"I am humbled by the generosity of the Pune flat buyers," with tears in his eyes, one salesperson said.

"Look around.....all are genuine buyers.......no crowd of casual visitors.....in 3 days I got some 200 serious enquiries.... just imagine what will happen even if 2 - 3 per cent of these guys booked flats in the next 3 - 4 months......this is overwhelming...." wiping his eyes the salesperson said.

"3 - 4 months! Why?," I asked.

"Now a days flat buyers take that much time to study and compare all options.....they not only visit sites 2 - 3 times to negotiate the price and check the progress of the construction - they do online research too - and book only when they are sure," the salesperson said.

"But some have booked in this exhibition itself!," I said.

"Those are exceptions....," the salesperson said.

"If the booking is going to happen after the usual 3 - 4 months followup - why are you so happy about the exhibition?," I asked.

"Because....though in the last 2 - 3 months number of enquiries & site visits have substantially increased - I don't get 200 enquirers in a month!," the salesperson said.

"Why are site visits increased?," I asked.

"Mainly because of MahaRERA.....buyers have started feeling safe," the salesperson said.

"Are they really safe?," I asked.

"Sentiments matter! Of course, GST is still a big threat....that's why most buyers prefer to go for ready possession flat...no GST on ready possession....straight away you save 12% ," the salesperson said.

"But everyone is passing input credit - no GST impact offer!," I said.

"General perception is - builder recovers that amount by increasing property price - so no GST impact offer doesn't work....buyers have become very smart," the salesperson said.

"Good to know that there is only one hurdle GST!," I said.

"DSK is a bigger hurdle than GST!," the salesperson said.

"But DSK is no more in the running!," I said.

"That's a blow to the entire industry! Old and big builder has become a risk. Flat buyers prefer new & lean builder. Look around. You will find that old established builders' stalls have less visitors.....multiple ongoing projects is no more a qualification!," the salesperson said.

"Then what is the qualification?," I asked.

"Ready possession...or at least early possession," the salesperson said.

"What about the property price?," I asked.

"Banks are there to care of the price!," the salesperson said.

"How?," I asked.

"See....major problem is no one has money to buy a property....so more than the property rates...home loan offer plays important role in flat booking," the salesperson said.

"You mean to say that - only those who have their own money can dare to negotiate rates?," I asked.

"Yes! Beggars can't bargain! You know how much money people have in their accounts? Most have only 5 - 6 per cent of the property cost! No one has 20 per cent own contribution - still, they can book a flat because these banks are offering 95 - 100 per cent loan - subversion schemes - differed payment options!," the salesperson said.

"You mean to say that all these people in this exhibition have empty bank accounts?," I asked.

"Yes! They know that if the banks refuse to lend them 95 - 100 per cent of the agreement value - the banks will go out of the business! Today's buyers are very smart!," the salesperson said.

"It means that this is the gathering of empty pockets!," I said.

"Yes! Our pockets are empty but our hearts are full of positive sentiments!," the salesperson said.

"Yes! I feel positive vibes all around!," I said.

What are the reasons for the downfall of D S Kulkarni Developers - one of the oldest & biggest builders in Pune? I wanted to know.

DSK is not an exception. There are many more old & big builders in Pune who are on the verge of going down. People told me.



Yes, everyone knows that most of the builders in Pune are facing financial difficulties.

All of them, including DSK, are blaming government & economy for their problems - RERA, Demonetization, GST, No new job creation, increasing job insecurity, home loan interest rates, etc.

Agreed! These can be the causes of the slowdown in Pune real estate market.

But these cannot be the reasons for the downfall of so many old & big builders in Pune. I am sure.



So, I asked Mr. Sanjay Deshpande of Sanjeevani Developers -

Why are so many old, established, big builders in Pune in financial difficulties? Why are they debt-ridden and on the verge of bankruptcy?

You know? Flat buyers are scared to book because of this.


You know what Sanjay said?

Yes! This is a scary situation!!

But this is not only about the old & big builders.

