In this week, we lost a court battle against the unholy nexus of corrupt Indian banking industry, big business houses and politicians.

ACP Neelesh More had to let go Ravindra Marathe, CMD, Bank of Maharashtra.

Special Public Prosecutor Pravin Chavan was absent.

Our, DSK Victims', advocate Amit Deshpande couldn't speak in the court but the judge has accepted his written objections.

Overall feeling is F D Holders were overpowered.

Will SPP Pravin Chavan continue to represent us? F D Holders are worried.

Will ACP Nilesh More be removed from our case? F D Holders are worried.

In the absence of these two dynamic & dedicated officers of the law, will we get justice? F D Holders are worried.

If this unholy nexus continue to protect the accused bankers - how can we get our money back? F D Holders are worried.

True. The case has taken a wrong turn. Situation is worrisome. Feeling hopeless is an obvious reaction.

But don't forget that they can avoid the arrest but they can not give clean chit to the accused.

Because proofs are solid. And, ultimately, justice prevails.

So, do not give up.

Do not think of hurting yourself.

Cowards end their own life.

Braves keep fighting till they are alive.

True we have lost a battle. But we will win the war.

Don't lose faith in judiciary.

In spite of all pressures & pulls, Ravindra Marathe is still in the custody!

DSK F D Holders' complaint to Bombay High Court against granting of bail to Ravindra Marathe, CMD of Bank of Maharashtra, in the Pune District Court of Hon. Judge Sardesai:

DSK F D Holders complaint to Bombay High Court against granting of bail to Ravindra Marathe, CMD of Bank of Maharashtra, in the Pune District Court of Hon. Judge Sardesai:

"What is the urgency to save fraudulent people from law & order?" question DSK F D Holders in their complaint email to Bombay High Court.

"If the courts function like this in doubtful manner, going out of the way, not following the procedure, common man will lose faith in Judiciary." warn DSK F D Holders.

"In view of the foregoing, these proceedings before the Hon'ble Sardesai Court should be suspended & moved to some other place." request DSK F D Holders to Bombay High Court.

Respected Sir/s,

Subject: Objection for granting of bail to Bank Of Maharashtra's CMD Mr. Marathe in the Pune District Court of Hon. Judge Sardesai.

D S Kulkarni investment scam is to the tune of 2064 crores. In this fraudulent matter, a criminal case has been registered with Pune Police. During the investigation, Police have arrested several persons. In this matter CMD of Bank Of Maharashtra & others have been arrested.

Earlier bail application was not pressed by thr said Mr. Marathe. Fresh application was moved for bail, at 5.40 p.m.on 23rd June 2018.
Before that, Mr. Marathe was arrested by Pune Police and remanded to Police Custody.

In the said fresh bail application, surprisingly,
Police Custody was converted into Magistrate Custody and it was done only in this case as a special case.

As per our Information, no medical reports issued by any Doctor of Government Hospital for admitting Mr. Marathe in Hospital for Medical Treatment.
Thus, without obtaining any medical report, Mr. Marathe was shifted to a private hospital at 7.00 p.m.

When in the Fresh Bail application of Mr. Marathe was moved, Hon'ble Judge Sardesai passed an order for say of the Public Prosecutor and Investigation Officer on the said bail application.

Government of Maharashtra has appointed Special PP Pravin Chavan in this matter, but he was not present for this matter. Local PP was allowed to represent this matter, who according to us, was not well informed about the facts of this case.

Hon'ble Judge Sardesai asked the PP for filing immediate say in the matter.

Your Honour, travel time in each direction from the District Court to Police Commissioner's office is minimum 20/25 minutes. Preparation of documents, paper work, report etc. takes approximately one hour.

We have no knowledge whether proper say was given and objection taken or not.

After that Hon'ble Judge Sardesai has asked the Advocate representing Mr. Marathe, said that if you ask for bail, only then I will be able to grant it. Hon'ble Judge asked PP for State's NOC to grant the bail to Mr. Marathe.

Now this matter is posted for hearing on 25th June 2018 at 10.30 a.m.

According to our information, Hon'ble District Judge, Pune was also present in the chamber of Hon'ble Judge Sardesai.

All these proceedings were conducted in the chamber of Hon'ble Sardesai.

Surprisingly, the day when these proceedings were conducted, i.e. on 23rd June 2018, it happens to be 4th Saturday, which happens to be a government holiday. Even then proceedings were conducted for reasons not known to us.

We also understand that the bail application was not registered and cannot be traced online on the official website of Courts & still the hearing was conducted by the Hon'ble Judge Sardesai.

If the courts function like this in doubtful manner, going out of the way, not following the procedure, common man will lose faith in Judiciary.

When the courts open at 11.00 a.m. what is the need to keep the matter for hearing at 10.30 a.m. on 25th June 2018, is the biggest question in our minds.

What is the urgency to save fraudulent people from law & order. We feel that, in this matter lots of illegal things are happening & have happened previously.

