Early morning, Sachin Kamble called.

"Meet me at 1 pm at Hotel VITS," Sachin said.

"I have my lunch at 12 noon. 1 pm is too late," I said.

"Good, eat your lunch and reach at 1 pm. Sharp," Sachin said.

"What's the news? Did Hinjewadi police file chargesheet against Kumar Builders?," I asked.

"No," Sachin said.

"Did Kumar Builders give you possession?," I asked.

"No. Come at 1," said Sachin.

At 1 pm Sachin was not at Hotel VITS. I called him.

"Come at Radha Hotel - exactly opposite...," Sachin said.

"I know where it is," I said and went.

"Lalit Kumar has filed 2 hundred crore suit against us," Sachin said.

Suresh Kakad, one more flat buyer of KUL Ecoloch was with him.

"2 Hundred Crores! Lalit Kumar knows your worth. You don't. If you knew - we would have been sitting in VITS," I said.

"Right! Lalit Kumar is more than a builder - he is a teacher!," said Suresh Kakad in Marathi.

"Teacher! Great!! I love teachers. Tell me more," I said & started video recording.

"See, when I booked a flat - all I wanted was a home for my family. But because of Lalit Kumar I have started learning Law. I visited the court for the first time. To file an FIR - I visited the police chowki for the first time and I read Indian criminal procedure code. Though Lalit Kumar didn't give me my flat - for which I have already paid for - he has given me a lot of education," said Suresh Kakad.

"Free education!," Sachin said.

"You know? I have read all these 300 plus pages case paper! Never before - in my entire 44 years life - I read any novel. Or such a big fat book. But I read these case papers. Yes! I read! Every day 20 minutes reading session in a toilet!! Lalit Kumar has made me a reader. For the rest of my life - 20 minutes - every day - I am going to read. Just imagine - how much I am going to learn. All because of my Guru. Guru Lalit Kumar Jain," Suresh said.

"Yes! I am very much thankful to Lalit Kumar Sir for that! You know? I was afraid of police & court case. But now - I am not!," Suresh said.

"In fact, before booking a flat - everyone must learn Law. Compulsory. It would be better if Pune builders start teaching Law to every flat buyer. They can charge - exorbitant charges - like infrastructure & development charges - start collecting legal education charges from the flat buyers," Sachin said.

"Why not change the education pattern? Start teaching Law in the schools!," said Suresh.

"Mr. Devendra Fadnavis, Chief Minister of Maharashtra - like English - make legal education compulsory from the 1st standard," Sachin said.

"Right! Legal education will make us law abiding - strong - citizens - legally educated citizens can fight with the builders," Suresh said.

"Give us practical education - useful in day to day - life," said Sachin.

"Otherwise, most of the things we learn at school - like History - are are not useful for us in day to day life - what say Sachin?," Suresh said.

"Right! That's why we consider Lalit Kumar Jain our guide - guru - teacher - who is giving us useful education - Thanks, Lalit Kumar Sir!   5. Ye to hadd ho gayi .....200 crores!!! Really bulder teaching us ....kuch din tak hum sirf Nokari aur Khar ke hi bare me sochte the(khud ke hi)...aur hamesha pareshaniyo se dur bhagte/darte ....Now we started to face every where some thing wrong practices and systems (not only with Builder).

    I would like to thank you for opening our eyes by sharing such horrifying experiences of people. It is really disheartening.
    Do these builders want to sell their flat to people or they are just investing black money ?... not getting why builders behaving like this. Really at least I am very dishearten by these stories and lost my confidence to buy flat in PUNE. I am also a stupid IT engineer from Germany and was dreaming to have flat in Pune (Sadly)....Don't know when or should I buy flat in Pune?.....but Thanks a lot RAVI for showing us a way and educating us......so we should not get looted by such Builder.....

    I would like to say THANK To YOU for sharing such lots of reviews and experiences of this builder lobby......
    I am also a stupid IT engineer from Onsite ,dreaming to buy a single flat in Pune(Sadly).
    Thank a lot for opening our eyes by sharing such horrifying experiences , so that at least people can not get looted by these builders.