It's about any builder.

Big or small.

A builder who has failed to understand that the 'the rules of the game' have changed - is in financial difficulties.

In the old days - Land Appreciation - was the rule of the game.

Appreciation of land was the reason for the property price rise & huge profits for the builders.

That's why every builder was batting on land appreciation.

Borrowing money at exorbitant interest rates.

Diverting flat buyers' money from the on going projects.

Investing in other lucrative business.

Assuming that they were good businessmen.

But fact is that - they were not.

They were gamblers.

They were earning huge moneys because the land was appreciating like anything.

Why was land appreciating?

Because supply of land was short.

But in the last 10 years - every government went on changing development rules to increase the supply of land.

Because of the increased supply - land stopped appreciating - result is - property rates remained stagnant - builders profit margins shrunk substantially.

Not only that!

Number of players increased too.

So the monopoly of the few big builders ended. Now, there was competition.

There were more options for the flat buyers.

More options about the locations. More options about the projects.

Obviously, flat buyers stopped booking at the pre-launch or at the lunch of the project.

Means interest free fund supply from flat buyers to construct the project started drying.

Builders had to borrow construction finance from the banks at heavy interest rates.

Most of the builders were running their business on the borrowed money and paying nearly 40% interest to the lenders.

What was the profit margin?

The profit margin was less than the interest builders were paying.

Obviously, for these builders there was no option but to go down.

Some have gone down. Others' days are numbered.

Result is builders' Raj is over.

Those builders who have financial discipline, right property, right price, good service, and are ready to do business on less profit margin are going to survive in Pune real estate market.

Because of the abundant supply, now, property rates are stable.

So, there is no need to rush to book a flat.

Book only when you are financially ready.

Now, there is no need to book at the launch.

Because property rates at the launch and at the almost ready for possession stage would be almost the same.

In fact, because there is no GST on ready possession flat - price of the ready possession flats would be less than the under construction flat.

Since no builder is in dominating or dictating position, he can't say no if the flat buyer's demand is reasonable.

For example, if you want to book a flat in Dhruva, my project at Punawale, and you ask me, "How many flats are booked?"

"3 flats out of 50 are booked. And I am casting the last slab. Means RCC would be ready soon," I will tell you.

At this point you have to ask me - "Only 3 booking? If you don't get more bookings - how are you going to complete the project?"

"I have taken construction finance from the bank so even if I didn't get a single booking I can complete the project and sell ready to move in flats," I will tell you and show my financials.

"But what if you couldn't sell at ready possession stage?," you will ask.

"Bank will acquire the project and sell those unsold flats to recover it's money!," I will tell you.

"What about my flat?," you will ask.

"You flat will be yours because bank has given NOC to you, So you don't have to worry!," I will tell you.

Point is before booking a flat find out whether the builder has enough funds to complete the project.

If the builder refuses to share information - don't book a flat. Simple!

2018 is the buyers' market.

Don't gamble. Take an informed decision.

Keep in mind - "The Rules of the Game" have changed.

Not only for the builders but for the flat buyers too!

CREDAI Pune Metro is the final authority.
Recently, we have realized this in the case of
Pradhan Mantri Awas Yojana - Maharashtra Housing Day
- 1 BHK Flat for Rs. 5 Lakh offer by Maple Group.
CREDAI Pune Metro certified that it was not a scam but a genuine offer.


When the president of CREDAI Pune Metro, Mr. Kataria announces that
the property prices in Pune real estate market will not go down
the flat buyers have to accept that as an ultimate truth.
Because in Pune real estate market the flat buyers do not matter.
In Pune real estate market only builders matter.

Removal of black money will reduce the property prices in Pune
and we will be able to own a home
was the hope of frustrated & frightened flat buyers in Pune.

Fact of the matter is - because of the demonetisation

Smart City Mission,
Swacch Bharat Mission,
Housing-for-All,
infrastructure development programs like ring road, Metro & Local Train etc,
and the effects of these initiatives like -
urbanisation,
migration,
job creation,
low home loan interest rates,
foreign direct investment etc.
are going to boost the demand of housing.
And the high demand will increase the property rates in Pune.

