Beginning of the End of the Builder Mafia Raaj in Pune

Maharashtra Government has initiated action against
the first 40 builders in Pune,

After submitting the first list of 40 builders, who have committed crimes against the flat buyers in Pune, Maharashtra Government has initiated action against them.

Mr. Vijay Sagar of Akhil Bharatiya Grahak Panchayat Pune shares this info in the above video interview in Hindi.

Mr. Kirit Somaiya, MP, has immediately told the respective officers to look into the matter. Result is Economic Offence Wing of Pune Police invited Grahak Panchayat for the initial briefing.

Mr. Devendra Fadnavis, Chief Minister of Maharashtra, has given assurance to Grahak Panchayat that there would be no political interference in the police investigation.

Mr. Mahesh Zagade, Chief Executive Officer of Pune Metropolitan Regional Development Authority - PMRDA - had a joint meeting with Grahak Panchayat & the 'listed' builders whose projects are in PMRDA.

Mr. Zagade has given orders to his staff to investigate and submit their report.

Marathi Bandhkam Vyavsayik Association - MBVA - has assured to co-operate with Grahak Panchayat.

The positive response from the respective authorities shows that we are moving towards achieving our major goals:

1) Prepare a task force for giving flat possession to the buyers who are waiting for years.

2) Take action against the builders - where only an FIR is lodged - under MCOCA - Maharashtra Control of Organised Crime Act, 1999.

3) Order Economic Offence Wing of Pune Police to take action against the builders who have committed financial crime of selling car parking, and extorting money from the flat buyers under the names of infrastructure & development charges, society formation charges, electric meter charges, club membership, maintenance charges etc.

And see that the builders refund those moneys back to the flat buyers.

4) Order PMC, PCMC, & PMRDA officers to take actions against the builders who are giving illegal possession without obtaining completion & occupancy certificate.

5) Punish the builders who have violated environmental clearance.

6) Order Pune Police to register the FIR filed by the flat buyers against their builder.

But this is just the beginning. Every day more & more flat buyers are joining us. The second list of the builders is getting ready. So, if you want to add the name of your builder, please, visit our office. Says Mr. Sagar.

Has the Chief Minister taken any steps to end Builder Mafia Raaj in Pune?

What about Grahak Panchayat's Andolan - "Builder Mafia Raaj Hatao - Pune Flat Buyers Bachao"?




Two months ago, Akhil Bharatiya Grahak Panchayat Pune published a list of 40 builders in Pune who have looted & cheated flat buyers and appealed to the Chief Minister of Maharashtra to take action against them.

1) Prepare a task force for giving flat possession to the buyers who are waiting for years.

2) Against some builders only an FIR is lodged - take action against them under MCOCA - Maharashtra Control of Organised Crime Act, 1999.

3) Order Economic Offence Wing of Pune Police to take action against the builders who have committed financial crime of selling car parking, and extorting money from the flat buyers under the names of infrastructure & development charges, society formation charges, electric meter charges, club membership, maintenance charges etc.

And see that the builders refund those moneys back to the flat buyers.

If the above actions are not taken within a month, Grahak Panchayat warned the Chief Minister that it will start andolan against builder mafia raaj in Pune.

Grahak Panchayat's timing was perfect. In the same month Pune Police have busted the Maple Pradhan Mantri Awas Yojana Scam. Obviously, newspapers & tv channels covered the news quite well and gave good publicity.

But what about the action?
In the last 2 months, has the Chief Minister taken any steps to end Builder Mafia Raaj in Pune?

Pune Flat Buyers Declare War on Builder Mafia Raaj

"Take strict action in 30 days or
"Builder Mafia Raaj Hatao - Pune Flat Buyers Bachao"
andolan will be launched" 
- under the leadership of Akhil Bharatiya Grahak Panchayat, flat buyers in Pune sent an ultimatum to Maharashtra CM Devendra Fadnavis:



A few days ago, in the press conference, Mr. Vijay Sagar, Mr. Vilas Lele & Ms. Seema Bhakare of Akhil Bharatiya Grahak Panchayat Pune published first list of 41 projects which have looted, cheated & exploited around 15,000 flat buyers and declared war on builder mafia raaj in Pune.

