Dhanori Lake - a natural community resource or a private property of Lunkad Realty?

High drama and tension prevailed at Ambanagari Co-operative Society during an inspection visit by a three-member team from the Ministry of Environment and Forests (MoEF) which had come to inspect Dhanori Lake and its surroundings on Saturday morning.

NATIONAL SOCIETY for Clean Cities (NSCC), Pune has taken up the cause of Dhanori Lake after one of their mohalla committees, the Dhanori citizens forum, brought it to their notice. Residents of that area appealed it to help them preserve the lake. When the NSCC visited the site, it was completely convinced. We were also bowled over by its sheer beauty.

We have studied the situation and strongly feel that this lake should be conserved and the area around the lake be developed as a garden.

A brief history

Dhanori lake is covered under survey numbers 47 and 90 and the total area is nearly 11 hectares. According to the development plan (DP), serial number 47 is a residential zone and 90 is an agriculture zone. While studying the survey of India map of Pune, published in 1971, we noted that this area has been shown as a quarry and hence wonder how could it ever be shown as a residential zone in a much later DP. Even a study of the development plan of 23 villages shows it to be a quarry and also shows a rivulet flowing away from it..

The Gai Wadar Mazdoor Society used to be the owners and now the owners are M/s Vijaykumar Mehta and Ors. They have approached the Pune Municipal Corporation (PMC) for constructing residential buildings. They propose to do so by filling the complete lake with rubble and earth and stamping it down. This can be verified by the note submitted to PMC by their structural consultants.

Without receiving permission, the builders started dumping rubble into the lake and have filled up two corners of the lake. They even started de-watering the lake and dumping the water into PMC drains without permission. This continued until the mohalla committee complained and PMC sent a notice to the builders to stop this activity. In spite of this notice, the builders continued de-watering the lake and dumping rubble at night until stricter action was taken by the PMC..

The lake and its environment

The lake is a heaven sent and a very beautiful site. Words fail to describe it. The lake started off as a quarry. However the quarrying came to a stop nearly three decades ago as per the residents of that area as it filled up with water. This was the result of tapping an underground watercourse and this watercourse has filled up the lake. Now it has become a perennial lake and the depth of the water, even in summer, hardly changes. The quality of water is also very good and the water starved societies on the banks of the lake pump water for their use. A wide variety of birds visit the lake and even nest there. The lake is also home to an abundant aqua life and locals even fish there with nets and line. So not only does the lake serve as a complete ecosystem but also meets the water requirements of the nearby societies.

A report from a TUV certified laboratory shows the water from the lake to be potable. This makes it all the more imperative to conserve this lake.

Our request

We have written to the PMC requesting it to take into consideration the Development Control (DC) rule 11.1.b, which mentions inter alia, "Not withstanding the above, the authority shall be entitled to take cognisance of the existence of all water courses, whether shown on the development plan or not, while sanctioning layouts and no person shall take any action without the permission of authority, which results in reducing the water way or closing or filling up of any existing water course." We have also requested them to not allow the builder to dump any rubble into the lake and fill up the existing subterranean watercourse.

Also, permission should not be extended to the builder by the city engineer or zonal commissioner to construct any building as it will be against the provisions of the DC rules 11 for site requirement..

Pune does not have many lakes and one of this size (most likely Pune’s largest lake) is a rare and a wondrous thing - a gift from god that we should neither reject nor allow it to be ruined. Hence it is essential that all efforts are made to preserve this treasure for, which belongs to the people of Pune. With this in mind, we have further requested the PMC to take the necessary steps to acquire this property and conserve the Dhanori lake and its ecosystem. Press Release-12 Jul 2008

Construction activity at Survey No. 86, Sahakarnagar, which comes under the hill top and hill slopes zone, came to a halt on Saturday, following intervention by Congress corporator and former mayor, Vandana Chavan.

The state government has finally admitted that the hill top and hill slope area in the Development Plan (DP) for Baner and Balewadi submitted by the Pune Municipal Corporation (PMC) had been altered.