What is the intention of Mr. Kataria behind revealing the truth of impending property rate rise in Pune real estate market?

The reason is certainly not to insult the aspiring flat buyers in Pune.

The reason may not be to clear the myth that Modi Government is pro young citizens of India.

The reason may not be to claim that like previous governments, Modi Government is also the builders' government.

My guess is - Mr. Kataria wants aspiring flat buyers in Pune to enjoy a good life.

His hidden message is -

Stop hallucinating of being able to own a home.

Give up hope of owning a home.

Stop saving for down payment.

Start splurging. Shop till you drop.

Instead of visiting builders websites - keep on browsing Amazon and other online stores apps on your mobile.

Instead of visiting property exhibitions - visit shopping malls & multiplexes.

Instead of visiting builders' site offices - have a great time in pubs, restaurants & resorts.

In short, the president of CREDAI Pune Metro says, don't bother us.

How noble are Mr. Kataria's intentions!

He has told us something which our parents never told us.

Parents are insisting to buy a flat and settle down - which is practically impractical in this age.

Mr. Kataria has told us which everyone of us wanted to tell his or her spouse but never dared to say so bluntly.

Don't assume that only death can do us part. Lifestyle, job, colleagues, drinks & drugs, sex are more powerful than the death.

Life is not secure anymore.

We all are floating.

There is no job security.

Possibility of becoming unemployable is certainty.

Artificial intelligence is ready to take over our jobs.

Raising a child has become unaffordable.

Education is very expensive.

Medical treatment is exorbitant.

Jobs are making us mentally & physically unhealthy & unfit.

There is no pension. No social security.

No one knows how to survive the old age.

In this situation what is the point in saving for down payment and keeping on paying 50 - 60 per cent of monthly income as EMI for the next 20 - 30 years?

Enjoying every day as the last day of your life - make sense.

Instead of becoming a homeowner - becoming a consumer is more fun.

Instead of paying EMI - paying rent is cool.

Giving up hope of buying a flat makes sense.

Thanks Mr. Kataria, president of CREDAI Pune Metro, we will not wait & watch for property rates in Pune to go down - we will never aspire to book flat - we will never bother the builders in Pune.

4) They have not become the true owners of their homes because their builder has not formed a co-operative housing society & hasn't done conveyance.

5) They are feeling that their builder has looted their maintenance fund - misappropriation of maintenance charges collected from the flat buyers at the time of possession.

6) They are complaining about quality of construction - mainly leakage & seepage in ceiling & walls, poor quality & poor fitting of floor tiles, internal walls without plaster.

7) They are suffering because of the poor planning & allocation of car park.

8) They are disappointed because of the incomplete, insufficient & less than promised amenities.

1) Avoid booking a flat in the fringe villages of Pune which come under PMRDA.

Those who have received possession of their flats & those who haven't - appealed to new flat buyers in Pune to avoid the mistakes they have made. To avoid becoming a victim of a builder - like them - their suggestions are:

1) Obtain loan sanction letter from the bank before you start searching a flat.

2) Consider the repayment of loan - not only your eligibility to get the home loan.

3) Book a flat on the basis of per sq. meter carpet area - prevent a builder from committing a crime against State Government of Maharashtra & Central Government of India by selling a flat on the basis of per sq. ft. saleable area.

4) Do not make a decision based on the property ad, sales brochure & sales talk of the salesperson - do title search of the plot of land, check the environmental clearance, sanctions & approvals, study the terms of transactions in the agreement.

5) Book a flat only if the builder is ready to appoint third party construction quality auditor & is ready to share reports at every stage of the construction - till possession.

6) Book a flat only if the builder offers 5 years warranty & guarantee for your flat.

7) Book a flat only if - in case of delayed possession - the builder is ready to pay rent, pre emi & compensation for mental agony, social insult & loss of income tax benefit etc.