Grahak Panchayat gave to the press the copy of an ultimatum letter sent to Chief Minister of Maharashtra Shri Devendra Fadnavis.

Along with andolan, Grahak Panchayat also announced that Public Interest Litigation (PIL) will be lodged against the State Government, local bureaucrats & Pune police for non performance of duties.

Here is the first list of projects in which the nexus of builders, bureaucrats, police & politicians have exploited Pune flat buyers:


1) Shalini Lake View Undri - Trishul Builders:


A) 500 Flats: Rs. 8 - 10 Lakhs Each.

B) In 2010 the building was demolished as it was constructed on reserved government land.

C) Money was collected from more than 500 flat buyers. Money not refunded. Hundreds of legal cases ongoing. No action on FRI lodged in 2011.

2) Misty Trails Hadapsar - Bhujbal Brothers Construction Company


A) 178 Flats: Approx Rs. 40 Lakhs Each

B) Construction stalled for years. Bank has attached the project. No action on FIR.

3) Forest Mist Hadapsar - Bhujbal Brothers Construction Company:


A) 80 Flats - Approx Rs. 40 Lakhs Each

B) Construction stalled for years.

4) Valay Hadapsar - Bhujbal Brothers Construction Company:


A) 20 Flats - Approx Rs. 40 Lakhs Each

B) Possession delayed by 2 years. Construction stalled for years.

C) Electricity meter 1,50,000 + Development charges Rs. 2 Lakhs collected from each flat buyer.

5) Vatika Balewadi - Bhujbal Brothers Construction Company:


A) 123 Flats - Rs. 45 - 70 Lakhs Each

B) Illegal floors. Incomplete project. Refund cheques bounced. No completion & occupancy certificate. Delayed possession after Grahak Panchayat Intervention. Amenities - clubhouse, gym, party lawn, garden etc - not provided.

C) Electrical meter Rs. 75,000 collected from the flat buyers.

6) Aura City Shikrapur - Jalan Maple Developers:


A) 1000 Flats - Rs. 14 - 25 Lakhs Each

B) Incomplete project. Construction stalled. Possession of a few flats given. No completion certificate. No basic facilities provided. Ongoing legal cases.

7) Bharatiya Jan Ghar Yojana 2015 - India Housing Day 2015 - Aapla Ghar - Maple Shelters:


A) 15 projects - Rs. 11 - 18 Lakhs per flat

B) Booking amount collected Rs. 1 - 3 Lakhs. No flat agreements.

8) Neo City Wagholi - Maple Shelters & Jalan Group:


A) 1200 flats - Approx Rs. 26 Lakhs Each

B) Incomplete construction. Delayed possession.

C) Electric meter - Rs. 25,000. Infrastructure charges - Rs. 1.5 Lakh. Parking Rs. 1.5 Lakh. Society formation Rs. 5,000. Collected from each flat buyer.

9) KUL Ecoloch Phase 1 Mahalunge - KUL Kumar Builders:


A) 850 Flats - Approx Rs. 55 Lakhs Each

B) Incomplete construction. No basic facilities. Delayed possession.

C) Police complaints against agitating flat buyers.

D) Builder has threatened that flat possession will not be given unless apology letter in the form of affidavit is submitted.

E) Infrastructure charges Rs. 2.5 Lakhs collected from each flat buyer.

10) KUL Ecoloch Phase 2 Mahalunge - KUL Kumar Builders:


A) 750 Flats - Approx Rs. 14 - 25 Lakh Each

B) Construction stalled for years.

C) Infrastructure charges Rs. 2.5 Lakh collected from each flat buyer.

11) Srushti Regency Wadegaon Kesnand - WS Developers:


A) 1980 Flats - 36 Rowhouses - 93 Shops - Approx Rs. 14 - 37 Lakhs Each

B) No sanction from town planning (PMRDA). No environmental Clearance.

