In this latest Marathi YouTube video update, Mr. Vijay Kumbhar talks about the case filed by the Fixed Deposit Holders of DSK - D S Kulkarni Developers Ltd - in Bombay High Court against the decision of Shivajinagar Special Court to grant bail to Mr. Ravindra Marathe, Chief Executive Officer and Managing Director of Bank of Maharashtra.
Victims of DSK Fraud filed a criminal application listing all the 'suspicious' things happened in the bail hearing of Mr. Marathe and raised questions about it. Bombay High Court has accepted the petition and has issued notices to all the concerned parties.
At Shivajinagar Special Court when the bail application of Mr. Marathe was heard, DSK F D Holders realized that the Public Prosecutor Advocate Pravin Chavan was not present to plead their case and that the Investigating Officer ACP Nilesh More suddenly changed his stand about the custody of Marathe - so they had appointed their own lawyer to represent themselves. Though their lawyer couldn't argue - the special court accepted the F D Holders' written say.
By taking these steps - Mr. Kumbhar says - F D Holders have given a loud and clear message to the banks & the politicians that no one can take them for a ride. Banks and politicians can not meddle with the law and try to victimize the DSK F D Holders. Watch it!

DSK F D Holders, Don't get upset. Bail is a rule. Jail is an exception.
In this week, Special Judge S N Desai of MPID Court Pune granted bail not only to Ravindra Marathe, CEO & MD, but to other top officers of Bank of Maharashtra - Executive Director Rajendra Gupta, Zonal Manager Nityanand Deshpande, former CMD Sushil Muhnot.
Yes, this was disheartening.
But dear DSK F D Holders, don't get depressed.
It was just bail.
The special judge didn't pronounce the top officers of MahaBank 'Not Guilty'.
The Supreme Court of India, has recently urged all judges to show 'Humane Attitude' while dealing with an application for remanding a suspect or an accused person to police custody or judicial custody.

D S Kulkarni investment scam is to the tune of 2064 crores. In this fraudulent matter, a criminal case has been registered with Pune Police. During the investigation, Police have arrested several persons. In this matter CMD of Bank Of Maharashtra & others have been arrested.
Earlier bail application was not pressed by thr said Mr. Marathe. Fresh application was moved for bail, at 5.40 p.m.on 23rd June 2018.
Before that, Mr. Marathe was arrested by Pune Police and remanded to Police Custody.
In the said fresh bail application, surprisingly,
Police Custody was converted into Magistrate Custody and it was done only in this case as a special case.
As per our Information, no medical reports issued by any Doctor of Government Hospital for admitting Mr. Marathe in Hospital for Medical Treatment.
Thus, without obtaining any medical report, Mr. Marathe was shifted to a private hospital at 7.00 p.m.
When in the Fresh Bail application of Mr. Marathe was moved, Hon'ble Judge Sardesai passed an order for say of the Public Prosecutor and Investigation Officer on the said bail application.
Government of Maharashtra has appointed Special PP Pravin Chavan in this matter, but he was not present for this matter. Local PP was allowed to represent this matter, who according to us, was not well informed about the facts of this case.
Hon'ble Judge Sardesai asked the PP for filing immediate say in the matter.
Your Honour, travel time in each direction from the District Court to Police Commissioner's office is minimum 20/25 minutes. Preparation of documents, paper work, report etc. takes approximately one hour.
We have no knowledge whether proper say was given and objection taken or not.
After that Hon'ble Judge Sardesai has asked the Advocate representing Mr. Marathe, said that if you ask for bail, only then I will be able to grant it. Hon'ble Judge asked PP for State's NOC to grant the bail to Mr. Marathe.
Now this matter is posted for hearing on 25th June 2018 at 10.30 a.m.
According to our information, Hon'ble District Judge, Pune was also present in the chamber of Hon'ble Judge Sardesai.
All these proceedings were conducted in the chamber of Hon'ble Sardesai.
Surprisingly, the day when these proceedings were conducted, i.e. on 23rd June 2018, it happens to be 4th Saturday, which happens to be a government holiday. Even then proceedings were conducted for reasons not known to us.
We also understand that the bail application was not registered and cannot be traced online on the official website of Courts & still the hearing was conducted by the Hon'ble Judge Sardesai.
If the courts function like this in doubtful manner, going out of the way, not following the procedure, common man will lose faith in Judiciary.
When the courts open at 11.00 a.m. what is the need to keep the matter for hearing at 10.30 a.m. on 25th June 2018, is the biggest question in our minds.
What is the urgency to save fraudulent people from law & order. We feel that, in this matter lots of illegal things are happening & have happened previously.
According to our information, to grant bail to Mr. Marathe, all arrangements are in place & also the order for granting bail is awaiting signature of Hon'ble Judge Sardesai.

