious that they were ideal home buyers. A young couple looking for their first home. Curious to know whether the experience of visiting the property exhibition was encouraging or disappointing - I requested them to give me a video interview.

"The experience was encouraging. My budget is around 55 Lakhs. But most of the 2 BHK Flats were beyond my budget - costing around 70. However, there were a few stalls offering bungalow plots. A 2 guntha plot at Pirangut was only for 18 lakhs! It means that - if I buy that plot and spend some 25 - 30 on construction of a bungalow - I can own a home - in my budget!," Mr. Kulkarni said.

"WoW!," I said.

"I am an IT professional - working in Hinjewadi. For me, Pirangut is a convenient location! By the way, I am born & brought up in a bungalow on Sinhagad Road - so, I hate living in a flat - same about my wife - anyway - I am not in a hurry to shift in that bungalow - for a while - I can use it as my weekend home - as an investment property," Mr. Kulkarni said.

"Yes! Lucky you!!," I said.

When I was editing the video, I enjoyed the expressions on their faces. Both of them looked so young & so happy.

My budget is 55 lakhs - I liked the way Mr. Kulkarni made this statement.

How?

Home loan eligibility!!

Yes! I hear this type of a statement everyday.

"My budget is 55" - people say this - with a casual confidence - as if they are saying - "my weight is 68 kg" - "my height is 5' 8"" - "my blood group is B+"!

It's not your budget, dud. It's your capacity to create a debt!

It's not your worth or wealth. It's your liability!

God has sent you on earth because a bank needs debtors!

You are an organic fuel of this debt based economic engine.

Your parents know this. Your in laws know this. Your colleagues know this. The organizer of the property exhibition knows this. That's why they put pressure on you to book a flat.

Coconut is for the god in heaven.

The god on earth needs sacrifice of - bali of - the beloved young son.

You are naive. You don't know what they are doing to you.

You don't know the difference between a liability and an asset. Debt and investment.

And that's better for you! Illusion is encouraging. Truth is discouraging.

I am sure - like every good son - you will name your bungalow - "पितृ कृपा"!

Victims of Proposed N A Bungalow Plot Scams can recover their money!

How to file & win Consumer Court Case - without a lawyer - against Proposed N A Bungalow Plot Scamster and recover money with interest!




Yes! Even IT Engineers in Hinjewadi & Kharadi can file a case - without a lawyer - in consumer court & recover their money!!

Sounds impossible. Right?

But it's true.

Sumit, Vijay & their friend were as stupid as any IT Engineer in Pune.

Without doing any due diligence they 'invested' their 40 + lakhs in N. A. Bungalow Plot Scheme called Nine Jewels Prestige at Wadki on Hadapsar Saswad Road launched by Master Home Facilities Services - MHFS - a.k.a. Sumer Pratham.

The agreement of N A Bungalow Plot was registered.

But when the developer took some 4 months to handover their registered agreement they felt that something was fishy.

Eventually, they found out that the plot was not actually N A - as mentioned in the registered agreement.

Not only that!

It was not a plot at all.
Because the developer had not done any plotting.
The collector had not sanctioned the plotting scheme.

And they had paid the price of a N A Bungalow Plot for some piece of agricultural land - which existed only on the paper - not on planet earth.

How to file a consumer court case - without a lawyer:


There are around 50 stupid people who have invested in this so called scheme.
But only these three guys - Sumit, Vijay & their Friend - realized that their agreement was nothing but a piece of shit!

Rest of stupid investors are still hoping that someday what is there on the paper will take shape on earth. Miracles happens! You know?

Let us recover our money.
Three of them decided.
Of course, the developer refused.
Now, what?

There is something which is called - Consumer Protection Act, 1986. Under it - National Consumer Disputes Redressal Commission (NCDRC) is there in India. Which is popularly known as consumer court. They found out.

There are not only stupid investors and crooked scamsters in this world - there is a consumer court too - was nothing but Sakshatkar for the three.

They told about this Sakshatkar to other victims.
But victims were afraid of the scamster.
The scamster will get angry if we go to consumer court.
The scamster will scold us. May beat us.
Who knows? The scamster will punish us by not giving our plot.
Consumer court takes long time to deliver justice.
We do not have time to waste in court proceedings.
We do not know anything about the law.
Scamsters - particularly builders & developers - are beyond the reach of law.
The natural born stupid investors raised many objections about filing a case in the consumer court.


But Sumit, Vijay & their friend went ahead.
They filed a case in the consumer court.
Without a lawyer!
In the consumer court - they defended - represented - themselves.
They became their own lawyers.