    I was really thinking to buy flat with these builders but now I have to rethink on my decision.

    I have one question, Does builder want to loot people? or Do they really want to sell these built flats to people ? or
    do they just want o invest black money in these buildings? I really don't get it.......

    Or they don't know that....We can fool one person at all time....we can fool some persons at all time....
    but we can not fool all the persons all the time.......

    I am really dishearten by these experiences of the people.......

      Why are you so keen to get yourself bitten by rabid dogs ? You are in Germany, enjoy there. If you happen to be in Berlin, just see how many people even own a house ! And if you are in Frankfurt, enjoy the city to it's fullest. Don't know why you want to buy flat in Pune sitting in Germany ?

      For builders here, taking flat buyers money is primary aim, not constructing the flat. And those who somehow construct, don't do conveyance deed & keep land with themselves.

      So think about buying only ready possession flat when you are in Pune, till then enjoy concerts at Jahrhunderthalle, Frankfurt or take river cruise & chill out there.

      I have asked some of them to builder , not all of them.
      I was there for more than 12 years in Pune.
      I am looking for flat for almost 5 years.
      But I could not take a Flat decision because every time I feel flats are overpriced. Builders are also somehow responsible that I am here in Germany. Due to my aspiration to buy flat in Pune. Every time I go for negotiation they have increased price. So I thought without working in foreign country, We can not buy flat in Pune.
      So lets see when can I buy flat in Pune?

      I am agree with @Enigma. Flats in baner balewadi are definitely overpriced.

      Logically how builder can sell roadside flat for extra 200 Psft ? but, we have such experiences , that's why people are raising voices. If Industry in Germany follows fair practice then Is it very difficult or impossible in India?......Is CREDAI there only for organizing exhibitions? ...is it only work that CREDAI can do?.....

      Firstly, you are not stupid neither I am, we sail in same boat. I am also in Europe just to arrange the down payment amount like you. And yes, just like the wise young woman Chaitrali Latkar who was in Belgium for 1.5yrs.

      I am here at Ravi’s blogs because I am also a perspective buyer of a home (I will not call it as house because I will borrow money from a bank(modern ‘Lala’) and the bank will be the owner in real sense unless I repay them) like you.

      I have been reading Ravi’s blogs since yesterday and spent whole weekend reading them and watching videos, wonderful experience!! (I read only 2016)

      Secondly, prices purely depend on builder’s lobby and not on demand/supply. Builders are in this business just to earn money. People term it as ‘they loot’ ‘you donate’. At the end buying home is your need for various reasons that’s why we are slaves. Builders might have taken oath in CREDAI office that the will not lower the base price. That’s why they come up with schemes like free modular kitchen, No VAT & service tax, etc.

      Back in 2010 I came across an excel sheet which showed how investing in FD was profitable than buying a house. It was based on opening FDs of EMI minus rent each month. And then there was a comparison of historical data of realty prices. Result showed that you get a lot of money after 20 years than you would get after selling your flat after repaying your loan. The cost of your flat included interest, property tax per annum, society maintenance, etc. Unfortunately, I lost that file in my old laptop, if anyone has please share.

      Now, my opinion on what we should do in today’s scenario.
      1. DO NOT buy under construction flat.
      2. If you are buying newly constructed RTM flat, BEWARE it has 35-40% loading. Its insane to buy unless you are passionate about new things.
      3. Always compare final price on carpet area.
      4. Go for resale flat which is constructed before 2009 because that time loading was 18-20%, balcony area considered 50%, used clay bricks, etc. I believe you have kids so the resale flat will definitely have schools/hospitals nearby and better connectivity. You get agreement done on what you pay. You will have all the readymade information about the area.
      5. If you buy resale flat consider at least 2-3 lakh on renovating it. After all you should get a feeling of moving to your own new home. If you are eligible, you will get furniture loan as well.
      6. You should have at least 1 parking.
      7. If you settle for 50 lakh property you should have at least 13-14 lakh as own contribution. I consider that bank will finance 80%. BEWARE there are touts in the market who will lure you for misleading processing fees, interest rates and insurance.

