Save Wagholi - Provide Better Infrastructure & Basic Amenities

Wagholi Housing Societies Association (WHSA) is petitioning Prime Minister of India - Shri Narendra Modi and 11 Others including Chief Minister of Maharashtra - Shri Devendra Fadnavis !



The construction of housing societies, big factories, warehouses are in full swing here.

Speed with which new constructions are being permitted by authorities and people moving in,
the infrastructure of the area should have drastically changed too
but believe us it remains the same as it was 10-15 years ago.

No proper roads,

No water by authorities,

No garbage collection,

No drainage system,

Load shedding every other day by MSEDCL,

Goondaism by localites,

No police patrolling,

No traffic lights,

No street lights,

No speed breakers

and WHAT ELSE NOT.


Grievances from Housing Societies:


1) No Water from Grampanchayat / Corporation.
Societies are forced to purchase water from tanker mafia who charge big time

2) No Garbage collection from GP.
Societies are forced to arrange dumping on their own.

3) Dumping and burning of garbage beside one society or the other without their knowledge that not only stinks but also increases health issues.
Note: GP does collect garbage from native Wagholi residents as if only they are humans and not citizens living in societies.

4) No Drainage System from GP at all.
Societies are forced to arrange waste drainage on their own into natural and nearby river streams.

5) No Street Lights on roads making them scary for residents to cross during nights.

6) No Proper Roads / Countless Potholes and
residents of housing societies are forced to live in a tribal like conditions.

7) No Police Patrolling at day or nights.

8) No Police Station or Police Chowki.
Nearest is Lonikand police station which is 6-8 kms away and is as good as reaching more into another village.

9) No Traffic Control at all.
Traffic Imagine a crossing without traffic signal and without any traffic police.
Chaos on every other crossing of Wagholi at peak time.

10) Heavy Encroachment that leads to more narrower roads impacting the free movement of traffic.

11) Incapability of Wagholi GP in handling vast number of societies in providing services
and hence they do not register any new housing societies.

12) Regular load shedding from MSEB.
Old transformers, lines need revisit, servicing, replacement etc.

Flat buyers sent legal notice to the builder Amey Prakash Lokhande

Kind Flat Buyers & Inconsiderate Builder:


Mr. Amey Prakash Lokhande, The builder of Sainath Palace, Wagholi, Pune

After meeting the flat buyers of Sainath Palace at Wagholi, I called their builder Mr. Amey Prakash Lokhande. He immediately agreed. We met at a mutually convenient place.

Amey Lokhande was well prepared. He told me that he reads & admires my blog. He also told me that I should write about the issues builders face. Particularly, the small builders like him.

Amey Lokhande's entire argument was based on - how it has become difficult for the small builders to operate.

Not Amey Prakash Lokhande but the circumstances are responsible for the stalled construction of Sainath Palace. Instead of blaming me - you should blame the circumstances and support me.

I am a good person. And in these circumstances - doing business has become difficult for good people like me. Lokhande tried to convince me.

"Circumstances? Means what?," I asked Amey.

"Government & big builders!," said Amey.

"You mean to say - the government and some big builder are responsible for the stalled construction of Sainath Palace?," I asked.

"Yes! You got it right!!," said Amey and added that - "Ravi, you should write about theses issues. In fact, I was planning to meet you to convince you to blog about it!"

I was impressed. What a strategy!

1) First, Amey Lokhande tried to win my heart by admiring & praising me.

2) Then Amey held someone else responsible & gave himself a clean cheat.

3) After that he tried to divert my attention from Sainath Palace to the government & big builder nexus.

Amey Prakash Lokhande knows how to play mind games! No wonder - he could easily convince the buyers to book a flat in the almost stalled project, take loan & give him 90 percent property price & patiently wait for possession for 2 years!

Ravi, go & tell those flat buyers - Amey Prakash Lokhande is a good human being. Though the ugly nexus of big bad builders & government almost destroyed him - he is trying his best to complete Sainath Palace. This was his parting message for me.

Amey Prakash Lokhande expressed no empathy for the flat buyers of Sainath Palace. Amey Prakash Lokhande expressed no guilt for hurting the flat buyers. Amey Prakash Lokhande expressed no shame for lying & breaking promises about flat possession. Amey Prakash Lokhande didn't express any concern for the flat buyers.



After coming home from the meeting, once again I viewed above Marathi video interview of the 3 flat buyers. In this interview they talk about sending legal notice to their builder - Mr. Amey Prakash Lokhande. In this viewing I realized how great these guys are.

Let me tell you why these guys are great:

1) In January 2015 these guys tried to play the kind of 'mind game' the builder was playing with them and made Amey Prakash Lokhande sign the MOU about giving flat possession before 31st March 2016 or giving rent if he fails to give possession. But when the builder's cheques were dishonored they freed themselves from playing 'mind games' and sent him the legal notice. Now, they have left no option to their builder but to pay for his misdeeds.

