How can The Times of India do this to Pune Builders?

MahaRERA is for the promotion of real estate business.
MahaRERA is for increasing housing supply.
Not to harm the builders in Pune.
Not to create shortage of housing in Pune real estate market.:

To gain insights on how RERA will transform the real estate industry, yesterday evening, I visited RERA Information Desk of Posiview Consulting at Times Pune Property Exhibition at Sheraton Grand near Pune railway station.

In the couple of hours I was there, I realized that most of the people who visited the RERA Desk were victims of the builders in Pune. These victims of the builders wanted to know whether MahaRERA will give them justice. Ms. Komal Karwande, who was at the Desk, confirmed the same.

At Times Property Expo, the victims of Pune builders outnumbered the visitors who wanted to book flats!

For example, at the exhibition, there was one couple in their 80s. Some 10 years ago they had booked a flat in a project near their home for their only daughter - so that their daughter can take care of them. But even after 10 years - they haven't received possession of their flat.

Instead of their daughter taking care of them - for the last 10 years - they are fighting for possession of their daughter's flat.

They had gone to consumer court & won the case. But the builder is refusing to follow the consumer court's judgement of giving possession of flat. The builder is ready to refund their money but refusing to give a flat.

Can MahaRERA help us to get possession of our flat? The couple in their 80s wanted to know.



This is terrible!

This is not only against the interests of the builders who participated in the property exhibition but this is against the entire builder lobby in Pune.

Instead of presenting a rosy picture which will tempt the visitor to book a flat - the organizers of the property exhibition are demotivating the visitors from booking flats.

By inviting victims to the exhibition - instead of a fiction - the organizers had exhibited the facts. The ugly truth of Pune real estate market. I said to myself.



In short, it was an exhibition of unfair - unethical - illegal - criminal - business practices of the builders in Pune.

How can The Times of India do this to Pune builders?

Spreading negative sentiments against the builders in Pune is not fair.

After all builder's ads is the main source of revenue of The Times of India.

These negative sentiments will completely destroy the business of builders in Pune who are already struggling to survive.

True! For the last couple of months the builders in Pune have stopped releasing ads.

True! For the last 6 months or so the builders in Pune are not taking part in The Times Property Expo.

True! In the next 6 months the builders in Pune may not release ads & may not participate in any property exhibition.

But it doesn't mean that anyone has a right to punish the builders in Pune for that!

If it had been a CREDAI Pune Metro Property Exhibition, the builders would not have put RERA Information Desk. The builders would not have let their victims enter in the exhibition. If the victims had tried to enter - like the last CREDAI exhibition - the builders would have used police force against them.

I hope that The Times of India will correct it's mistake and join hands with the builders in Pune. Together they will spread the positive sentiments in Pune real estate market and give boost to the business. Which is the main purpose of MahaRERA.

Will MahaRERA resolve flat buyers' complaints against builders in 60 days?

"I am worried ..... Will MahaRERA really give justice to victims of builders ..... Will MahaRERA be an illusion of justice ..... Will MahaRERA be a mirage .... a false hope ..... Will MahaRERA be able to resolve flat buyers' complaints against builders in 60 days?" - asks Advocate Shirish Deshpande, Chairman, Mumbai Grahak Panchayat.

One of the good things about Real Estate (Regulation and Development) Act, 2016 is speedy & efficient disposal of flat buyers' complaints. Section 29 of the Act says that RERA Regulator shall dispose of the complaint within a period of 60 days from the date of receipt of complaint.

How many days? 60 days!

A flat buyer's complaint against the builder will be resolved in 60 days!!

Is this a gimmick or a legal commitment?

In 1986, when Consumer Protection Act was passed - we were given the same kind of assurance - consumer complaints will be resolved in 90 days!

But in the last 30 years - all of us have seen how efficient & speedy consumer courts are.

Justice delayed is justice denied.

That's why - in the presence of all of you - I want to question Mr. Gautam Chatterjee, Chairman of MahaRERA - There is a provision of expeditious disposal of complaints in the RERA Act passed by the central government - but - Mr. Chatterjee - are you in a position to resolve flat buyers' complaints against builders in 60 days?

Will MahaRERA resolve flat buyers' complaints against builders in 60 days or will it be a daydream - a mirage - an illusion?

Will MahaRERA be able to deliver justice to the flat buyers or will it be a one more big disappointment?

Advocate Shirish Deshpande, Chairman, Mumbai Grahak Panchayat asked Mr. Gautam Chatterjee, Chairman of MahaRERA, in an event organized last weekend. The name of the event was - "Unfolding MahaRERA" - रेरा कायद्यात दडलंय काय?. Adv. Deshpande was expressing his expectations from MahaRERA.