Only you can save Pune!

For more than 5 years, i have done adverting of Lunkad Realty. In those days, up to 2003, Lunkad Realty was Lunkad Housing and had all their projects in Viman Nagar on Nagar road. So i have worked with Amit Lunkad of Lunkad Realty and know him quite well. When i read this news about Dhanori Lake and saw his photo in DNA, two things amused me.

First, the news was about 'water'! Looks like that Amit Lunkad and Lunkad Realty has some mystic bond with "water". There was no water in Viman Nagar. (It is not there even today!)

Second, this is my first blog on Lunkad Realty and Amit Lunkad. But i am not feeling good about it. Lunkads, father and both sons, were more than my favorite clients!

However, when i visited all above stories, i realized that only you, property buyers, can stop the destruction of Pune. Only you can defeat the combined forces of politicians, government officials, builders and protect the citizens of Pune.

Just imagine, what will happen if you stopped booking a flat in Balewadi Baner till the government finalizes the development plan?

What will happen if you refused to book a property in the project constructed on the hill slope?

I don't think Lunkad Realty would have been interested in constructing "Lunakd WaterWorld" by filling up rubble in "Dhanori Lake" if they knew that property buyers wont book!

However, according to the president of PBAP, not all 400 members of his organization have the skill sets required to execute such projects, so that only 10 members have been able to attract under $1 billion investment from abroad.

Who are 'attractive' developers?

1.Runwal Housing:
“FDI is our strategy for growth: most of our growth over the next few years will be through FDI. We have ongoing talks with an overseas partner for Rs 200-crore FDI in our first large project, an integrated township at Hadapsar, which we will announce by October,” Sanjay Runwal.
2. City Group:
Future group has invested $45 million (Rs 180 crore) in City Group’s Rs 850 crore Amanora Market City, through its offshore fund Horizon Realty LLC.
3. Paranjape Schemes:
Rs 250 crore invested by the IndiaReit Offshore Fund of the Ajay Piramal group, in which the UK-based 3i is invested.
4. D S Kulkarni:
The Rs 16,000-crore proposed township-cum-SEZ project is spread over 400 acres at Fursungi, on the city’s eastern edge city and a memorandum of understanding for a Rs 1,000 crore joint venture has been signed.

Credit Suisse’s real estate investment arm has invested in a hotel-office-residential block

Citigroup Property Investment picking up an equal stake in a high-end housing complex.
FDI norms:the project should have a minimum size of 50,000 sq mt for a commercial project and 25 acres for a residential and a minium investment of $5 million with a three-year lock in.

Encroachments at Ramnadi pulled down

Ramnadi, August 7, 2007:
Following disclosure by district collector Prabhakar Desmukh of prominent developers encroaching Ramnadi, builders and housing societies in Bavdhan and Baner themselves pulled down compound walls and cleared the debris from the river on Monday.

According to a statement issued by the Pune Municipal Corporation (PMC),
Kumar builders pulled down a compound wall and removed the rubble from Ramnadi
and Tejas builders pulled down temporary structures on an 80-metre area.
In Baner, the La-chappel co-op housing society pulled down a 25-metre wall,
Ujwal co-op society razed a 20-metre wall

"The ruling Nationalist Congress Party in the PMC (Pune Municipal Corporation)
does not support any builder
and will fully support the administration in the drive.
However, I have asked Pardeshi (Pravinsinh Pardeshi, Municipal Commissioner)
to pull down the constructions and encroachments of big builders on priority,
instead of initiating action against the huts of the local farmers," Bhosale told reporters.

"The developer of the said housing scheme
has illegally constructed a mini-dam on the premises.
The two hotels have constructions that encroach on Ramnadi.
However, these three encroachments do not find a mention in the collector's list

demanded that the PMC, (Pune Municipal Corporation),
and the collectorate,(Prabhakar Deshmukh, District Collector)
issued a clarification,
after verification of course,
in all such cases
("Paranjape Developers, D.S. Kulkarni, Mantri Constructions, Kumar Builders, Avinash Bhosale’s Abhijit Constructions, Tejas Developers, and Shivshailam Developers, and others..."..?..!),
where it is established that the developers had carried out the work

Detailed survey, conducted jointly by the collectorate and the Pune Municipal Corporation (PMC), has established that the developers had extended their plot areas by the filling up the river bed with rubble or soil.