The anonymous chief executive conveniently forgot that the Judge S N Sardesai of Special Sessions Court has sent the bank executives to the police custody!
Arrest of Bank of Maharashtra officials unwarranted: Indian Banks’ Association (IBA) - was the headline of The Hindu Business Line. Why was the arrest "Unwarranted"? Read this - Senior officials of the bank (Bank of Maharashtra) have been arrested for criminal conspiracy and in violation of the Maharashtra Protection of Interest of Depositors (MPID) in Financial Establishment Act, 1999. Underscoring that the Act is not applicable to banks, Kannan explained the banker is not concerned with the activity of taking and repayment of deposits by the company (DSK Developers in the case of Bank of Maharashtra). Hence, the arrest (of the MD & CEO and ED) is unwarranted.
While making this statement, the chief executive of IBA conveniently forgot under which sections of Indian Penal Code (IPC) these bank officials were booked. BOM executives were booked under these section of IPC - 120(B), 406, 409, 420, 465, 467, 468, 471, 109 r/w 34 IPC & 13(1)(c) r/w 13(2). Not under MPID.

In the last 3 months, Shirish, son of DSK & Hemanti, could not spare time to meet his lawyers. That's why his lawyers could not prepare reply to the affidavit filed by Pune Police. So Bombay High Court has given time to Shirish till 5th of June.

Considering the scope and gravity of the crime, the special judge J T Utpat has decided to keep Deepak Sakharam Kulkarni & Hemanti Kulkarni locked up in his custody at Yerawada Jail.
For years the actual business of DSK & Hemanti was looting public money - the Special Public Prosecutor Advocate Pravin Chavan claimed in his argument.
The construction business - D S Kulkarni Developers Ltd. - was just an excuse to loot the flat buyers, Fixed Deposit Holders, Non Convertible Debenture Holders, Investors, Moneylenders, Banks & Financial Institutions.
Over the years, DSK & Hemanti have looted some 3,000 Crore Rupees from them. 1374 Crores from the banks, 470 Crores from the flat buyers, 110 Crores from Debenture Holders, 1153 Crores from F D Holders
By selling lands or even by constructing and selling flats on these lands only 500 - 600 crores can be generated - it means that it's not possible to recover 3,000 crores DSK & Hemanti have looted.
To loot the flat buyers, DSK's tools were - glamorous launch event of the project, full page color ads, hoardings at every corner, news stories praising the builder and the project, TV commercials on all channels, 'No EMI till Possession' payment schemes from the private banks.
Though DSK is in the jail, all DSK projects are stalled, all private banks are harassing the DSK flat buyers for the EMI, many Pune flat buyers are booking flats with the builders who are using the same tools DSK has used. This worries me a lot.

I demand an affidavit of Investigating Officer stating that he will be held responsible if DSK dies. Cried Shrikant Shivade, advocate of DSK.
Why are you so pessimistic - so negative? Don't you know that if you keep on thinking negative thoughts - your negative thoughts turn into reality? Look at us. We were thinking positively. Our positive thoughts turned into reality and we got the custody of DSK! The Special Public Prosecutor (SPP) Pravin Chavan said.
The crowd gathered in J. T. Utpat court laughed quietly.
My lord, police want DSK dead. That's why they sent him to Yerawada Jail. Police know that the jail dispensary is not equipped to treat DSK who is a severe diabetic patient. Advocate Shivade complaint.
But you demanded judicial custody for DSK. You sent him to Yerawada Jail. SPP Pravin Chavan said.
Instead of sending him to Yerawada Jail - the police should have produced DSK in the court today. Ad. Shivade said.
How can we produce him in the court? DSK was not in our custody. He was in judicial custody. Today, the panel of doctors in Sasoon Hospital gave a report that DSK is fit - since he was in judicial custody - he was sent to Yerawada Jail. SPP Chavan said.
The police kept me in the dark. They didn't give me the medical reports. Isn't this enough to prove that they want DSK dead? What will happen in case of medical emergency? They will treat him in Sasson Hospital. You know? Sassoon Hospital is a den of corruption. The doctors and facilities are substandard. Sending DSK to Sasson means planning to kill him. Ad. Shivade said.
Accused in judicial custody is treated at Sassoon Hospital only. SPP Chavan said.
Give DSK police custody. In case of medical emergency treat DSK in Dinanath Hospital. Begged Ad. Shivde.

In that case - I demand an affidavit from Investigating Officer stating that he will be held responsible if DSK dies. Cried Shrikant Shivade, advocate of DSK.
Ignoring the quietly laughing crowd - the court started dictating order about sending DSK to police custody.
The last sentence of the order was - "in case of medical emergency police should give him proper medical treatment."
Ad. Shivade was happy to send DSK to police custody but was unhappy about the medical treatment. So, again he insisted on Dinanath Hospital.