Adv. Deshpande, the host of the event, not only expressed his concern, he offered the solution too.

Appoint more number of adjudicating officers, he suggested.

From the 1st of August 2017, there would be a big flood of complaints against the builders. Most of these complaints can be resolved by the adjudicating offices. As a chairman you have the power to appoint adjudicating officers. Exercise that power.

And before appointing adjudicating officers from the judiciary - arrange an orientation programme for them. Because, MahaRERA would be effective only if they realize the importance of social justice.

Otherwise, the process of resolving complaints would become a legal battle which builders' lawyers can easily win. Builder's lawyers will use all their legal expertise & experience to defeat the flat buyers.

See that the adjudicating officer understands the intention behind implementing MahaRERA - to protect the interests of the flat buyers.

What we all expect from MahaRERA is social justice. If you need more time to deliver it - we don't mind.

Instead of 60 days - take 90 days.

We don't mind even if you take 120 days.

Because for us most important question is - Will MahaRERA disappoint us like the Consumer Protection Act or will it really protect the interest of the flat buyers by offering speedy & efficient justice? Asked Adv. Deshpande.

What say you?

Will the politicians & bureaucrats take strict action against the 3rd member of their nexus - the builders in Pune?

And for whom? For the urban middle class?

To win the votes of urban middle class in Pune - IPL - 20 Twenty Matches, malls, roads, flyovers, metro & airport is more than enough.

We want development. We don't bother about justice.

Don't book a flat in Pune till RERA is implemented

Important tip for the first time home buyers in Pune real estate market - Don't book a flat in Pune & Pimpri Chinchwad Municipal Corporation limits till RERA - Real Estate (Regulation and Development) Act, 2016 - is implemented in Maharashtra:

I am looking for my first home and I am working in Software company in Yerwada.
My budget to buy 2/3 bhk flat is 60lac.
I got two properties: 29 gold coast and Skyway Sereno.
Both the properties are in my budget. Should I book there ? Or any other suggestions.

Have you read my blog on Maharashtra RERA Rules?

Are you aware that if approved as published, Maharashtra RERA Rules will give legal authority to the builders to dominate, victimize & intimidate flat buyers in Maharashtra?

Most of the time your reply is - No. I am not aware about RERA. I am not aware that Maharashtra RERA Rules are against flat buyers.

Okay. Being dumb is not a crime. So don't punish yourself. Instead of that learn about RERA. You will find original English & Marathi RERA Rules and 5 objections against Maharashtra RERA Rules on my blog.

After reading my blog - you will realize that you should not book a flat till Maharashtra Government finalizes the RERA Rules.

And then you have to confirm that Maharashtra RERA Rules are as per Real Estate (Regulation and Development) Act, 2016 passed by the Indian Parliament.

It means that you can book a flat only after the confirming that Maharashtra RERA offers protection to the flat buyers.

If Maharashtra RERA is a mockery of RERA Act passed by the Central Government - if it is diluted - then instead of booking a flat - you have to come on the road and start Andolan & go to court against Maharashtra Government.

Since the deadline for the implementation of RERA is April 30, 2017 - in the months of February, March & April in 2017 - you should not even think of booking a flat in Pune real estate market.

Who needs RERA!

Should I book a flat which is not yet sanctioned by PMC?



I liked one project opposite Pu La Deshpande Udyan on Sinhagad Road. It has 5 high rise towers. I chose a flat on higher floors. This floor is not yet sanctioned. If I book that flat today - by paying 10% of the agreement value - I can get a substantial rate benefit - means I will get today's rate. The flat agreement will be signed & registered after the builder obtains PMC sanction - means approximately after a year or so. Ravi Karandeekar, my question is - should I book today or wait for PMC sanction? A lady asked.

Sorry. I didn't get you. What is the question? I asked.

I want to know - Is there any risk involved? Is this builder reliable? Since you know so many builders - I thought that I should ask you before booking. The lady said.

Thanks for asking! Are you married? I asked.

Yes! 20 years. I am a working mother of a college going daughter. The lady said.

Good! What will be your reply if your daughter asks you - "Mummy, a boy in my class is asking for sex - I refused - but he keeps on asking - can I have sex with him?". I asked.

No one will dare to ask. My daughter is not like that. I have raised her well. The lady said.

You are angry! Why? I asked.

My Sanskars! My daughter is well groomed. She is open & free. But not sultry. The lady said.

Sure. But what about you? I asked.

What about me? The lady asked.

Do people come to you with indecent proposals? Like - spend a night with me & I will give you a promotion! I asked.

Stop this nonsense. Talk about the builder. Not about my personal life. The lady said.