Only three buyers, who could afford to buy 10 - 20 lakh rupees property, has shown the guts to do what a group of 100 buyers who have booked 50,00,000 - 100,00,000 rupee property don't dare to do.

2) Though they have taken assertive steps and announced their intention to file a case against their builder Mr. Amey Prakash Lokhande in criminal, civil & consumer courts, they have expressed their concern & kindness.

If the builder starts the construction and gives us possession in 2 - 3 months we will pardon the builder for what he has done to us - they have said in the interview.

Showing compassion for someone who has hurt you so much is found only in human beings. Not in the builders. Right?

My builder's unscrupulous tactics

Lies, Broken Promises & Dishonored Cheques:




In January 2016, Mr. Amey Prakash Lokhande, the builder of Sainath Palace at Wagholi, signed an MOU about giving possession of my flat in March 2016.

"If I can't give possession in March 2016 - don't worry - I am a very kind person - I will pay you the rent!," giving away the post dated cheque for rent, Mr. Lokhande, my builder, promised.

In March 2016, my builder didn't give possession. Because he couldn't complete the project.

My builder couldn't complete the project because he never started the construction.

So I deposited the builder's cheque for the rent of April 2016.

My builder's cheque was dishonored.

It means that the MOU & the cheque was nothing but my builder's unscrupulous tactic.

One more unscrupulous tactic.

In the July 2014, when I booked the flat, Mr. Lokhande, my builder, promised to give possession in March 2015. And mentioned the date in the flat agreement.

I believed in him because the structure of the 4 story single stand alone building was ready. Completing internal work of the 16 flats by March 2015 looked very much possible.

But that was a lie.

From July 2014 to March 2015, my builder did only the POP.
Otherwise for the last 2 years the construction is completely stalled. Jaise Thhe. No progress.

In the last 2 years, my builder has done only 4 activities.
1) He has collected my home loan disbursements. Nearly 90% of the flat price.
2) He has given promises about giving possession. March 2015. December 2015. March 2016.
3) He has broken all promises.
4) He has lied again and again.

What all my builder, Mr. Lokhande, is doing - is preplanned - premeditated - business tactics.

I am left with no choice but to suffer.

Required - Builder's Credit Report & Credit Score Rating

CIBIL - Credit Information Bureau (India) Limited - evaluates the eligibility of the home loan borrowers. 
How about establishing an agency which will evaluate the performance & credibility of the builders?:




In June 2014, I booked a 1 BHK Flat in Sainath Palace - a single stand alone 4 story building of 16 flats - at Wagholi.

I booked in this project only because - 70 % construction was ready and the builder - Mr. Amey Prakash Lokhande - promised to give possession in 6 months - means in December 2014.

Possession in 6 months means - I had to pay both - the rent and the Pre-EMI - only for 6 months.
Possession in 6 months means - just after the 6 months - I have to pay only EMI. Which was as good as my current rent.

Financially - paying both only for the 6 months was quite manageable.

However, today, in June 2016, 2 years after the booking, I haven't received the possession of my flat. And I don't know when I will get it.

It means that - I don't know how long I have to keep on paying both - the rent & the pre-EMI.

Can I manage to pay both for so long?

What if I can not manage to pay both in a month?

For the last 2 years - these questions are bothering me day & night.

Till I get the possession of my flat - I have to live in a rented flat - obviously, I don't have any option but to keep on paying the rent.

Since I have taken the home loan - though the construction of my project is stalled - I don't have any option but to keep on paying the Pre-EMI.

Yes. True. I have to pay both every month.

But - what if I can't manage to pay the both?

What - only in a month or two - if I can pay only one - either the rent or the Pre-EMI?

For the obvious reasons, certainly, my first priority would be to pay the rent.

But the fact of the matter is - not paying the Pre-EMI for a month or two - will damage my credit worthiness - my CIBIL ratings. Result is - low CIBIL ratings would hamper my eligibility to obtain a loan from any bank. And I will suffer for life.

But - what happens to the builder who puts me in such a challenging situation by delaying possession of my flat?

Nothing!

Because, like CIBIL - there isn't any authority which rates the builder's' performance!

Don't you think that this is unfair?

Don't you think that the government must establish an agency which will publish an authentic credibility report of the builders?

Don't you think that an authentic credibility report of the builder will help the property buyers to decide whether the builder is eligible to book a flat at an under construction stage of the project?

My biggest mistake - I didn't construct a gunthewari house

Buying an illegal Gunthewari plot & constructing an illegal house on your own is safer than booking a flat in a builder's legal under construction housing project!


Today, I would have been living in my own home if I hadn't refused to join my two friends.

Three of us were going to buy one guntha plot and construct 3 homes on our own. Each one of us was going to contribute 5 lakhs for the plot and 5 lakhs for the construction. In only 6 months & 10 lakhs rupees we would have become homeowners & would have lived happily ever after.

But I made a mistake. Worst mistake of my life. I didn't join them.