We all care for his well being. Said the court and added - "preferably at Dinanath Mangeshkar Hospital"!
So, till 1st of March, DSK is out of the frying pan and into the fire!

By the time I reached Bombay High Court, the hearing of anticipatory bail application of DSK was over.
Thank God ! Mr. Vijay Kumbhar and a group of F. D. Holders were present in the court premises.
Here is what they told me about today's hearing -
Today at Bombay High Court, DSK presented Mr. Prabhune, who claims that he has given 50 Crores to DSK.
Mr. Prabhune told the court that since its foreign currency, DSK will get the money only after the approval of RBI. For the approval some time is required.
"Yes, of course! How much time do you require? Can we meet on 5th of February?," asked the judge.
"5th is good!," said the advocate of DSK.
'Are you happy?,' I asked F. D. Holders of DSK.
"Do we look happy?," asked one F. D. Holder.
"No! Why are you angry? The judge can give more time!," I asked.
"But Supreme Court has clearly said that DSK must deposit 50 Crores before 19th of January. He will not get more time than that. My 1st question is - Why did this judge go against Supreme Court's order and give more time to DSK?"
"My 2nd question - 50 Crores are not deposited in DSK's bank account in Pune. If DSK has the money with him and then the judge had given time for obtaining RBI's permission I would not mind giving more time. Why did the judge give more time to obtain RBI's permission when the money is not there?"
"My 3rd question - The judge said that DSK's case is not a scam like Sahara. How can the judge pass this kind of a remark? Isn't it jumping to conclusion? How can the judge give a judgment before the case is filed in the court?"
"My 4th question is - How can a judge pass the order and tell the banks to sell DSK's properties? The hearing was about anticipatory bail application. Not the final verdict of the case!"
In short I felt that the judge was out of his mind. The judge was dancing on someone eles's tune.
After the recent issue of the Supreme Court judges, this judge should have have been more judicious.
These are the sentiments of the victims of DSK. Please, take them with a pinch of salt. I am sharing this to update you about DSK scam. Not to critisize the court.

To avoid arrest on 22nd January DSK informed Bombay High Court that - My Lord, the cheque is in the post - the famous lie used in the business world.
The court ordered police to verify but once again gave time to DSK.
"Can you deposit 50 Crores on 25th January?," the court asked the advocate of DSK.
After consulting with the assistants of DSK the advocate said,"Yes, My Lord!"
However, my sources have told me that till 24th evening the 50 Cr haven't reached from Singapore to Pune.
In his blog, Vijay Kumbhar has raised questions about the Singapore based company which has sent the money and the authenticity of the documents DSK has submitted to the court.
But, you all know that both of us are biased.
Who knows? DSK might have received the money.
E.D. and Income-tax Department mighy not have taken any objection this money.
And today at 11 am DSK might deposit 50 Crores and get an anticipatory bail.
But if Vijay Kumbhar is right and DSK doesn't have money to deposit what excuse will he give to the court? I am wondering, on my way to Bombay High Court.
As far as I know DSK, his excuse would be - "My Lord, my cat ate my chequeboook. Please, give me some time to get a new cheque book"
Considering that 26th, 27th, & 28th are holidays, I may have to go to Bombay High Court in the next week.

The Public Prosecutor is trying his best to give an opportunity to Pune Police to arrest DSK, Hemanti, Shirish & Tanvi in Aanandghan case:
Will Pune Police be able to arrest DSK, Hemanti, Shirish & Tanvi in Aanandghan case?
The Public Prosecutor, Advocate Javed Khan, was insisting that, as per Section 438, DSK, Hemanti and their son & daughter in law - Shirish & Tanvi - and others who have applied for anticipatory bail must be present in the court when the judge gives final order.
But the advocate of DSK argued that there presence is not mandatory. The court can decide whether DSK's presence is really in the interest of justice.
The Public Prosecutor was insisting DSK's presence in the court mainly because, if the anticipatory bail is rejected - Pune Police can arrest DSK, Hemanti, Shirish & Tanvi immediately in the court itself. Which hasn't been possible in the case of F D Holders.
However, it was almost 5.15. Court hours were almost over. So the court said that we will take this matter tomorrow.
What will happen today?
Will the court give order in the absence of DSK or in his presence?
What will be the order? Will DSK get bail?
If the court rejects the anticipatory bail application - Will Pune Police arrest DSK, Hemanti, Shirish and Tanvi?
Or will DSK manage to avoid arrest and go to high court - and even to supreme court - to get bail - like he did in the F D Holders' case?
I could see all these questions on the faces of the flat buyers of DSK Aanandgahn at DSK Vishwa who were present in the court yesterday.
After cheating 400 plus flat buyers and looting thousands of crores, DSK has so many options.