C) Stalled project.

D) Society formation - Rs. 20,000. Parking - Rs. 50,000. Electricity meter - Rs. 35,000. Development charges - Rs. 25,000 - collected from each flat buyer.

12) Revell Orchid Lohegaon - Rainbow Housing & Revell Realtors:


A) 550 Flats - Approx Rs. 34 Lakhs Each

B) After delay of 2 years possession was given without Completion & Occupancy Certificate.

C) No water line. No society formation. No conveyance.

D) Infrastructure charges Rs. 3 Lakh collected from each flat buyer. Amenities not provided.

13) Vista Luxuria Manjri - Parmar Indus Associates:


A) 400 Flats - Approx Rs. 20 - 32 Lakh Each

B) Violation of Environmental Clearance. No Completion & occupancy Certificate.

C) Solar Rs. 35,000 + Society formation Rs. 25,000 + Car Parking Rs. 1 Lakh + Electricity meter Rs. 25,000 + Development charges Rs. 1.70 Lakhs - collected from each flat buyer.

D) 198 flat possession was delayed by 1 year. No compensation given.

14) Palladium Grand Dhanori - Raojee Construction & Shreyas Shelter


A) 140 flats

B) Violation of Environmental Clearance. No PMC water supply. No Sewage Treatment Plant. Firefighting system not working. No solar power. No proper approach road. Society not formed after 8 years of flat possession.

C) Builder beats & theatence flat buyers.

8) No help from PMC officials & cooperative department.

15) Defence Colony Radheshwari Nagar Bakori Wagholi - Supertech Construction:


A) 290 Flats - Approx Rs. 24 - 33 Lakhs

B) Illegal floors. No possession. No amenities.

C) Car parking Rs. 1 Lakh + Electricity meter Rs. 1 Lakh - collected from each flat buyer.

16) Aarohi at Sus - Teerth Realties:


A) 220 Flats - Approx Rs. 25 - 40 Lakhs

B) Ongoing legal cases. Basic facilities not provided. Sewage treatment plant not working. Inadequate parking. No water supply. Some possession not given for the last 6 years.

17) Songbirds Bhugaon - Enerrgia SKYi Developers:


A) 1200 Flats - Approx Rs. 65 Lakh Each

B) Incomplete construction. No amenities. Delayed possession.

C) Maintenance Rs. 1.5 Lakhs + Electricity meter Rs. 25,000 + Infrastructure charges Rs. 3 - 5 Lakhs - collected from each flat buyer.

A huge number of property buyers in Pune have not received possession of their flats

1) The builder has become bankrupt & has abandoned the project.

2) The builder is facing financial crunch & construction is stalled.

3) The builder has not received necessary clearances - sanctions & construction has slowed down.

4) The builder has committed the crime of violation of environmental clearance & has received stop work order.

5) The builder has not received enough number of bookings & the construction of the project has not begun.

6) The joint venture partners - the promoters of the project - have split or have some disagreements & issues - and the project is stalled.

Their message for new flat buyers in 2016 is -

1) Every builder is not eligible to book at the launch or at under construction stage of project.

2) Anyone can launch a housing project but very few are capable of completing it.

B) Most of the flat buyers in Pune who have received possession of their flats are unsatisfied & disappointed. Their reasons are -

1) They have lost huge amounts of money because of the delayed possessions.

2) Even after paying the entire property price, they are forced to occupy their homes illegally because their builder has not obtained completion & occupancy certificate.

3) They are suffering due to insufficient or lack of basic facilities like road, water, drainage, power, garbage, safety & security, etc.

4) They have not become the true owners of their homes because their builder has not formed a co-operative housing society & hasn't done conveyance.

5) They are feeling that their builder has looted their maintenance fund - misappropriation of maintenance charges collected from the flat buyers at the time of possession.

6) They are complaining about quality of construction - mainly leakage & seepage in ceiling & walls, poor quality & poor fitting of floor tiles, internal walls without plaster.

7) They are suffering because of the poor planning & allocation of car park.