8) Give more importance to the current financial status & the debt of the builder than - the number of under construction projects, the history - the track record - & future plans of the builder.

9) Know the actual charges required for electricity, society formation & firmly refuse to pay exorbitant charges.

10) Refuse to pay infrastructure charges - means, charges for the car park - because a builder can not sell a car park - covered or open.

11) Refuse to pay floor rise & the premium for the garden facing flats.

12) Put pressure on the builder & bank to relate the disbursement of loan installment from first slab to conveyance deed.

13) Take possession of your flat only after it receives completion & occupancy certificate from PMC, PCMC & PMRDA.

14) Till PMC, PCMC & Gram Panchayat starts supplying water - it's builder's responsibility to supply free water.

15) After the possession, insist on appointing professional agency for the maintenance of the society and monitor the accounts of maintenance fund.

When I was at the offices of Crime Branch of Pune Police with the flat buyers from Kumar Builders' KUL Ecoloch, I received a phone call of my real estate salesperson friend.

"Some people are protesting at the entrance of CREDAI exhibition! Big news for you!!," my real estate salesperson friend said.

"Protesting? Are you out of your mind? Who will dare to protest against CREDAI?," I said.

"True! That's why it's news!!," my friend said.

My real estate salesperson friend called me again.

"Now, what?," I said.

"CREDAI called police. Police didn't take the protestors in the custody!," my friend said.

"Why? Are police no more friends of Pune builders or what?," I asked.

"Police said they are not protesting. They are creating awareness," my friend said.

"Creating awareness is good. Isn't it?," I said.

"Certainly not! Not good!!," my friend said.

"Not good! For whom? For the builders?," I asked.

"Not good for the property buyers! Aware property buyer will never be able to book a home & may remain homeless for life!," my friend said.

"Means - you are not worried about the builders - you are worried about the property buyers!," I said.

"That's why I called you. You care for the property buyers. I hope you will do something to save them from becoming homeless," my friend said.

"What's the difference? Where do the builders give possession to those who have booked? Isn't it better to become a homeless for not booking a home - than not getting possession of a flat after booking & paying the entire amount to the builder?," I said.

"But, for not getting a flat possession - you can blame a builder. Isn't it better than blaming yourself?," the caller said.

"You sound like a flat buyer! I think I must do something to stop this awareness program," I said.

I told the crime branch police what's going on at CREDAI exhibition & requested them to let me go & do something to stop the awareness program.

"Go & stop it. Awareness is not good. Look at me. After hearing from you that the builder can't sell parking - I have started blaming myself for paying 6 lakhs for 2 car parks. Ignorance is a blessing!," the officer said.

You know what I saw at the main entrance of Credai Pune Home Buying Festival at SSPMS?

Those who have not received possession of their flats were explaining the visitors what precautions they should take while booking a flat & how to avoid becoming a victim of a builder.

You know what was most disappointing?

Huge number of visitors were listening to them carefully!

Do not listen to these guys. You have no power to change the builders. You have to follow the builders' rules. I tried my best to convince as many as I could.

But, no one paid any attention to me.

Sad. Unfortunate. Very stupid of them. Isn't it?

Ignorance is a blessing. Awareness is a curse. Right?

When someone calls me on 919860044110 for 3 minutes free advice about buying a home in Pune, I ask him, "Do you know that real estate is a criminal enterprise?"

Generally, the caller says,"I know most of the builders are bad. But, I don't know what do you mean by 'criminal enterprise'?"

"An enterprise - organisation - a group of people who work together - for committing a crime! Do you know what 'crime' means? 'Crime' means - unlawful activity. Crime means - a serious offense, especially one in violation of morality. 'Crime' means - an unjust, senseless, or disgraceful act. 'Crime' means - an evil act. 'Crime' means - something to be regretted. 'Crime' means - any serious wrongdoing. 'Crime' means - a foolish act or practice!," I try my best to explain.

But, now, after Credai Pune Metro Pune Property Exhibition 2014, my job has become easy. I don't have to take so much efforts to warn the buyers about the true nature of real estate business.