"Encroachments in river beds cannot be allowed and these need to be removed. The law says that if a third party (flat owners) interest has been created, they (flat owners) can sue the builders by approaching the consumer forum," Prabhakar Deshmukh, District Collector, said.

“We will verify what maps were presented to us by the developers while seeking permission and what their affidavits say. If they have misrepresented the case, they will be penalized and also action will be taken against erring officers,” Deshmukh said.

"Many developers had undertaken the projects after verifying the land records and before going ahead with any action, they should be given a hearing. Two dozen buildings constructed by prominent city builders stand on the Ramnadi river bed


“The layouts of these buildings were approved by the district collector and we (Pune Municipal Corporation (PMC)) had no choice but to approve the building plans,” was the repeated reply given by civic officials led by development engineer S.K. Thorat.

“They have grabbed around three lakh square feet of land,” Vikas Mathkari, leader of the opposition and Corporator Ujjwal Keskar alleged.

Because of the encroachments 48 meters width of the Ramnadi is reduced to 20 meters

Elaborating on the nature of encroachments, Prabhakar Deshmukh, District Collector, said some were constructed properties while some were in the nature of land plots. "We have supplied the information to the PMC and asked the officials to identify owners of these encroachments."

"It is the civic body which prepares and approves the development plan (DP) and sends it to the state government. So there is no question of the district administration neglecting to mention the river status," the district collector said.

Major alterations were made by civic officials in the originally approved DP

City-based environmental organisations, including Parisar, Gomukh, Indian National Trust for Art and Cultural Heritage (Intach), Centre for Development Studies and Activities (CDSA) and Centre for Environment Education, made charges against civic officials, irrigation department officials and the revenue department in the district collectorate.

Ramnadi, March 2004:

Pune Municipal Corporation would soon embark on a project to de-silt and beautify the Pashan lake

Municipal commissioner Sanjay Kumar, Corporators Tanaji Nimhan and Ramdas Kale, elected representatives from the Pashan and Aundh, civic garden department chief Y.S. Khaire, water department chief V.G. Kulkarni and mechanical department chief Uday Biniwale participated in the meeting.

While the mechanical department has been told to deploy its machinery to de-silt the lake, the garden department is expected to transport the silt to Aundh and use the same for the beautification of the Ramnadi (river) and its banks.

The Ramnadi, once the lifeline of Aundh, has now turned into a storm-water drain. So much so that newcomers to Aundh don’t even know that the river existed there once. As the Pashan lake has been lying unattended for several years now, the water department expects to excavate a large quantity of fine silt from it.

Kumar said de-silting would increase the water storage capacity of the lake, which was once used for supplying drinking water to Pashan and surrounding areas.

Nimhan and Kale suggested that the PMC should recondition the machinery at the Pashan water purification centre. This will enable the PMC to hold more water in the lake during the monsoons and supply purified water to Pashan, Someshwarwadi, Sutarwadi, Baner, Sus, Bavdhan and Balewadi areas.

Ramnadi, November 2003:

Pune Municipal Corporation has resolved to beautify the Ramnadi, which runs through Aundh and Pashan

Speaking to reporters here on Thursday, local corporator Tanaji Nimhan said the PMC will spend Rs 2 crore on the river beautification plan, which also envisages developing a garden along the 20-km-long river bank.

President of Vanrai, Mohan Dharia, will lay the foundation stone for the project at a function to be held near the Pashan water treatment centre, off Pashan-Sutarwadi road, on November 2, Nimhan said.

The project assumes significance, considering the Ramnadi has turned into a sewage canal and garbage dump over the years. “In fact, many local residents are not even aware of the fact that a river exists in this area,” Nimhan said, adding the project would be completed within the next two years.