8) They are disappointed because of the incomplete, insufficient & less than promised amenities.

Their message for new flat buyers in 2016 is -

1) Avoid booking a flat in the fringe villages of Pune which come under PMRDA.

2) Big builder, big brand, does not mean good quality & good service.

3) Form a flat buyers group & monitor the progress of construction on a weekly basis.

Those who have received possession of their flats & those who haven't - appealed to new flat buyers in Pune to avoid the mistakes they have made. To avoid becoming a victim of a builder - like them - their suggestions are:

1) Obtain loan sanction letter from the bank before you start searching a flat.

2) Consider the repayment of loan - not only your eligibility to get the home loan.

3) Book a flat on the basis of per sq. meter carpet area - prevent a builder from committing a crime against State Government of Maharashtra & Central Government of India by selling a flat on the basis of per sq. ft. saleable area.

4) Do not make a decision based on the property ad, sales brochure & sales talk of the salesperson - do title search of the plot of land, check the environmental clearance, sanctions & approvals, study the terms of transactions in the agreement.

5) Book a flat only if the builder is ready to appoint third party construction quality auditor & is ready to share reports at every stage of the construction - till possession.

6) Book a flat only if the builder offers 5 years warranty & guarantee for your flat.

7) Book a flat only if - in case of delayed possession - the builder is ready to pay rent, pre emi & compensation for mental agony, social insult & loss of income tax benefit etc.

8) Give more importance to the current financial status & the debt of the builder than - the number of under construction projects, the history - the track record - & future plans of the builder.

9) Know the actual charges required for electricity, society formation & firmly refuse to pay exorbitant charges.

10) Refuse to pay infrastructure charges - means, charges for the car park - because a builder can not sell a car park - covered or open.

11) Refuse to pay floor rise & the premium for the garden facing flats.

12) Put pressure on the builder & bank to relate the disbursement of loan installment from first slab to conveyance deed.

13) Take possession of your flat only after it receives completion & occupancy certificate from PMC, PCMC & PMRDA.

14) Till PMC, PCMC & Gram Panchayat starts supplying water - it's builder's responsibility to supply free water.

15) After the possession, insist on appointing professional agency for the maintenance of the society and monitor the accounts of maintenance fund.

When I was at the offices of Crime Branch of Pune Police with the flat buyers from Kumar Builders' KUL Ecoloch, I received a phone call of my real estate salesperson friend.

"Some people are protesting at the entrance of CREDAI exhibition! Big news for you!!," my real estate salesperson friend said.

"Protesting? Are you out of your mind? Who will dare to protest against CREDAI?," I said.

"True! That's why it's news!!," my friend said.

My real estate salesperson friend called me again.

"Now, what?," I said.

"CREDAI called police. Police didn't take the protestors in the custody!," my friend said.

"Why? Are police no more friends of Pune builders or what?," I asked.

"Police said they are not protesting. They are creating awareness," my friend said.

"Creating awareness is good. Isn't it?," I said.

"Certainly not! Not good!!," my friend said.

"Not good! For whom? For the builders?," I asked.

"Not good for the property buyers! Aware property buyer will never be able to book a home & may remain homeless for life!," my friend said.

"Means - you are not worried about the builders - you are worried about the property buyers!," I said.

"That's why I called you. You care for the property buyers. I hope you will do something to save them from becoming homeless," my friend said.

"What's the difference? Where do the builders give possession to those who have booked? Isn't it better to become a homeless for not booking a home - than not getting possession of a flat after booking & paying the entire amount to the builder?," I said.

"But, for not getting a flat possession - you can blame a builder. Isn't it better than blaming yourself?," the caller said.

"You sound like a flat buyer! I think I must do something to stop this awareness program," I said.

I told the crime branch police what's going on at CREDAI exhibition & requested them to let me go & do something to stop the awareness program.

"Go & stop it. Awareness is not good. Look at me. After hearing from you that the builder can't sell parking - I have started blaming myself for paying 6 lakhs for 2 car parks. Ignorance is a blessing!," the officer said.