Now, even The Times of India has publicly accepted the exact nature of business of it's biggest patron.

Of course, The Times of India has extended it's help to cover up the foolish act.

While explaining the 7.5 % offer of Credai Pune Metro, TOI clarifies that - "The lender will not take a cut on the interest. Instead, the developer will shell out the difference between 7.5% and what the lender is charging for that specific period."

It means that - by shelling out the difference between 7.5 % and the official interest rate - Credai Pune Metro is not going against the directives of Reserve Bank of India (RBI) or not disobeying the court of law.

In short, The Times of India says that Credai Pune Metro is neither committing any crime - nor taking a home buyer for a ride.

To attract the property buyers, Credai Pune Metro is just playing a game.
A motivational game - "One Two ka Four - Four Two ka One".

Now, please, don't ask me - Did Credai Pune Metro (www.credaipune.org) succeed in attracting property buyers?

Please, Refuse to Pay VAT - An appeal from Pune Builders!

Join the Fight Against Maharashtra Government!

In an informal chat over a lunch, after the press conference of CREDAI Pune Metro, two senior reporters of leading newspapers in Pune were discussing how popular sentiments and advertising policies of the newspaper compels them to hide the truth while reporting.

For example, though, they - both the reporters - have understood the hidden messages given by the president of builders association of Pune & Maharashtra, - editors & owners of their newspapers - will not allow them to pass on that "hidden message" to the readers.

"Don't worry. That's why - CREDAI has invited me. I will pass on the builders' message to the property buyers who have bought flats between June 20, 2006, and March 31, 2010," I assured worried senior reporters.

"Who are you? How could you understand the "hidden message" of Pune builders?," the reporter who didn't know me asked.

"I am Ravi Karandeekar. For a while, I am writing 'Ravi Karandeekar's Pune Real Estate Market News Blog.' But, before starting the blog, for years, I was in Pune real estate advertising & marketing. Most of these Pune builders were my clients. So, I can read their minds. I can read between the lines. As a blogger - you know - I have a freedom to write the secret appeal - the hidden message - of builders in Pune!," I said.

"OK. What was the hidden message?," the other senior reporter asked.

"The hidden message of the builders in Pune & Maharashtra is - Dear property buyers, please, refuse to pay VAT & join our fight against Maharashtra Government!," I said.

If You Fight Against VAT, You Don't Have to Fight Against the Builders!:


The true reason behind calling urgent press conference on the noon of Friday, November 2, 2012, was to announce "compromise formula" to avoid impending war between builders & property buyers in Pune and Maharashtra.

The builders have realized that the united property buyers are not going to stop only at VAT. These united property buyers are going to fight against all exorbitant 'other charges' like MSEB, Parking, Legal & Society Formation, Maintenance and all. Including completion & occupation certificate and conveyance deed.

Instead of only complaining and spreading bad word about the builders, now, under the guidance of consumer organizations like Grahak Panchayat, Grahak Hitwardhini & Sajag Nagarik Manch, these united property buyers are going to take legal actions against the builders for these 'other charges' and demand accounts - refund - compensation - interest.

Builders have realized that it would be difficult to fight enlightened & united property buyers.

The builders have realized that united assertive property is bigger threat than the sales tax officers. While assessing their VAT returns, the sales tax officers can only challenge the method of calculation but these enlightened united assertive property buyers will damage their business itself.

If theses united property buyers continue to fight, in the near future, the builders will not be able to enjoy the protection they are going to gain from Maharashtra Housing (Regulation and Development) Bill, 2012.

Worried builders who prefer Income Tax Exemption Scheme like 80IB(10), are ready to go at any length to protect their books of accounts from Income Tax as well as from Sales Tax Officers.

On the last day, 31st October 2012, the builders realize that Maharashtra Government is not ready to levy 1 per cent VAT on the agreement value. It means that they can't avoid sales tax officers. Now, builders realized that only the property buyers can save them from sales tax officers. It means that there is no point in fighting with the property buyers. And builders decided to throw in the towel and called the press conference.