Did you ever ask yourself - How come this builder dared to ask me to book a flat which is not yet sanctioned by PMC? You know lady? Your builder's suggestion is as immoral as your daughter's classmate's invitation for sex. Your builder's proposal is as indecent as your boss's offer to spend a night with him for promotion. I said.

I don't think so. Pre booking - advance booking is a normal business practice. Of course, there is a risk. But there isn't anything wrong about it. The lady said.

Okay. Please, call Urban Development Minister, Venkaiah Naidu and request him to scrap Real Estate (Regulation and Development) Act, 2016. Tell him that there is no need to prevent the builders from accepting bookings before obtaining all necessary sanctions & approvals. Flat buyers need no protection. Flat buyers don't need RERA! I said.

Maharashtra will have interim RERA by October 2016

Who will be the Real Estate Regulatory Authority (RERA)?:




1) About implementation of Real Estate (Regulation and Development) Act, 2016:


The much awaited and widely acclaimed Real Estate (Regulation and Development) Act, 2016 came into force from May 1, 2016. This has set in motion the process of making necessary operational rules and creation of institutional infrastructure for protecting the interests of consumers and promoting the growth of real estate sector in an environment of trust, confidence, credible transactions and efficient and time bound execution of projects.

Ministry of Housing & Urban Poverty Alleviation has notified 69 of the total 92 sections of the Act on Wednesday this week bringing the Act into force from May 1,2016 culminating the eight year long efforts in this regard. A proposal for a law for Real Estate was first mooted at the National Conference of Housing Ministers of States and Union Territories in January, 2009.

As per the notification announcing the commencement of the Act on May 1,2016, Rules under the Act have to be formulated by the Central and State Governments within a maximum period of six months i.e by October 31,2016 under Section 84 of the Act. Ministry of HUPA would make Rules for Union Territories without legislatures while the Ministry of Urban Development would do so for Delhi.

Section 84 of the Act stipulates that “The appropriate Government shall, within a period of six months of the commencement of this Act, by notification, make rules for carrying out the provisions of this Act.”

Early setting up of Real Estate Regulatory Authorities with whom all real estate projects have to be registered and Appellate Tribunals for adjudication of disputes is the key for providing early relief and protection to the large number of buyers of properties.

Section 20 of the Act says “The appropriate Government shall, within a period of one year from the date of coming into force of this Act, by notification establish an authority to be known as the Real Estate Regulatory Authority to exercise the powers conferred on it and to perform the functions assigned to it under this Act”. These Authorities decide on the complaints of buyers and developers in 60 days time.

Section 20 of this Act also empowers appropriate Governments to designate any officer preferably Secretary of the Department dealing with Housing, as the interim Regulatory Authority until the establishment of Regulatory Authority under the provisions of the Act.

Regulatory Authorities, upon their constitution get three months time to formulate regulations concerning their day to day functioning under Section 85 of the Act.

Likewise, under Section 43 of the Act, Real Estate Appellate Tribunals shall be formed within a maximum period of one year i.e by April 30,2017. These fast track Tribunals shall decide on the disputes over the orders of Regulatory Authorities in 60 days time.

Under the directions of the Minister of Housing & Urban Poverty Alleviation Shri M.Venkaiah Naidu, a Committee chaired by Secretary (HUPA) has already commenced work on formulation of Model Rules under the Act for the benefit of States and UTs so that they could come out with Rules in quick time besides ensuring uniformity across the country. The Ministry will also will come out with Model Regulations for Regulatory Authorities to save on time.

The time limits of six months for formulation of Rules and one year for setting up Regulatory Authorities and Appellate Tribunals are the outer limit and the States willing to act quickly could do so and the Ministry of Housing & Urban Poverty Alleviation would notify the remaining Sections of the Act to enable relief to the buyers under the Act as quickly as possible, as desired by Shri M.Venkaiah Naidu.

पूर्वी अस्तित्वात असलेला ‘मोफा‘ म्हणजे महाराष्ट्र ओनरशीप फ्लॅट ॲक्ट, २०१२ साली रद्द करून राज्याने स्थावर मालमत्ता (विनियमन व विकास) २०१२ स्विकारला. या कायद्यानुसारही राज्यात स्थावर मालमत्ता नियामक प्राधिकरणाची स्थापना होणार होती. परंतु एकूणच राजकीय नेत्यांचे आणि बाबू मंडळीचेही बिल्डरांशी साटेलोटे असल्याने त्याची स्थापना झाली नाही. आता तर तो कायदाच केंद्राने निरस्त केल्याने राज्यात आधीच उल्हास त्यात फाल्गुन मास अशी परिस्थिती निर्माण झाली आहे.त्यामूळे जोपर्यंत केंद्र शासन स्थावर मालमत्ता अधिनियम २०१६ मधील सर्व तरतुदी अधिसुचित करत नाही तोपर्यंत राज्यात स्थावर मालमत्ता घेणा-यांना दिलासा देणारा एकही कायदा अस्तित्वात नाही अशी स्थिती निर्माण झाली आहे . RERA to be notified on 1st May 2016