You know what I saw at the main entrance of Credai Pune Home Buying Festival at SSPMS?

Those who have not received possession of their flats were explaining the visitors what precautions they should take while booking a flat & how to avoid becoming a victim of a builder.

You know what was most disappointing?

Huge number of visitors were listening to them carefully!

Do not listen to these guys. You have no power to change the builders. You have to follow the builders' rules. I tried my best to convince as many as I could.

But, no one paid any attention to me.

Sad. Unfortunate. Very stupid of them. Isn't it?

Ignorance is a blessing. Awareness is a curse. Right?

Pune Builders, Join Hands to Eradicate Corruption - Grahak Panchayat

Protest is good. But not enough.
To eradicate corruption builders & property buyers must join hands:



For years, corruption was builders' Aladdin's Genie! Even for a normal & regular work, builders were paying bribes to big & small politicians, bureaucrats & their peons to get the things done. And they were happy about it.

The bribes have become just an additional expenses - administration charges - extra fees. Which any builder can easily recover by looting property buyers. By hiking property prices. By charging exorbitant amounts for Infrastructure, MSEB, Society Formation, Legal Fees, Preferential Location Charges (PLCs), Floor Rise, etc.

Fact of the matter is, the builders have become looting agents of politicians & bureaucrats in Maharashtra. Corruption has given them license to loot property buyers. Real estate industry has become 'criminal enterprise' of corrupt politicians & bureaucrats.

But after the suicide of Mr. Suraj Parmar of Cosmos Group and president of Thane chapter of Maharashtra Chamber of Housing Industry (Credai-MCHI), builders suddenly realized that they themselves have become the victim of corruption. The corrupt politicians & bureaucrats are exploiting them too. And, they are as vulnerable as property buyers.

The corruption is no more an Aladdin's Genie. Corruption is a monster. Builders have realized. On 13th October 2015 they have decided to protest against corruption. All the members of CREDAI, are going to observe protest with closure of offices, sites office, registration and construction work throughout the country.

Good! Protest against corruption is a good step. But not enough to eradicate corruption.

To clean the system by eradicating corruption builders have to do much more than one day protest. They have to join hands with the property buyers. Says Mr. Vijay Sagar of Akhil Bharatiya Grahak Panchayat Pune.

Together we can open a war against the corrupt system & win it too. Says Vijay Sagar.

Of course, first builders must stop looting & extorting property buyers. The builders have to rationalize the property rates. Stop demanding exorbitant charges for Infrastructure, MSEB, Society Formation, Legal Fees, Preferential Location Charges (PLCs), Floor Rise, etc.

If the builders do this - property buyers will help & assist them to get sanctions & approvals, NOCs, completion & occupancy certificates and all required services from collector, town planning, PMRDA, PCMC & PMC offices - fast & without paying any bribe. Says Vijay Sagar.

Together we can fight for rationalization of ready reckoner rates, low stamp duty, VAT, service charges, double taxation and all other issues.

Together we can fight for low development charges, better infrastructure & efficient implementation of development plans.

Even for fair real estate bill.

Grahak Panchayat believes that property buyers & builders are actually two sides of the same coin. Our interests are common. We all are consumers of the state & local government.

And at the end of the day - the bribes you pay is our - property buyers - hard earned money.

If the property buyers refused to pay - the builders will be Na Ghar Ke Na Ghaat Ke.

Instead of that, if builders join hands with property buyers - it will become people's movement against corruption. And you know, corrupt politicians & bureaucrats have always proved powerless against the people's movements.

So, if you are truly against the corruption - members of CREDAI Pune Metro, Marathi Bandhkam Vyavsayik Association and all other associations of the builders & developers - you must join hands with property buyers. Together we will eradicate corruption. That would be true Shradhanjali to Mr. Suraj Parmar of Cosmos Group. Says Mr. Vijay Sagar is this Hindi video.

