How to Fight Against Builder

How "Grahak Panchayat" Helps Pune Property Buyers to Fight for Their Consumer Rights:


Nowadays, Pune property buyers refuse to be victims of builders. They are fighting against the builders for their consumer rights.

Pune property buyers are fighting for the completion certificate.
For the formation of Co-Operative Housing Society.
For the conveyance deed.
For drinking water.
For incomplete construction.
For not providing promised amenities.
For the water leakage & seepage.
For the defective tiles.
For the inferior construction quality.

Pune property buyers have started demanding compensation for delayed possession.

They are demanding accounts & refund of money collected by the builder
as MSEB charges, open parking, society formation charges etc.

Last year, in 2012, Maharashtra Value Added Tax on the properties bought between June 20, 2006, and March 31, 2010 created awareness among Pune property buyers. The VAT issue united Pune property buyers for the first time. Under the leadership of Akhil Bharatiya Grahak Panchayat Pune City, Grahak Hitvardhini, and Sajag Nagrik Manch united Pune property buyers started their fight against the builders.

This 'fight' against VAT, inspired Pune property buyers who had purchased flats after April 2010. These property buyers have started visiting office of Grahak Panchayat on Monday evenings between 6 pm to 7.30 pm. Mr.Vijay Sagar, Ms. Seema Bhakare, Ms. Veena Dixit and other members of the "Builder Related Problems Cell" of Grahak Panchayat guide these property buyers to solve their issues.

"Fact of the matter is - It's not that difficult to fight against the builder! These proactive property buyers realize in the first meeting," said Ms. Seema Bhakare.

"We are not aware about our consumer rights and don't know how to fight for them - is the main problem," said Mr.Vijay Sagar.

"You wont believe, 90 per cent complaints are solved without going to consumer court! Just by writing a letter to the builder!! At Grahak Panchayat we guide these property buyers to complain in a proper way and to take the appropriate steps to resolve the issue, " said Ms. Seema Bhakare.

"No professional builder can afford to refuse the demand of united property buyers who know their rights and are ready to take proper steps," said Mr. Vijay Sagar.

Of course, Monday evening is enough for the guidance, but to create awareness among all, these assertive property buyers invite Ms. Seema Bhakare, Mr. Vijay Sagar, Ms. Veena Dixit, Mr. Shrikant Joshi and other members of the "Builder Related Problems Cell" to their society. Preferably on weekends, all the members of the society gather together in a club house, parking or in a open space to discuss their issues.

At the end of meeting, angry property buyers become assertive. Frustrated property buyers become proactive. Victims of the builder become fighters. Helpless property buyers realize their power. They are no more frightened of their builder.

Last weekend, I attended one such society meeting and video recorded it. Quality of the video is not satisfactory. Discussion is in Marathi. But still, for sure, the video will inspire you to invite "Builder Related Problems Cell" of Grahak Panchayat to your society.

If those who are less privileged can fight for their rights, then why not we - educated, mostly upper caste Hindus, middle income, middle class property buyers! You will tell yourselves and contact Grahak Panchayat Pune at the following address:

  3. Dear Sir,
    I m going to perches a old flat in Kasarwadi PCMC this is 5 year old flat but not having the society, also builder is not providing drinking water at 4th floor all plumbing arrangement for drinking and boring water is made but only boring water is provided,
    Total no flat in society is 08, two flats of 1st floor is with builder, PCMC completion certificate is available