Why? Because DSK has money for lawyers.
Whose money is it?
It's Flat Buyers' and F D Holders' money.
To avoid going to jail - to get anticipatory bail - some claim that - DSK has already spent a couple of crores of rupees.
Couple of crores of Flat Buyers' and F D Holders' money to fight the court cases against the Flat Buyers and F D Holders themselves!
Moral of the story is - Anyone who wants to book a flat in an under construction housing project should keep in mind that you are creating a monster who is going to eat you alive.

The other day, I spent a lot of time talking to people who had just visited the head office of D. S. Kulkarni Developers Ltd. on J. M. Road, Shivajinagar, Pune 411 005.
All of them were Fixed Deposit Holders who haven't registered complaint with Economic Offences Wing of Pune Police. Mainly because they were "Supporters of DSK" who are sure that DSK will come out of the trouble and will return their deposits along with outstanding interest.
Some of these "DSK Supporters" haven't filed complaint because their F D would mature in 1st or 2nd quarter of 2018 and they are hopeful that by that time DSK would be out of trouble and pay them.
"If you are so sure that DSK will give your money back, why did you visit DSK's office?," I asked.
"Just to make sure that we are right," the DSK Supporter F D Holder said.
"What did you ask?," I asked.
"Are you paying F D Holders?," the DSK Supporter F D Holder said.
"What was the answer?," I asked.
"Currently our bank accounts are frozen so we can't issue or honor cheques - I was told," the DSK Supporter F D Holder said.
"Did the answer satisfy your curiosity?," I asked.
"Yes! I am satisfied. It means that when police will let DSK operate his bank accounts - DSK will pay us," the DSK Supporter F D Holder said.
"Are you sure?," I asked.
"Yes, I am sure," the DSK Supporter F D Holder said.
"If you are so sure - why did you visit DSK's office?," I asked again.
"Just to make sure....I told you," the DSK Supporter F D Holder said.
After having this type of conversation with many DSK Supporter F D Holders, I realized that they were confused.
They wanted to support DSK, but they didn't know how!
So, I thought that I should share a few tips with them.
You know why?
Because, though I am on the side of those F D Holders who have gone to MPID Court against DSK, I care for F D Holders who are DSK Supporters.
All of them are good human beings.
They all are too innocent to understand MPID Act.
They all are too emotional to accept the reality.
That's why I believe that it's my duty to give them practical tips about how to support DSK.
1) DSK will be jailed:
Every DSK Supporter needs to accept the reality.
DSK has committed the crime.
DSK collected deposits in the name of companies which didn't have permission.
DSK didn't pay interest on these FDs on the committed dates.
DSK didn't refund the deposits on the date of maturity.
DSK refused to return money when people wanted to withdraw their deposits before maturity.
So, as per MPID Act, crime has been committed. Criminals are identified. FIR is filed.
And eventually these criminals - DSK, Hemanti and all - will be jailed.
So, DSK F D Holder Supporters, please, accept that - Now, DSK is not what he was.
Yes, DSK hasn't jailed yet but DSK is no more a builder - no more a businessman. DSK is a criminal. And you are supporting a criminal.
When you will accept that DSK is a criminal who will be jailed, you will free yourself.
You will stop visiting DSK's office.
You will stop expecting that DSK will return your deposits.
You will start supporting DSK wholeheartedly.
You will start supporting DSK without any expectations.
Result is - You will become stressless and, once again, you will start living enjoyable, pleasant, relaxed life.
2) Bail or No Bail - DSK is no more a free man:
Some DSK F D Holder Supporters and some flat buyers in DSK projects like Aanandghan and all believe that Supreme Court / Bombay High Court will give bail to DSK and after that everything will become normal. DSK will start running his business. DSK will start operating his bank accounts. DSK will start paying interest. DSK will restart construction of the stalled projects.
Means, after DSK gets the bail, DSK Supporters believe that - they will get back their money and flats.
This is not true.
Even if DSK gets the bail, he will not be able to run his business.
DSK's bank accounts are going to remain freezed.
DSK's properties will remain in the possession of the government.
Nothing will change after the bail hearing.
Except one thing.
The place where DSK will sleep at night.
If DSK gets the bail - instead of sleeping in police / magistrate custody - DSK will sleep in his bungalow.
That's all!
So, DSK Supporters, stop daydreaming. Tell DSK -
"DSK, please, take rest. Take care of your health. Close the office. Spend time at home. Enjoy the company of your dear ones."
"DSK we care for you. We understand you. We don't expect anything from you. No flat. No F D. Nothing. All we want is - DSK, you should be physically & mentally fit to serve the jail sentence"

Your love, respect and sacrifice will energize DSK.
DSK will stop crying and start laughing.
DSK will be ready not only for the police interrogation but for the jail sentence too.