Fight for Honor, Fight for Home

Residents of Pinnacle Brookside at Bavdhan Budurk, join hands to fight for their consumer rights:

Last weekend, residents of Pinnacle Brookside at Bavdhan Buduruk, called a meeting to discuss their issues. They invited Seematai & Shrikant of Grahak Panchayat. I went along with them and video recorded some part of the meeting.

Women were in the majority. All were focused on the action. Anger, disappointments & frustrations were on the back burners. Small tips were taken seriously. Priorities were set swiftly. At the end of meeting action plan was ready.

Living in a flat which has completion & occupancy certificates is a honor.

Forming a society and getting conveyance is becoming a true owner of your home. After paying such a high property price to the builder and big EMIs to the Bank, you deserve to become an owner of your building and land. Nobody can stop you from becoming an owner. In fact, the state government is helping you to get the conveyance done. The residents were glad to know this.

Before demanding any money, the service provider (the builder), must give the accounts, of money he has collected from them as maintenance charges, society formation charges, MSEB charges.

Demanding VAT & Service Charges without giving proper invoice is unacceptable, unprofessional and illegal.

Demanding extra charges for using club house is an offence.

Demanding maintenance charges based on the size of the flat or on number of rooms is not legal. All units should contribute the same amount for the maintenance of the society is the law.

At the end of the meeting, the residents of Pinnacle Brookside realized that the fight is not only for the home. The fight is for honor.

Their fight is not against anybody. Their fight is for their self respect. To get what they deserve.

How to Fight Against Builder

How "Grahak Panchayat" Helps Pune Property Buyers to Fight for Their Consumer Rights:


Nowadays, Pune property buyers refuse to be victims of builders. They are fighting against the builders for their consumer rights.

Pune property buyers are fighting for the completion certificate.
For the formation of Co-Operative Housing Society.
For the conveyance deed.
For drinking water.
For incomplete construction.
For not providing promised amenities.
For the water leakage & seepage.
For the defective tiles.
For the inferior construction quality.

Pune property buyers have started demanding compensation for delayed possession.

They are demanding accounts & refund of money collected by the builder
as MSEB charges, open parking, society formation charges etc.

Last year, in 2012, Maharashtra Value Added Tax on the properties bought between June 20, 2006, and March 31, 2010 created awareness among Pune property buyers. The VAT issue united Pune property buyers for the first time. Under the leadership of Akhil Bharatiya Grahak Panchayat Pune City, Grahak Hitvardhini, and Sajag Nagrik Manch united Pune property buyers started their fight against the builders.

This 'fight' against VAT, inspired Pune property buyers who had purchased flats after April 2010. These property buyers have started visiting office of Grahak Panchayat on Monday evenings between 6 pm to 7.30 pm. Mr.Vijay Sagar, Ms. Seema Bhakare, Ms. Veena Dixit and other members of the "Builder Related Problems Cell" of Grahak Panchayat guide these property buyers to solve their issues.

"Fact of the matter is - It's not that difficult to fight against the builder! These proactive property buyers realize in the first meeting," said Ms. Seema Bhakare.

"We are not aware about our consumer rights and don't know how to fight for them - is the main problem," said Mr.Vijay Sagar.

"You wont believe, 90 per cent complaints are solved without going to consumer court! Just by writing a letter to the builder!! At Grahak Panchayat we guide these property buyers to complain in a proper way and to take the appropriate steps to resolve the issue, " said Ms. Seema Bhakare.

"No professional builder can afford to refuse the demand of united property buyers who know their rights and are ready to take proper steps," said Mr. Vijay Sagar.

Of course, Monday evening is enough for the guidance, but to create awareness among all, these assertive property buyers invite Ms. Seema Bhakare, Mr. Vijay Sagar, Ms. Veena Dixit, Mr. Shrikant Joshi and other members of the "Builder Related Problems Cell" to their society. Preferably on weekends, all the members of the society gather together in a club house, parking or in a open space to discuss their issues.

At the end of meeting, angry property buyers become assertive. Frustrated property buyers become proactive. Victims of the builder become fighters. Helpless property buyers realize their power. They are no more frightened of their builder.