Not only that!
They won the case against the developer!!
The consumer court - Pune District Forum of National Consumer Disputes Redressal Commission (NCDRC) - gave verdict in their favor.
They are going to get what they have paid to the developer + 9% interest on that moneys - from the date case was filed till they get their money back + compensation & case expenses.
Isn't this great?

It's not only great. It's simple too!
Anyone who can read, write means type and speak can file a case without a lawyer in consumer court and win.
Yes, even IT professionals! Even if he can not read, write means type & speak Marathi!! Along with Marathi consumer court proceedings are conducted in English too. (In fact, use of Marathi in consumer courts in Maharashtra is the recent phenomenon!)
Filing a case in the consumer court is not only simple - it is not at all time consuming.
What all you need is proper documents.
Follow the right formats - submit essential documents - pay nominal fees - submit your case.
If you made some mistake in your submission - don't worry - the staff at court will guide you.
Once your case is accepted - inform the accused by speed post and wait for the date of hearing.

These three guys - had three hearings - in 6 months - and received justice.
At every hearing they got a few minutes - from 5 to 10 minutes only - to presented their case.
On every court date - they took only half day leave at work.
Which their managers sanctioned proudly.
The atmosphere at the court was not at all tense. The judges were kind.

To keep in touch with the proceedings of court case - there is the ConfoNet - Internet based Case Monitoring System Computerization & Computer Networking of Consumer Forums in Country - which Sumit, Vijay & a friend - who is abroad - used it extensively. Plus Google is there to teach you about the consumer law.

Flat v/s Plot - Which is a Better Investment?


I started Ravi Karandeekar's Pune Real Estate Market News Blog because I wanted to help home buyers to buy a home in Pune. I thought that sharing info about ongoing housing projects in and around Pune would help home buyers to make a right decision.

I started visiting sites and sharing information about newly launched projects on my blog. I didn't stop at that! I published my mobile number - 919860044110 - on my blog and started offering 3 minutes free advice about buying a home in Pune.

As expected, more and more people started calling me for free advice. However, over the period, I realized that I am receiving more calls from real estate investors - second home buyers - than genuine home buyers. This realization made me sad.

I become more sad as the number of home buyers' calls went on decreasing day by day.

A young, intelligent, educated, salaried, first time home buyer who is eligible for a home loan - can't buy a 2 BHK Flat at a convenient location is - social injustice.

It's systematic economic exploitation of the young population. Particularly the IT professionals working in Hinjewadi & Kharadi.

Only because of these IT guys, Indian economy could achieve around 4 - 5 per cent GDP growth in the last 4 - 5 years and bring in good amount of foreign direct investment in the country.

But, in return what did these IT guys get?

Nothing!

These IT guys can't fulfill even their basic needs. These IT engineers can't buy a decent home with proper approach road, water & power connection.

These IT professionals in Hinjewadi & Kharadi have become slaves of the Indian economic policy.

I went on convincing myself to accept this truth. But, I couldn't. And, I became more sad.      

At the same time, all was not well with real estate investors too. Unscrupulous builders & land developers had set traps to kill these naive investors.

Builders trap was 'affordable - budget - compact - homes'.

Land developers' weapon of mass destruction was "Proposed NA Plots".

"Affordable - budget - compact - homes" means poorly designed 1 BHK Flat of around 410 - 430 sq.ft. carpet area & a 2 BHK Flat of around 610 - 650 sq.ft. carpet area - located in some faraway - remote - non urbanized - location - without road, water, electricity, drainage and waste management services and social infrastructure.

Assuming that in the near future - when the area would develop - we can win a jackpot - these naive investors are paying irrational property prices for these worthless properties.

"Proposed NA Plots" means a cut piece of an agricultural land - sometimes on the hill top & hill slope - which seller can not sell and a buyer can not buy. Because -
1) Agricultural land can not be divided into pieces.
2) Only a farmer can buy an agriculture land.
3) Hill top & hill slopes are protected - no construction is allowed.      

Trusting in the white lies about some ring road - PMRDA - proposed merger in PMC / PCMC - upcoming phase of IT Park in the vicinity - automatic conversion from agriculture to residential zone -these stupid investors are deceiving themselves.

These stupid investors are paying irrational price for a cut piece of agriculture land which they do not own today. And will never be able to own tomorrow.

The property card - 7/12 - of the cut piece of agriculture land is not transferred in their name today. And will not be transferred tomorrow.  Because these cut pieces are illegal and these investors are not farmers.

Today, in this corrupt Pune real estate market, most of the young eligible would be home buyers find themselves in a fix. Same about the young home owners who want to invest in second property and earn appreciation.