According to our information, to grant bail to Mr. Marathe, all arrangements are in place & also the order for granting bail is awaiting signature of Hon'ble Judge Sardesai.

In view of the foregoing, these proceedings before the Hon'ble Sardesai Court should be suspended & moved to some other place.

Kindly look into this seriously.

After Special Public Prosecutor Pravin Chavan and ACP Nilesh More arrested Bank of Maharashtra Chief Executive Officer Ravindra Marathe, an executive director, Rajendra Gupta, Zonal Manager Nityanand Deshpande, and former CMD Sushil Muhnot, entire banking industry opened war against them. All national mainstream media was flooded with the news stories attacking the officers of the law.

Bankers suspect foul play in arrest of Bank of Maharashtra CEO - said The Economic Times. Quoting an anonymous chief executive of some bank, the news said - “More and more bankers come under investigative net without any proof of malfeasance. A person can be taken into custody if he is not cooperating. But when the senior official of a bank cooperated with investigative agencies, there was no need for the arrest. This shows that there is an element of foul plan which is going to affect the morale of bankers.”

The anonymous chief executive conveniently forgot that the Judge S N Sardesai of Special Sessions Court has sent the bank executives to the police custody!

Arrest of Bank of Maharashtra officials unwarranted: Indian Banks’ Association (IBA) - was the headline of The Hindu Business Line. Why was the arrest "Unwarranted"? Read this - Senior officials of the bank (Bank of Maharashtra) have been arrested for criminal conspiracy and in violation of the Maharashtra Protection of Interest of Depositors (MPID) in Financial Establishment Act, 1999. Underscoring that the Act is not applicable to banks, Kannan explained the banker is not concerned with the activity of taking and repayment of deposits by the company (DSK Developers in the case of Bank of Maharashtra). Hence, the arrest (of the MD & CEO and ED) is unwarranted.

While making this statement, the chief executive of IBA conveniently forgot under which sections of Indian Penal Code (IPC) these bank officials were booked. BOM executives were booked under these section of IPC - 120(B), 406, 409, 420, 465, 467, 468, 471, 109 r/w 34 IPC & 13(1)(c) r/w 13(2). Not under MPID.

A visit to Calyx Navyangan & Calyx Artemis

"I know how upset you all are with me. I am sorry. Please, accept my apology. Please, forgive me. Mala maaf kara," with folded hands I apologized to the redevelopment committee members of my housing society.

"Now, it is too late. You should have apologized the builder's representative then and there," one redevelopment committee member said.

"I am requesting you to forgive me because I am feeling sorry for upsetting you all," I said.

"You misbehaved at the builder's office and let us down. You were representing the society. We all are ashamed of you," the other redevelopment committee member said.

"I am so sorry. I didn't mean to disgrace you all. Please, forgive me," I said.

"Thank god! The builder didn't throw us out of his office!!," the other redevelopment committee member said.

"But that man - the representative of the builder - was just wasting our time," I said.

"It was a height of stupidity to ask whether the builder has enough money to redevelop our society. Do you know anything about the land holding of this builder? I know. Because my business is to provide funds to the builders in Pune. Hundreds of builders - big & small - are my clients," the other member said.

"Oh! Really!! I didn't know this!!!," I said.

"I too disapprove your ungentlemanly behavior. Today we were supposed to just visit the sites of Calyx. Just to see - to observe - to know the builder's body of work - the projects. That's all. But you asked questions. You asked to the wrong person. How could be you so rude to him? He was just the representative of the builder. He was not the builder," the most senior member said.

"That's the point! The builder himself should have entertained us. Not some employee," I said.

"No builder does that. Builder's assistants - builder's people at the site show the site. That's the standard practice," the other member said.

"Karandeekar knows this. He is from real estate industry. That's why I feel that what happened today at Nayangan - ungentlemanly behavior - rude questions - raising voices - getting angry - becoming hyper and all - was 'pre-planned'," the other member said.

"Pre-planned or unplanned - whatever, but, please, don't get mad at me. I am very sorry for upsetting you all - please, forgive me - Mala Maaf Kara," I begged for the last time and took their leave.

While I was climbing the stairs, my neighbour opened the door of his flat and asked me,"What happened? Why were you all so upset? Builder not good?,"

"It was not about the builder. It was about me. All committee members are angry with me," I said.

"Why?," my neighbour asked.

"Because I behaved ungentlemanly - I got very angry with the builder's representative - I raised my voice - I spoke very rudely - I almost shouted at him - that's why all got upset with me - so I was begging the committee members to forgive me for upsetting them," I said.

"Misunderstanding! They may have thought that you were trying to upset the apple cart," my neighbour said.

"Spot on! Besides this incident, for the rest of the day, I behaved like a good boy," I said and went home.

I have a lot of respect for the all flat owners in my small housing society. I am fortunate to have such good neighbours. Most of them are senior citizens. The young ones - in their forties or fifties - are highly educated & very successful. That's why I felt that it's my duty to apologize them publicly and decided to write this blog.