Builders have to deliver what they have promised to the flat buyers. Otherwise they will be taken to task - Venkaiah Naidu, Union Urban Development Minister:


1) Entire Act - Real Estate (Regulation and Development) Act 2016 - will not be notified. Portions of the Act will be notified. Like definitions of Carpet Area, Occupancy Certificate etc. And, of course, Establishment of State Real Estate Regulatory Authority. Establishment of Real Estate Appellate Tribunal etc.

2) 1 full year may be required to implement the complete Act.

3) There should be a time bound programme to implement the entire Act. In the meantime, an interim authority should be appointed right away - equivalent to the housing secretary of the state - which is capable to handle the huge number of complaints against the builders. Mr. Rohit Gera of Gera Development suggests.

4) To avoid coming under the purview of the Act - many builders will try to complete their under construction projects. Pankaj Kapoor, Liases Foras, comments.

Real Estate Regulatory Authority (RERA) Comes to Town

If your builder has not fulfilled all conditions & commitments mentioned in the commencement and/or completion certificate issued for your project, Pune Municipal Corporation (PMC) will issue Stop Work Order for the builder's other ongoing projects.

Your builder can resume the construction of these projects only after you - the Flat Buyers - and the Enquiry Officer certify that the builder has completed your project exactly as per the conditions & commitments mentioned in the commencement & completion certificate issued by PMC.

It is the duty of City Engineer's Office to confirm that the builder has fulfilled all conditions & commitments in the commencement & completion certificate issued by their department.

If the City Engineer's Office fails to discharge their duties, Pune Municipal Commissioner will take strict action against the responsible officers.

By issuing these directives Pune Municipal Commissioner Kunal Kumar has proved how easy it is to regulate the real estate business.

Let the flat buyers monitor the performance of the builder & the city engineer's office.

Let the flat buyers certify that the builder has implemented all conditions & commitments mentioned in the commencement & completion certificate issued by PMC.

Let Pune flat buyers be the real estate regulator.

By activating flat buyers regulatory mechanism, Mr. Kunal Kumar has solved an age old problem of monitoring the 'conditional clearances' issued for housing projects.

Without increasing the expenditure in municipal budget, Kunal Kumar has set an effective & inexpensive mechanism to confirm that the builders are fulfilling conditions & commitments.

By making civic administration responsive, the Commissioner has won the hearts of property taxpayers in Pune who are number one revenue sources of PMC - Rs. 950 Crores (approx).

Theses residents dared to point out the wrong & irresponsible practices in the city engineers' office. The city engineer's office didn't bother to monitor whether their builder has fulfilled the conditions in commencement & completion certificates. Even after the residents brought it to their notice - the city engineer's office refused to take any action against the builder. So, Palladium Grand residents went to Municipal Commissioner Kunal Kumar.

Which are the conditions & commitments the builder of Palladium Grand didn't fulfill? As per the affidavit, the builder didn't supply free water. No rainwater harvesting. No solar water heating system. No garbage management system. No firefighting system. Illegal parking - double than the sanctioned 72 car parks. No two wheeler & cycle parking. Less open space. Changing layout without the consent of the flat buyers. The issues common in the most of housing projects in Pune real estate market.

I am sure, the flat buyers in Pimpri Chinchwad Municipal Corporation (PCMC) & Pune Metropolitan Regional Development Authority (PMRDA) will follow Palladium Grand and help the respective commissioners - Mr.Rajeev Jadhav & Mr. Mahesh Zagade - to set this type of real estate regulatory mechanism in their areas.

It means that, now, the flat buyers in KUL Ecoloch will go to Mr. Mahesh Zagade, chief executive officer PMRDA, and demand to appoint an enquiry officer to confirm that Kumar Builders KUL has fulfilled the conditions & commitments mentioned in the commencement & completion certificate. If the finding is negative PMRDA will issue Stop Work Order for KUL Nation.

Why only PCMC & PMRDA? Now, the flat buyers in Suyog Nisarg at Wagholi will approach Maharashtra Pollution Control Board & State Level Expert Appraisal Committee SEAC III and submit their report about implementation of conditions & commitments regarding environmental clearance and if their claims are true - they will demand action against the builder.