These young guys are intelligent enough to see the con game of land developers. These rational guys refuse to invest in worthless affordable compact budget homes - which are not suitable to live.

But what should they do about their savings? Where should they invest their 5 - 10 lakhs?

They do not have enough money to buy an investment grade property in the developed area of Pune. There is no point in keeping a few lakhs in a bank. What to do?

Their few lakhs are making them uncomfortable.

After repaying the first home loan, they know that not availing a second home loan is not a smart decision.

For them investing in real estate is not only about earning appreciation. Not only about increasing personal worth. Not only about earning passive income. Not only about converting their printed paper currency notes into a valuable kind.

Investing in real estate is more than that.

Investing in real estate is about securing your future. Making provision for future needs of your family.

Real estate investment is their pension account. And they know that for the old age - you have to start saving while you are young.

But there is no safe & affordable real estate investment option available for them.

Ben Bernanke made "Fiscal Cliff" popular term by using it for the current U S budget deficit riddle.

Isaac Asimov coined the term “robotics” in his short story “Liar” in 1941.

Some BBC media man coined the term "Bollywood".

But, who coined the term "Proposed NA Plots"?

No doubt, he must be highly qualified - mostly Non-Matric.
Certainly, a land developer in Pune real estate market.
Who should be given 'Honorary Doctorate' for his in-depth knowledge about income, IQ & psychology of stupid people in Pune.

The one who coined the term "Proposed NA Plots", showed the way to get rid of that little extra money these stupid people had earned - by mistake - and didn't know what to do with it.

The one who coined the term "Proposed NA Plots", gave respect to these stupid people by calling them "investors".

The one who coined the term "Proposed NA Plots", told them that they were not just getting rid of that extra money - but, they were doing something meaningful. They were investing their extra money in a plot of land.

Because of the one who coined the term "Proposed NA Plots", these stupid people became proud of themselves.

Result is, all stupid people confidently announced that - We are not stupid. We are investors in a plot of land.

Now, if someone asked them, "Why are you investing in a plot of land?"

"Investment in land is the most profitable investment. Land appreciates more than the flat. Dream of my life is to construct a bungalow!," the stupid people could proudly answer.

If you ask these stupid people, "But is your plot of land in the residential zone with Non Agriculture Order from the collector?"

Now, the stupid people can proudly reply, "You know what? It's Proposed NA Plot!"

"Means what? Land can be either NA or Agriculture. Like a man and an animal can either be dead or alive!," desperate to understand the meaning of "Proposed NA Plots", you ask.

"Not really. Only a coin has two sides. Life and land has many dimensions. For example "Atman" - Soul - is something more than death & life. The same way, "Proposed NA Plots" is something more than just an Agriculture land & Non Agriculture - N A - land!," the stupid people claim.

"I didn't know that! You are really an intelligent person!!," you say so only to end the conversation.

"Yes! My mother was right. Shadi ke baad Main Bohot Sudhar Gaya Hoon!!," the stupid people reveal the secret.

"What your wife says about you?," you can't control yourself and ask.

"My wife calls me "Prince!" She says that if a frog like me can become her prince - why Proposed NA Plot can not become "N A Plot" someday down the line?," the stupid people say confidently.

"You are an intelligent family!," you say and start wondering who coined the term "Proposed NA Plots"!

There was a crowd in the stalls which were selling N. A. / Proposed N. A. Bungalow Plots & Farm House Plots.

Plots at any location. Starting from plots at Nere & Rihe near Hinjewadi, plots on the back waters of Panshet & Khadakwasla Dams near Pune, plots at Tamhini Ghat to plots with a sea view at Dapoli in Konkan. Including plots at Pargaon Khandala near Shirval MIDC. And even near proposed International Airport at Boramani near Solapur.

Though I visit every property exhibition at Pune, I avoid visiting the stalls which sale plots. But this time, I visited these stalls. Enjoyed the conversations between the 'investors' & salespersons. Explaining the special exhibition offers. Threatening about the price rise. Claiming tall appreciation in the next few years. Informing grand development plans. And investors signing cheques of the booking amounts.

At one stall, Sanjay, one my readers, told me that he is here to find out a project which will - in the near future - say after 20 years - will become one of the most prime residential location in Pune.

Sanjay's wife got bored and had left for home. But Sanjay was exploring the exhibition to find and book a bungalow plot. He was 100 per cent sure that he will be successful in his mission. Because he has a vision. Like his father. Who had identified and invested in a bungalow plot society at Karve Nagar - some thirty years ago. Identifying right investment opportunity is in my blood, Sanjay told me.