And you will stop blaming yourself for keeping fixed deposits with DSK and booking flat in DSK housing scheme. What a relief!
3) DSK was not a man. DSK was just a mascot:
Most of the DSK Supporters are senior citizens. Nearly of the same age of DSK. Even elder than DSK.
They find it difficult to think of sending 67 year old DSK to jail.
"It's inhuman - cruel - to send someone so old to jail - and that too only for a few lakh rupees - not acceptable," one DSK Supporter told me.
"But DSK duped you!," I said.
"So what? We trusted DSK for so many years. We kept deposits on our own. DSK didn't force us. When for so many years - DSK was giving us interest - higher than any bank - we respected him. Partly we are also responsible for this situation. It would not be fair only to blame him and send to jail!," the DSK Supporter said.
"But you are not sending DSK to jail! You are sending Deepak Sakharam Kulkarni to jail!," I said and gave him this explanation:
With the help of Late Sharad Deshpande of Setu Advertising, Deepak Sakharam Kulkarni created a mascot for DSKDL. Mascot means a person, an animal or an object that represents an organization.
In those days, Late Mr. Shantanurao Laxmanrao Kirloskar, though he was an industrialist, he was very much respected in all sections of society. Not only in Pune but in entire Maharashtra. He was popularly known as SLK.
To take advantage of popular trend of knowing people by their initials - Kulkarni & Deshpande named their mascot as DSK.
Then they created an aura around their mascot called DSK.
They described their mascot DSK as an honest builder, trustworthy person, kind hearted human being, god fearing gentleman, dynamic businessman, follower of Savarkar, a rag to riches legend.
Instead of using some other person or an animal or an object - they used Deepak Sakharam Kulkarni as the mascot of D. S. Kulkarni Developers Ltd.!
That's why people believed that DSK and Deepak Sakharam Kulkarni are one and the same.
They never realized that DSK is just a mask of Deepak Sakharam Kulkarni.
Deepak Sakharam Kulkarni has no qualities which are associated with the mascot DSK.
In the last 2 years, only F D Holders who have filed complaints against DSK have realized the difference between the two.
Even after Mr. Vijay Kumbhar exposed the criminal acts of DSK, Hemanti and co, not only the DSK Supporters but most of the Maharashtrians still believes that DSK is Deepak Sakharam Kulkarni. That's why they find it difficult to believe that their lucky mascot is actually an evil mascot!
So, dear DSK Supporters, now is the time to accept that DSK was just an imagination. Not a real person.
DSK was just an imaginary unreal character. Created to influence you. Mislead you. Cheat you.
There is nothing wrong to send that imaginary unreal character DSK to jail.
It's not you but Deepak Sakharam Kulkarni is responsible for sending DSK to jail.
Of course, if you don't want to send him to jail, I have no problems.
But, at least, accept that DSK and Deepak Sakharam Kulkarni are two different things.
Stop expecting Deepak Sakharam Kulkarni to behave like your beloved imaginary unreal character DSK.
Accept that the one - to whom you gave your money to - doesn't exists anymore.
DSK is finished. Only Deepak Sakharam Kulkarni is left.
Not bothering Deepak Sakharam Kulkarni is the best way to support him.
So, please, just forget about your money. Your fixed deposits. Your flats.
Let Deepak Sakharam Kulkarni enjoy the rest of his life.
4) Deepak Sakharam Kulkarni has no powers. He is just a puppet:
Dear DSK Supporters, you know who has all the powers. Hemanti! Right?
Hemanti has power of attorney of all companies of DSK Group.
All money has gone to the companies owned by Hemanti, her son Shirish and her sisters and their husbands.
In your encounters with her - you have experienced that Hemanti has all powers and Deepak Sakharam Kulkarni has none.
He is just a puppet. A talking puppet of Hemanti.
Even though you know this truth, sometimes you believe in what Deepak talks.
Don't do that.
If you stop taking D. S. Kulkarni seriously you will find him more entertaining.
He is much better actor than any TV star.
So, if you really care for him, please, see that the jailer gives Deepak Sakharam Kulkarni a microphone and lets him give a 30 minutes speech to all inmates every morning and evening.
Why? Because a talking puppet needs to keep on talking.
And Deepak Sakharam Kulkarni has a lot to teach to all jailmates - in all jails - in all countries - of the entire world.
5) True DSK supporter never tells the truth:
For a long time, DSK Dream City was considered as reason for the financial problems DSK is facing.
Then DSK blamed his car accident, his viral video, slowdown in Pune real estate market, demonetization, RERA, GST for the 'cash crunch' he was facing.
Then, one day, DSK blamed 2 Mahamurkh Bhampak Bloggers for his downfall.