"I don't want to raise my family in an illegal housing," I told my friends and started searching legal housing project.

And you know what? I found Sainath Palace at Wagholi. A 4 story stand alone building of 16 flats - with a lift!

When I visited the site, construction was in full swing. Out of the 4 floors - 2 were already constructed.

"I will give you possession in just 6 months," the builder, Mr. Amey Prakash Lokhande, promised me.

So, I booked a 1 Room Kitchen Flat for Rs. 9 Lakh & 12 thousand rupees.

This happened in September 2013.

But, as yet, I haven't received possession of my flat. For the last 3 years - from September 2013 to June 2016 - I am waiting for possession. And I don't know when I will get my flat.

Of course, after I registered my flat agreement in December 2013, the builder completed RCC, brickwork, plaster and collected around 90 % of the property price - Rs. 8.70 Lakhs - and stopped construction of the project.

"Why are you not completing the construction?," many times I have asked the builder.
"I don't have money. I will complete it only when I will get the money," this is the standard reply of the builder.

"How can you say that you don't have money to complete the project....I have paid.....other flat buyers have also paid," I asked him once.
"Yes, you have...but I told you.....I don't have enough money for completing the project....I am trying my best to arrange the money & complete the project....don't worry....be patient......you will get your flat," the builder convinced me in his soft & sweet tone. As if I am some crying kid.

Of course, in the last 3 years very rarely I managed to meet the builder. It's difficult to catch him. He doesn't have an office. He does not take my phone calls.

I visit the project often. Spend some time in my flat. I can't do anything but wait. And talk to myself.

The government has sanctioned the plan - given permission to the builder to construct the project. The bank has approved the project & disbursed the home loan to the builder. But both - the government & the bank - are least bothered about me.

At least, the government should have some concern for me. I am a law abiding citizen. I haven't gone for an illegal construction.

I have booked a flat in the legal housing project. As per the law of land - I have registered my flat agreement and paid stamp duty, registration charges, VAT & service tax to the government. After the possession, all my life, I am going to pay property tax to the government.

Isn't it duty of the government to take the side of the tax payers?
Isn't it duty of the government to protect it's citizens from the builders?

Who told you that the government is for the people?
The government is certainly not for the law abiding citizens like you.
The government is for the people who buy & live in illegal properties.

If you had joined your friends & had constructed illegal gunthewari house - you would have earned some respect of the government. You would have become the valuable voter and the important power source for the government. Then the government would have rewarded you by giving legal status to your illegal gunthewari house. But you missed that opportunity by booking a flat in the legal housing project.

In this legal world, you don't matter. In this legal world, for the government important source of power is the builder. So the government is on the builder's side. Not yours.

I keep on talking - mostly, blaming myself. What else can I do? I feel helpless.



True, if I hadn't refused to join my friends - today, I would have been living in my own home - but I would have lost respect for myself.

I am young. I am not much educated. I don't earn much. But I am honest. I have self respect. I know for sure that my future is bright.

Booking a flat in a legal project was not a mistake. Yes, considering my income it was a risk - a big risk - but not a mistake. My builder is stupid. I am suffering because the builder made some terrible mistakes. Otherwise, my plan was perfect.

In 2013, my salary was 13,000. I was recently married. I was paying 5,000 rent for the single room.

"Instead of paying 5,000 rent why shouldn't we try to get a home loan and pay 5,000 as an EMI to the bank?," I asked my wife.

"I hate to live in a rented room. Owning a home is also my dream. If you manage to get a home loan - I will give you my gold jewellery - sell it for the down payment," my wife agreed and we decided to buy a flat.

A bank agreed to give me a home loan. Of course, at a very high interest rate. 11.25%.

My 50,000 savings and 1 lakh of my wife's gold were not enough for the down payment. So, I manage to get 50,000 personal loan. Of course, at a very high interest rate. 15%.

So, what? In just 6 months I was going to get possession of my flat. Instead of paying 5,000 rent - I was going to pay some 7,000 EMI. To own a home, every month, I have to spend only 2,000 rupees more. By the way, after the salary rise, paying 2,000 per month would be quite easy for me. Certainly, booking a 1 Room Kitchen Flat at Sainath Palace was a good decision.

But when the builder stalled the construction - my dream turned into nightmare. My risk became a big financial blunder.

I got the raise. I started getting 20,000 per month. But that was not enough. The landlord increased the rent - 6,000 per month. Plus, I had to pay nearly 6,000 rupees interest on personal & home loans. Minimum 3,000 - 4,000 were required for food. Had to spare some 1,000 rupees for the medical & other expenses for my newborn baby. 1,000 more for the petrol & mobile recharge. For my mother at hometown I had to send a thousand or two every month. Somehow, I am managing to survive from paycheck to paycheck.

Since last 3 years, I am not only managing to live with empty pockets but also with an empty heart.

Why doesn't my builder understand my pain? How can someone be so cruel? Vikas wonders.