"What about you, Ravi karandeekar? Do you invest in land?," Sanjay asked.

"Certainly! I am follower of Mark Twain. Who said - Buy Land! They're not making it anymore!!," I said.

"Where did you invest in Pune?," Sanjay asked.

"When I invest in real estate - I think like 'investor'. Not like a 'home buyer'. I have invested in cheap 1000 acre land at New South Wales Australia and a piece of land on the Moon," I said.

"But what's the use of land on the Moon?," Sanjay asked.

"Someday, I hope, my unborn son would be as proud of me as you are of your father!," I said.

Ms. & Mr. Hardas were exploring investment opportunity in real estate. Ms. Hardas wanted to buy a second property which will give her rental income. Whereas Mr. Hardas wanted to invest in a plot. On which, down the line, I can construct a bungalow, Mr. Hardas told me and asked, "I don't understand - how can you book a plot in exhibition - without visiting the actual site?"

"Why? What's the problem? At one stall, they were showing the site on Google. Since its nothing but a barren land what more you can see if you actually visit the site?," I asked.

"What about the legal documents? Developers reliability?," Mr. Hardas asked.

"That's why I prefer to invest in a flat!," Ms. Hardas said.

"But, don't you think that if you invest in diamonds - you can eat the cake & have it too - you can wear a few lakh rupees diamonds on yourself and encash it anywhere - anytime? Don't you think that investing in diamonds is more safe & easy than investing in a flat?," I asked.

"That's what I tell her!," Mr. Hardas said.

Have You Taken Possession of Your Bungalow Plot?

When someone asks me about buying a bungalow plot, my standard answer is - "Consult a Lawyer!". You agree with me and say, "Suggest a lawyer, please!"

"Find someone near your home. It will save you time & energy," I answer.

I don't suggest a lawyer because most of the lawyers I know well, work for the builders. I wonder whether these lawyers would be interested in offering their services to a property buyer. And I doubt whether a property buyer would be able to afford the fees of these experienced lawyers.

However, when I want to know something, I bother my lawyer friends. Generally, Advocate Nandkumar Shinde, legal consultant of leading builders in Pune. Mainly because, I know that Advocate Shinde genuinely cares for a property buyer. I am not only a lawyer - I am human being - a common man - a citizen - a buyer - Advocate Shinde says.

Advocate Shinde, be a good friend & give me free advice - is always my first sentence when I want to ask him something. On which Advocate Shinde says, "Sorry! Pay consultation fee in advance & take an appointment."

What can I do? This time, the issue was such that I had to take Advocate Shinde's appointment. So, I called 020 25 53 89 93 and visited Advocate Nandkumar Shinde's office located opposite Hotel Deccan Rendezvous, at the junction of Ghole Road & Apte Road in Shivajinagar, Pune 411004.

One of my readers was very upset. His developer was avoiding to do sale deed of his bungalow plot.

Nearly, 2.5 years ago, my reader has purchased a plot in this famous bungalow plots colony at Pirangut. Had paid his own contribution. Registered the agreement for sale. Against that his bank has disbursed the loan.

However, since my reader had gone abroad, on site in U S A, he hadn't done the sale deed. Now, back in Pune, my reader wanted to complete the transaction - sign the sale deed & take possession of his plot.

But after persuing for a few months, my reader came to conclusion that the developer of the bungalow plot colony at Pirangut was avoiding signing the sale deed & giving possession of his plot.

The latest excuse for not doing sale deed was the recent change in the stamp duty! When you registered the agreement to sale, you paid only 2 per cent stamp duty - now, it's 5 per cent. So, now, if you want to go for a sale deed - you have to pay the balance 3 per cent stamp duty!!

My reader found this demand unreasonable.

Yes, it's not fair. We are fighting with the government - go home - come back when our fight is over - the developer of the bungalow plot colony at Pirangut told my reader.

What is the truth? Do I have to pay 3 per cent stamp duty to do the sale deed of my plot? My reader asked.

He is fighting for you! Don't you trust your famous developer of the bungalow plot colony at Pirangut? I asked.

No. How can I trust someone who doesn't develop promised amenities & infrastructure? How can I trust someone who asks for maintenance charges without maintaining anything? My reader said.

My reader's frustration didn't leave me any choice but to consult Advocate Nandkumar Shinde.

The problem is not the rise in the stamp duty. Problem is your reader. Like most of the investors in plots, he hasn't forgotten about sale deed & possession of his plots. Advocate Nandakumar Shinde said.

Moral of the story is - I can request you to invite me for a cup of tea when you take possession of your bungalow plot too!

So, please, tell me, have you taken possession of your bungalow plot?