In the next few days - he not only blamed Mr. Vijay Kumbhar - but accused Kedar Vanjape, son in law of his elder brother, for plotting a conspiracy to destroy DSK business empire.
Surprised to hear that a family member is trying to destroy DSK, I interviewed DSK's elder brother's son in law and DSK's son in law - who are ex-employees of DSK.
You know what they said?
Both of them blamed - "No land appreciation in the last couple of years".
Both of them avoided taking name of DSK.
Both of them didn't criticised or blamed DSK.
Off the camera, Sanjay Deshpande told me many things about DSK.
But nothing on the camera!
Though DSK has tarnished image of Kedar Vanjape - he only said that "I am the black box of DSK. Don't force me to open it"
- Means Kedar knows many secrets of DSK but he doesn't want to reveal them.
Not only that!
Kedar Vanjape announced that he is going to file a 100 crore defamation case against DSK.
Yes! 100 crores defamation case against DSK who failed to deposit 50 crores to obtain a bail!!
Why?
Because, a true DSK supporter never tells the truth.
Only people like Vijay Kumbhar keep on researching & revealing truth.
So point is - when you will tell the story about - "how you lost all your life savings" - to your great grandsons & great granddaughters - feel free to imagine - invent some convincing but false reason - decorate it with some personal heart touching incident - like Kedar & Sanjay did in their interviews - and avoid telling the truth about DSK. What can a flat buyer learn from the downfall of DSK?:
Ravi Karandeekar with DSK, December 23, 2013 - Launch of DSK Aanandghan at DSK Vishwa, 1 BHK & 2 BHK Flats - Dhayari, off Sinhagad Road, Pune
Accused Number 1:
DSK - D S Kulkarni - used to give 5 reasons which put his business in danger -
1) His car accident on Pune Mumbai Highway,
2) Slowdown in Pune real estate market,
3) Demonetization,
4) RERA - Real Estate (Regulation and Development) Act 2016,
5) GST - Goods and Services Tax Act 2017
Fixed Deposit Holders got panicked after his life threatening car accident and started withdrawing their deposits.
To pay the F D Holders, DSK diverted funds from other business and killed those business - like DSK Toyota Dealership.
Because of the ongoing slowdown and upcoming RERA & GST, people became less interested in booking flats at the launch or in an under construction project and started preferring to buy ready possession flats - which stopped inflow of working capital.
People started cancelling bookings, stopped paying payment installments after the demonetization which broke the back of his business.
"These circumstances are responsible for the difficulties I am facing. But don't worry. It's a temporary phase. I am not bankrupt. I am just facing cash crunch. My assets are 10 times more than my debt. I will not go down. Give me some time. I will come out of this," DSK used to appeal.
Accused Number 2:
DSK is in financial trouble only because of DSK Dream City.
Impractical concept - River, Tram and all.
Exorbitant property prices - Who will pay 80 - 90 Lakhs for a 1 BHK - This is Pune - Not NYC or London!
Poor location - Manjri on Pune Solapur Highway.
Purchasing & developing 300 acre land of DSK Dream City has left no money in his pocket and there in no cash inflow because there are no bookings.
Many believed that DSK Dream City is the reason for the problems DSK is facing.
Accused Number 3:
One Sunday morning, some F D Holders and Flat Buyers attended RTI Katta at Chittaranjan Vatika in Model Colony.
They shared their problems with Mr. Vijay Kumbhar.
- Not receiving interest.
- Not getting back matured fixed deposits.
- Stalled housing projects.
- DSK not paying Pre-EMIs to the banks as per "Aadhi Ghar Paise Nantar" "DSK Master Plan" offers.
- CIBIL ratings are down.
- Harassment from the banks. Etc.
Vijay Kumbhar starts investigating DSK and unearths financial irregularities and fraudulent intent of DSK.
Calls DSK & Hemanti - wife of DSK - Bunty aur Babli!
In his blogs - Vijay Kumbhar published authentic documents which prove that -
1) For years DSK was cheating F D Holders by collecting Fixed Deposits in the name of the companies which are not allowed to take it.
2) For years DSK was looting his own Public Limited Company - DSKDL - and was siphoning money to proprietary or partnership companies of Hemanti - wife of DSK and her sisters.
Vijay Kumbhar claimed that some documents prove DSK's daughter and niece were also involved.
Vijay Kumbhar not only exposed criminal activities but he insisted that DSK must be prosecuted under MPID Act - Maharashtra Protection Of Interest Of Depositors Act.
"It means that - DSK was not in financial difficulties - not facing 'cash crunch' - as DSK claims - DSK has swindled public money." - Vijay Kumbhar announced.
More than 3,000 F D Holders & Economic Offences Wing (EOW) of Pune Police accepted Vijay Kumbhar's argument and registered FIR against DSK and Hemanti - Bunty aur Babli.