Though officially the press note given to the reporters said that it's property buyer's responsibility to pay VAT as per the demand letter sent by the builder, in an informal conversation the builders said that this demand is unreasonable. We don't agree with the 3 methods of calculation which forces the property buyer to pay from 0.6% to 5% VAT. We ourselves are fighting for 1 per cent VAT. It means that, please, ignore our demand note and keep on fighting with the Maharashtra Government for the uniform 1 per cent VAT on the agreement value.

The compromise formula is - if the property buyers help us to fight against Maharashtra Government, builders will see that property buyers don't have to fight for other clauses in the same agreement!

Builders can't go against the Maharashtra Government openly. Builders can not go on strike.

Court of law can not order the Maharashtra Government to levy or not to levy VAT.

Media is making it difficult for the Maharashtra Government - already suffering with policy paralysis - to change it's mind on VAT because the decision will be criticized as a favor to builders.

The ministers are not ready to take any decision because they want to avoid one more allegation of scam - Maharashtra Value Added Tax (MVAT) Scam - because of which Maharashtra - the most debt-ridden state in India (Rs 2.53 lakh crore!) - lost revenue of nearly 1,000 crore.

In this situation, for the builders, in Pune & Maharashtra, only hope is property buyers. So, the builders are trying to convince the property buyers that the real culprit is government. Not the builders. In fact, the builders are on the property buyers' side. The builders support the property buyers' cause. So, fight against the government. Not against the builders.

Property buyers, we, the builders. will keep on sending legal notices to you. But you are free to ignore them and continue with your fight against the government.

Property buyers, don't worry about the payment of VAT. We, the builders, will keep on demanding extension of the due date and no interest & no penalty for you.

Property buyers, we, the builders, can't officially join your fight against 5 per cent VAT for the flats bought between June 20, 2006, and March 31, 2010. But, always remember that we, the builders, are your friends.

And friends don't fight. Friends don't go to court. Friends solve dispute by negotiations. Any dispute. Dispute about VAT as well as dispute about MSEB, Parking, Legal & Society Formation, Maintenance, Completion & Occupation Certificate and Conveyance deed!

So, dear property buyers, if you keep on fighting against VAT, we promise, you will never have to fight against builders!

The 'Official' Press Note Issued by Builders:


Though you have got the hidden message, I am sure, you will be curious to read the official stand of CREDAI Pune Metro and Marathi Bandhakam Vyavsayik Association. So, please, have a look at the press note and news links of both organisations. Entertain yourselves and keep on fighting for your rights! After all 'an agreement for sell' is 'an agreement for sell' is 'an agreement for sell'. Binding for both. For the property buyer as well as for the builder.

FLAT BUYER HAS A LEGAL BINDING TO PAY MVAT AMOUNT -
(Press Release- CREDAI's Press Conference on MVAT):


November 2, 2012: There has been a lot of confusion created about the liability and responsibility towards the payment of the VAT to the Govt. of Maharashtra as a result of the various statements and opinions pertaining to the issue.

MVAT (Sales Tax) is an indirect Tax. Thus, under the taxation laws of India the assessee is permitted to collect the same from his customers (similarly to service tax which too is an indirect tax.) Like any other goods are purchased the VAT collected from the customers is deposited to the Government likewise, the VAT amount for flats is required to be paid by the respective flat owners by depositing it with respective builders.

As per the law, there are 3 ways the developer (dealer) can calculate the VAT that is payable to the State. The dealer is free to take the method that leads to the lowest payment. As an example, in one case, the dealer is free to deduct the value of the land (as per the ready reckoner rates), also deduct the value of works contracts issued. From the remaining amount, 30% is permitted to be deducted as a standard deduction towards labor. On the balance, the average rate of tax on materials purchased is to be applied and this leads to the exact tax liability for each flat.