      Disclaimer- all my opinions are based on my personal experience and you should believe you own brain and heart.

      Coming to the original post….its very sad to hear that builder filed defamation case for asking possession of their own home on time. Its funny that these poor chaps paid legal charges like 20-25K to the builder only to get sued. They are saying they got Free Education. No……….nothing comes free in this world! They paid for it in the form of Legal charges.

  9. 200 Cr defamation suit filed by bankrupt builder, whose aukaad is not of even 20 paisa, lol.

    As it is said - Patriotism is last refuge of scoundrels, similarly, defamation case is last resort of class less, sadak chap, sewage insect grade builders.

    This type of action from Lalit Kumar Jain was expected when he filed FIR against Ravi earlier too. What more can be expected from former Pune area commander of Lashkar-e-CREDAI ?

    Now all thugs & parasites (read Pune builders) will keep mum thinking that if this sadak chap builder wins, they too can do the same. But let me tell all these gutter grade builders - this is not going to happen.

    Ravi & all the buyers who have been sent defamation notice under IPC 499 & maybe also under IPC 500 of Indian Penal Code 1860, please note the following :

    These charges are normally pressed to intimidate the opponent. Infact, this law is of British Era & was used widely then to suppress those speaking against British Govt & third class Queen.

    The following things can be done :

    File case against this sadak chap builder under IPC 209, 211, 415, 420.
    Consumer court case must already must be on, if not file one there as well alongwith National Consumer Commission & CCI.

    This sadak chap builder had also sent a letter which was shown in magicbricks now channel where builder has sent in writing that the flat buyers won't do this & that to get flat possession. This is on record, in media & itself is illegal. Use this to show that builder is blackmailing them. Another case be filed against builder for blackmailing, threat, extortion. These can be covered under IPC 383 to 389.
    Apart from this, standard sections of IPC 24, 43 & 44 can be used for dishonesty, illegal & mental injury.

    And last but not the least, do take this issue up again in media - electronic, print, social etc.

    Ravi & all the flat buyers who are facing trouble from crook builder, be assured that IPC 499, 500 in your case will be thrown in dustbin by the judge, this I am saying based on one of my lawyer friend who is one of the top notch lawyers. And don't let matter end here, file all the cases possible under relevant sections against the builder as well & claim so heavy compensation that LK Jain should be unable to pay even if tries to sell himself on Olx, LoL.

    And even after reading this, there may be Yedas who will go & buy flat in under-construction project.

  11. It seems that the frustration on part of builders alias sadak chap dacoits is reaching it's peak that they are retorting to these type of highly deplorable acts against their own buyers. This useless KUL should rename their tagline to - We Build (fake) Cases.

    And Ravi, this KUL thug will need to file case against media channels as they had covered the grievances of flat buyers in magicbricks now. But he won't have guts to do so. This is the start of end of KUL & this KUL will take several other builders too with him.

    Two developers raided, undisclosed earnings worth Rs 150 cr exposed :

    In two separate raids conducted by the Pune's income tax department, crores of undisclosed income was exposed in the city. The raids were conducted last week on well known builders and developers Amit Enterprises and Raviraj Enterprises.

    The three-day raid across locations yielded close to Rs 150 crore worth of cash, jewellery and undisclosed documents of land. The tax department also seized documents pertaining to multiple investments in fixed deposits by the groups, which is currently being evaluated by the agency, sources said.

      Had a word with couple of my lawyers on yours & buyers issue about sadak chap KUL case. And what they said you know ? Kon hain uska chu***a vakil ? LoL.
      The case won't stand & my lawyers have advised not to let builder let go even after court dismisses the case. The buyers should file counter complaints as mentioned above, including yourself since targeting you is just targeting media. You can easily file case under mental harassment & also for filing fake case to trouble you.
      And yes, please send a letter about this builder harassment just for record to CM, Devendra Fadnavis & Minister for Housing, Prakash Mehta & then again raise the issue in magicbricks TV.