Accused Number 4:
While arguing on anticipatory bail application in MPID Court in Pune, Shrikant Shivade, DSK's lawyer accused a political leader for the troubles DSK is facing.
To grab the land bank of DSK at a throw away price - DSK Dream City and other land parcels - this politician is using MPID Act.
There is enough proof to prove that DSK can not be prosecuted under MPID Act - that's why he should get the bail. Advocate Shivade told the court.
Surprised to hear this, after the hearing, I met defence lawyer of DSK and requested him to reveal the name of that politician.
Advocate Shivade refused to tell me the name of that politician but told me that I can write what he has claimed in the court - some politician is behind all this!
"Sir, I am not a lawyer. I am Ravi Karandeekar, Pune real estate blogger and investment adviser. I can't write without a proof. That's why, please, give me a video interview," I said.
But the advocate refused.
Accused Number 5:
"Two stupid & foolish bloggers - Maha Murkh aani Bhampak Bloggers - are trying to harm me by spreading rumors against me," without mentioning the names, DSK accuses the two bloggers in this video -
Accused Number 6:
After meeting the supporters of DSK, Mr. Raj Thackeray of Maharashtra Navnirman Sena, announced that - "Non Maharashtrian builder lobby is trying to destroy Marathi Builder DSK and take over not only his business empire but the entire Pune real estate market"
Accused Number 7:
DSK is a good and an honest Marathi businessman. As Maharashtrians we must help him overcome the current difficulties. Raj Thackeray appealed.
To find out - 'Is DSK good to save' - I talked to Mr. Sanjay Deshpande, son in law of DSK. Before starting his own construction company, Sanjeevani Developers, Sanjay was MD of DSKDL. That's why he knows DSK as a person as well as a businessman. And most important - Sanjay's business style is exactly opposite of DSK. Means Sanjay must have learned - 'how not to run a business' - from DSK. I thought.
In the video interview, Sanjay avoided to criticize DSK directly. Without taking his name, Sanjay said - "Those builders who didn't realize that "The Rules of the Game" have changed are facing serious financial problems."
"Who has changed the rules?," I asked.
"Government!," Sanjay said.
"What? Are you accusing Maharashtra Government for destroying DSK?," I said.
Accused Number 8:
To understand their views, I interviewed a few 'Supporters of DSK'. You know? These DSK Supporters accused the F D Holders for destroying DSK!
When DSK himself was confessing that he is in financial difficulties and requesting all to give him some time to arrange funds - many F D Holders were emotionally blackmailing DSK to pay them.
"Emotionally blackmailing! How?," I asked.
"By telling lies! By exaggerating their problems!!," the DSK supporter said.
"How?," I asked.
"When I was at DSK's office, I saw a girl continuously crying loudly - 'I have lost my father. Give me money to perform his last rights' - You know what? The next day her father himself came to DSK's office to collect the money!," the DSK supporter said.
"I saw a lady - who was wearing gold ornaments of more than 30 tolas - requesting DSK to pay back her money for her husband's medical treatment! There are hundreds of examples like this - which prove that these greedy - impatient - unfaithful - short sighted - liars - backstabbed DSK and filed FIR against him - now, who knows - DSK may go to jail - and that may be his end," the supporters said.
Accused Number 9:
"The case of DSK is nothing but a prime time tv soap opera!," one of my readers, Ms. Agarwal, not her real name, said.
"But Mr. Kumbhar says it's MPID case," I said.
"Mr. Kumbhar is RTI activist. His investigation may be right. But his conclusion is not. Accusing DSK is a big mistake. DSK is innocent. In fact, he is the victim!," Ms. Agarwal said.
"Really! How?," I asked.
"Where did the money go? Who had 'power of attorney' for the both sides? If you study the evidence shared by Vijay Kumbhar - you will realize that - all money went to only one person - Ms. Hemanti Deepak Kulkarni! Right?," Ms. Agarwal said.
"Yes! You are right!!," I said.
"Ms. Hemanti systematically siphoned all money to her and her sisters accounts - firms. She took away all moneys and powers of DSK. She gave away those funds to her son to spend on his dreams. Not only that! She forced DSK to step down and gave control of DSKDL to her son. Now, DSK is moneyless, old, powerless and accused. Right?," Ms. Agarwal said.
"Yes! You are right!!," I said.
"Whereas, she and her son have everything any woman can dream about. This is a story of a revenge and power. She must have planned it long ago - first she removed DSK's family & trusted lieutenants - Mr. Vinay Phadnis - son in laws of DSK Mr. Deshpande & Mr. Vanjape - from the company - then she gave powers and important roles to her sisters and hijacked the company. Blind in her love, DSK never realized that he has lost everything to his wife. He has become nonentity. Innocent DSK didn't realize that - through both of you - his wife is offering him as a scapegoat to law," Ms. Agarwal said.