The method has numerous variables such as rate per square foot which can be different for each customer, rate for land which changes every year as per the ready reckoner. Each developer follows different contract strategies and as such, the works contract deductions differ. Depending on the purchases made from within Maharashtra or out of state, the tax rate to be applied also varies. As a result, there can be a difference in the rate of tax for neighbors within a project and certainly a difference between projects. In fact, in order to simplify the process, the state government had come up with a standard rate of VAT at 1% with no land setoff etc from 2010 onwards.

Considering the background and legal history of the VAT from 2006 the State Government had issued a circular on 6th Aug. 2012 with various terms and conditions making it mandatory to deposit VAT (sales Tax) on the flats from 20th June 2006 with the deadline of 31st Aug. 2012. To challenge the punitive portions of the circular and the applicability of VAT on the industry as a whole the CREDAI-Pune Metro had moved to the Hon'ble Supreme Court of India and the Hon'ble Supreme Court of India extended the period for becoming dealers and granted administrative relief filing returns and paying tax before the said date.

During the period of 2006 onwards the developers have in their agreements of Sale with flat holders put the liability to pay VAT (Sales Tax) and other taxes to the flat holders as when it would become liable. In the larger interest of the Real Estate Industry and for all its players (including the customers), various organizations had filed cases against the applicability of this tax per se.

Since the matter of applicability of VAT on the Real Estate Industry was in dispute and matters were sub-judice in Court through various orders since 2009 and hence the Developers did not collect the VAT amount from the Customers.

On 28-08-2012 the Hon'ble Supreme Court of India gave an interim relief wherein they had directed that VAT be paid by and before 31st Oct. 2012 so as to avoid any coercive action penalty or interests while extending the date and of payment of this tax from 31st Aug. 2012 to 31st Oct. 2012 under the Trade Circular issued on 6th Aug,. 2012 by the Sales Tax Department, Government of Maharashtra.

Under the provision of the MVAT 2002 for the period from 20th June 2006 to 31st March 2010, the methodology of calculation of MVAT liability is very complicated and cumbersome. After going through all calculations of deduction and set offs, variation in tax liability can be from 0.6% to 5% in each individual case and this will further vary in projectwise calculations on year to year basis.

The State Government, from 1st April 2010 however did bring the composition scheme wherein 1% of the agreement value is to paid at the time of registration as VAT (Sales Tax) however this was not applicable to the period from 20th June 2006 to 31st March 2010. We are however still in pursuit with the State Government to consider our appeal in the interest of the entire Real Estate Industry to make this Composite Scheme from 20th June 2006 so as to bring a major relief to all flat holders in the State.

In fact, there were various petition including a PIL that were filed in the Hon'ble Bombay High Court wherein a similar prayer was sought some of which were decided and dismissed on 31st Oct. 2012 however we are yet to receive a copy of the same.

In recent articles and news publication it seems that there few organization that are misguiding the flat purchasers as to not making the VAT payment to the Developers who on their behalf pays to the State Government. As we have stated here even the PIL in the Hon'ble Bombay High Court did not seek for flat purchasers not to pay tax rather their prayer was to recover lowest VAT amount from the flat purchaser as recovery of the amount paid or payable to the State Government in discharge of liability of the flat purchaser and that the Developer has full right to collect from the customers.

So it is quite clear that the ultimate liability to pay VAT on the sale of flat is on the flat purchaser as it being an indirect tax like that of Service tax. Kindly do not heed to any misinformation and confusing information or articles as it would only increase the burden of liability over the flat purchaser.

It is pertinent to note that the Hon'ble Supreme Court of India has passed on interim order to pay tax before 31st Oct. 2012 and stating that if the applicability of VAT is finally held as unconstitutional then the State shall refund the entire tax amount with interest as decided. The Developers in turn shall refund the same to the Flat holders as and when decided.

Thus even though VAT tax is being paid it does not mean that the issue of applicability of VAT is decided rather all these issues are open before the Hon'ble Supreme Court.

CREDAI-Pune Metro is voicing this demand and is fighting a legal battle since last 5 years for the benefit of the flat buyers.