      With complaints against conniving builders constantly coming up, the state government has decided to constitute a housing regulatory authority to safeguard the interests of homebuyers. The authority will be a quasi-judicial body and resolve disputes related to the housing sector. Four benches are likely to be established to hear the cases at different cities in the state, including Pune, considering the number of complaints against builders.

      Buying flats at high price from builders itself is a crime. This same money is used against buyers while buyer pays EMIs for same & builder enjoys money doing nothing.
      After going through all such info, it feels really good to stay on rent than buy flat. You are saved from hefty EMIs as well as from fraud actions by builders-dacoits.

    Sadly, I am also one of the buyer in the KUL Ecoloch project. I am not shocked to see such foolish defamation case being filed. Lalit Kumar Jain has run out of option and now he he trying to use his money and power to silent the agitating buyers and you.

    like many others, I bought the flat in 2011 and living outside India for last couple of years. I am coming to India just to fight the builder. How can I participate in this case of Corrupt builder v/s Frustrated Buyers till Dec from outside India? Dec I'll be present there.

    Hopefully, flat buyers who are cheated by KUL too can act just the way buyers of Orbit corp have by filing Police case against crook builder which has landed him in jail & the same can be done for LK Jain as well.

      Govt body to solve homebuyers’ woes :
      With complaints against conniving builders constantly coming up, the state government has decided to constitute a housing regulatory authority to safeguard the interests of homebuyers. The authority will be a quasi-judicial body and resolve disputes related to the housing sector. Four benches are likely to be established to hear the cases at different cities in the state, including Pune, considering the number of complaints against builders. Since this will be done before 31st of October, do make full use of it.

      Orbit Group case: 40 more home buyers lodge complaint, realtor’s custody extended :
      On Monday, the buyers met the senior police inspector of Azad Maidan police station claiming that they had earlier approached the Saki Naka police against Aggarwal and wanted to merge their complaints with the current case. They also sought that the entire investigation of the case be transferred to the Economic Offences Wing of the Mumbai Police. The police has told the buyers – many of them NRIs – to send across their complaints via email.

  14. KUL had no money now they have taken loan from dubai because now they had no money. It was not possible without this blog. Great work. I think Court should give 200 crores back to you 6 people so that builder can understand that this is not joke to file defamation case against troubled buyer of flat.

    1. Thanks for the link. It categorically states that this money is for refinancing. They had invested in other bankrupt builder Marvel too earlier, but still marvel projects are stuck & payments to it's contractors are pending.

      BTW, whenever money flows in from Abu Dhabi/Dubai (UAE), Mauritius & Cayman Islands, it raises eyebrows as most often this is nothing but black money which goes out by havala & comes in as FII routed via local companies registered in these countries.
      If you remember, Emaar was another such Dubai based company which had several projects in NCR, Jaipur etc. & had ties up with builders like DLF, MGF etc. which happened to be very close to CONgress.

  15. This is another Pune real estate, this time involving white collared builder & one of the most hyped project in Pune - Trump Towers, Kalyaninagar. What I wonder is why did most of the local media didn't cover this issue, just because politicians & Trump name is involved ? This news has come first in British newspaper about land scam on which this project stands & later this news was carried forward by local media.

    The Republican nominee lent his name to property now facing legal scrutiny – the latest incident in his troubled attempt to enter the Indian market.

    Saurabh Rao, the district collector (or top administrative officer) for Pune state, told the Guardian: “We are currently in the investigation process. We have been conducting an inquiry for the last five or six months.” The results of the investigation are due to be published imminently, Rao said.

    According to Rao, “the land passed through various hands and eventually reached Panchshil, or a company that is definitely related to Panchshil.”

    In a telephone interview with the Guardian, Rao confirmed that there were irregularities, saying: “There are definitely two different files [with the same number]. Usually it never happens that there are two files with the same number.”

    Police inspector Sanjay Patil, who conducted a primary inquiry into the complaint, said: “The investigation is ongoing. We are waiting for various department heads to reply to our requests for more information.”