"OMG! You mean to say that Ms. Hemanti destroyed DSK?," I almost shouted.
"To understand this you need to have a heart of a woman!," Ms. Agarwal said.
"And a lot of free time to watch prime time tv soaps," I said.
Accused Number 10:
Nearly 3 months after filing complaint against DSK, Pune police didn't register FIR. Someone is preventing police from taking action against DSK - F D Holders believed and stopped wondering - how come every time they go to police DSK is always present there!
However, when Pune Police registered FIR, they suddenly became very efficient. Within no time, Pune Police not only took actions like searching offices and residences of DSK, freezing DSK's bank accounts, confiscating computer server, ordering sub registrar not to register any document of DSK etc - but they gave exclusive interviews to every TV channel & every newspaper. The huge media coverage poured oil in the fire and thousands of F D Holders from all over India started filing complaints against DSK.
Not only that!
The Public Prosecutor of Pune Police single handedly defeated advocate of DSK and convinced the judge to reject anticipatory bail application of DSK.
No one expected so much efficiency and so many efforts from Pune Police.
If Pune Police had followed Kolhapur Police and Mumbai Police - DSK would not have to run for his life. DSK supporters feel.
Accused Number 11:
It was just a hearing of anticipatory bail in Bombay High Court. Pune Police hasn't yet filed a case under MPID.
Still Justice AS Gadkari looked over enthusiastic about protecting the interest of the fixed deposit holders of DSK.
He granted anticipatory bail only when DSK offered to deposit 50 Crores in 15 days and handover a land worth of 200 Crores to the court.
Advocates of DSK tried to convince the court that if DSK had so much money and so much encumbrance free land - no F D Holder would have any complaint against him!
But Bombay High Court didn't listen to DSK.
And DSK had no option but to behave like a criminal and run away to Delhi.
Some even started talking that via Delhi, DSK has gone to Nepal from where he may go to Pakistan or Dubai.
Adamant court has forced the firebrand devotee of Swatantryaveer Savarkar to behave like anti national criminal - DSK supporters went on crying till they found out that DSK has obtained protection from the supreme court.
True. DSK has obtained protection. But he has lost his face.
Accused Number 12:
When it was almost clear that DSK is not going to remain free for long, a son in law of DSK's brother and ex-executive director of DSKDL, Mr. Kedar Vanjape gave me an interview. The next day, he also announced that he is filing 100 crore defamation case against DSK.
You know why?
Because in the press conference DSK has accused him.
"Kedar Vanjape is behind all this! He is trying to destroy me!! He gave all documents to Vijay Kumbhar!!!," DSK had told the reporters.
"Did you destroy DSK?," I asked Kedar.
"If you want to know - come to my office," Kedar said.
In his video interview, Kedar told me that - "Not Kedar Vanjape but the debt destroyed DSK! DSK went on borrowing to pay the old lenders. When there was no one left to borrow - he couldn't pay the lenders - the F D Holders, the NCD Holders, the banks."
"You mean to say that DSK himself destroyed DSK?," I asked.
Kedar Vanjape didn't say anything.
Accused Number 13:
"What's going on?," Vijay Kumbhar called me today morning.
"I am trying to find out who destroyed DSK - in fact, at this point of time, I am writing a blog on this topic - I have prepared a list of accused - but not sure who it is," I told him.
"Tell me your list of accused," Vijay Kumbhar said.
"You have missed one name!," Vijay Kumbhar said.
"Really? Tell me," I said.
"Ravi Karandeekar!," Vijay Kumbhar said.
Till then, I didn't know that Mr. Vijay Kumbhar has such a great sense of humor!
What can flat buyers learn from the destruction of DSK?
In short quantities, every flat buyer has all the symptoms which destroyed DSK.
When we buy a property - like DSK - we ignore that circumstance can change - we may lose the job.
We don't pay attention to the fact that property has stopped appreciating and borrow to invest in a second property.
Like DSK - we all believe in "Jugad" - and try to buy a home by borrowing money from our parents, relatives & friends - and put our important relationships in danger - and when something goes wrong we blame the builder or the government.
We also don't pay much attention to the facts - sanctions and approvals - and make our decisions based on the brand image of the builder.
We don't feel ashamed to borrow 85 - 90 - 100 percent of the agreement value from the banks and commit to pay 50 - 60 percent of our monthly salary as an EMI - just like DSK.
Some of us even take a personal loan or 'top up loan' to book or furnish a flat.
DSK wanted to prove that he is a big business man - exactly like, we want to prove to our parents, in laws and colleagues that we are doing well!
Every young man feels that he can not get a wife if he doesn't own a flat - means he becomes slave of his wife even before he becomes her husband.
So, moral of the story is, before buying a property be sure that you will not become the next DSK.