    How can we go for society formation builder is refusing for the same

  6. Hi Ravi, i have query regarding property and need your guidance on below.
    -->I have booked 2 bhk flat two month back (ready possession flat, now i am shifted into that flat)
    --> done agreement on last month (May-2014).
    -->after agreement, done home loan from SBI for 30L but as par bank rule got approved loan of 28L from SBI,
    -->As par agreement clause i have to pay loan amount within 15 day and then after i will charge for 15% interest yearly basis. But loan from SBI released on 30 days from agreement.
    -->now builder is claiming 2Laks pending amount + 2Lakhs penalty from delay in loan.
    -->as par agreement, i have to pay 15% delay amount for 15 days but builder is saying he will charge 2 lakhs penalty and if not given he will allot my covered parking to someone else(As covered parking is not mentioned in agreement).
    -->Now I don’t have possession letter in hand or any other letter in my hand. i am trying to pay 2 lakhs difference amount but builder is not accepting. Saying 2 lakhs additional amount as penalty
    -->builder is completely unprofessional (kind of guntha mantri ),in relation with one MP.
    -->In above case need your suggestion on how can I fight with builder for covered parking issue or is there any way builder can harm me. (Such as electricity, water supply, society formation).

    We are in very complicated situation related to Parking Space. Please go through below details.

    We have signed one of the page of the agreement on which our parking location is shown. In front of every parking they have marked small rooms. Now we observed that marked small room is for Domestic toilet for that wing. They have made that toilet in front of our parking space so they did not get enough space for our parking and extended line out side the pillars and told us that we have balcony at the back (upper) side of our parking, which comes in parking dimensions/area !! after that we have gone through all same parking which has balcony on at back(upper) side. We are shocked !! They have proper big parking space inside the pillars and upper balcony is not considered as a parking area because they do not have toilet in front of their parking, however per agreement copy small room/toilet also drawn in that parking also. Builder just has selected our parking area to built a toilet randomly or as per their convenience ! We are fighting with them from last 12 months but they are not responding and ignoring our concern. We got 4.5 to 5 feet less space because of this issue and builder has forced us to consider under balcony area as parking !! Even parking layout of agreement copy also shown as zigzag but in actual only our parking is out of pillars and others got inside. please refer attached image.

    Conclusion : Builder/Architect has done a error to accommodate toilet and ignored our parking space.

    Could you please advice what will be our next step and how to fight with builder because we are unable to find legal/proper rules related to parking and also they are not providing is the PCMC approved layout related to Toilet area section. They did not even show any dimension of parking and toilet area selection. We have checked with PCMC also but they only have the same parking plan which we have. They do not have anything related to toilet permission/location. We have talked with Grahak Panchayat long time back but they do not have any knowledge related with our concern. Sir, If you can not understand our issue and comfortable to talk with us then please share your contact number.

  9. Dear Raviji,
    I had booked a 1bhk flat at vadgaon mawal(pune) in March 2011 a project called alfa greenfields - by ARK Prem construction, Pune. This Year I got possession but with incomplete amenities(MSEB METER, Elevator, SWIMMING POOL, CLUB HOUSE, PARKING SPACE ALLOTMENT letter, INTERNAL & EXTERNAL ROAD) as mentioned in agreement by builder. I paid full amount with 2 years maintenance having faith in builder. 75% flats are been sold out. At present 12 flats are staying for full-time and rest visit occasionally. Me too visit once a month. The builder has stopped work completely since last 6 months. Now he is passing the time and did not reply properly to any flat owner. He do not reply to phone call or show interest to meet the flat owners. It is understood that he has started his new project at Wagholi, Pune. How can he do this by leaving this existing project incomplete?
    We all want our amenities as mentioned in agreement at fast as possible. He has delayed this project by 2.5 years as of date.
    We all therefore want your advise in this regard

  10. Hi,

    There is one project in Punawale,Pune [Project name: My Home Mh14 Punawale].
    Possession of flat was supposed to be started in Dec 2015, but eventually it couldn't be started on time. Builder has started possession from April 2016.
    Few points:
    1) Builder started giving possession without completion certificate and occupancy certificate
    2) For people who have not yet taken possession for them too compulsorily society maintenance is started from Apr 2016.

    Is it legal?
    Can we do something about it? Any complaint to be done to PCMC? If yes, where? What approach can we take?

    Few people who have not taken possession yet because of lack of OC and CC with builder - Can you suggest something for them? what should they be doing?