    पुणे में ट्रंप के नाम से बनी दो गगनचुंबी इमारतों को लेकर गंभीर आरोप लगे हैं. ट्रंप टॉवर्स के नाम से पुणे में 23-23 मंजिला ये दो इमारतें बनी हैं.

    क्या हैं आरोप, किसने लगाए आरोप?
    RTI कार्यकर्ता रविन्द्र बर्हाटे के मुताबिक पुणे के कल्याणी नगर में जहां ट्रंप टॉवर्स है, वो कुल 5 लाख 20 हजार वर्ग फीट ज़मीन से जुड़ा मामला है. बर्हाटे के मुताबिक 1991 में पुणे के ज़िलाधिकारी ने अर्बन लैंड सीलिंग (ULC) कानून के तहत इस ज़मीन में से सिर्फ 20 हजार वर्ग फीट जमीन असली मालिक सरोज गांधी के नाम रखने का आदेश किया था. जिलाधिकारी ने बाकी बची पांच लाख वर्ग फीट जमीन सरकार के नाम करने के आदेश दिए थे.

    गरीबों के लिए घर बनाने का था वादा
    बर्हाटे का कहना है कि 1994 में बिल्डर सुरेंद्र संस ने जमीन का कब्जा सरोज गांधी से करारनामा कर पॉवर ऑफ अटॉर्नी के आधार पर ले लिया. बर्हाटे का आरोप है कि पुणे नगर निगम में फर्जी अर्बन लैंड सीलिंग (यूएलसी) ऑर्डर लगाया गया. साथ ही ये वादा किया गया कि जमीन पर गरीब लोगों के लिए घर बनाए जाएंगे. बर्हाटे का आरोप है कि बिल्डिंग लेआउट के लिए स्टेट बैंक ऑफ इंडिया के नाम से फर्जी स्टाम्प की रसीद तैयार की गई.

    बर्हाटे का कहना है कि जमीन के तीन प्लॉट किए गए, उसमें से एक प्लाट पर लैंडमार्क गार्डन के नाम से आलीशान रिहाइशी सोसाइटी निर्माण कर बेच डाली गई. दूसरे प्लाट पर अब ट्रंप टावर्स खड़ी है. वहीं तीसरे प्लाट पर बिशप स्कूल की इमारत है.

    तैयार किया गया फर्जी दस्तावेज!
    साल 2003 में पंचशील ग्रुप ने सुरेंद्र संस बिल्डर से दो नंबर का प्लॉट खरीद लिया. बर्हाटे का आरोप है कि बाजार भाव काफी ज्यादा होने के बावजूद सिर्फ 2 करोड़ 30 लाख रुपए में पंचशील ग्रुप ने ये ज़मीन खरीदी. बर्हाटे का ये भी आरोप है कि सुरेंद्र संस, चोरडिया ब्रदर्स और सरकारी अधिकारियों ने मिली भगत करके फर्जी दस्तावेज तैयार कर जमीन को फ्रीहोल्ड दिखाया.

    क्या है डिस्ट्रिक्ट मजिस्ट्रेट का कहना?
    'आजतक' ने इस मामले में राज्य सरकार की तफ्तीश के बारे में जानने के लिए पुणे के ज़िला मजिस्ट्रेट सौरभ राव से संपर्क किया. सौरभ राव का कहना है कि ये मामला बहुत पेचीदा है. तफ्तीश पूरी होने के बाद ही पता चल पाएगा कि जमीन किसकी है? या इसकी खरीद-फरोख्त में गैर कानूनी तरीके अपनाए गए या नहीं?

    जिला मजिस्ट्रेट ने ये ज़रूर कहा कि जो शिकायत प्राप्त हुई हैं उसमें काफी जटिलताएं हैं. पुराने दस्तावेज है. इन्हें रिकॉर्ड रूम से चेक कराया जा रहा है. बहरहाल ट्रंप टावर्स की जमीन से जुड़े सच की तफ्तीश में राज्य सरकार के 74 अधिकारी जुटे हुए हैं.
