DSK F D Holders raise objection against out of the way bail granting plans to CMD of Bank of Maharashtra

DSK F D Holders' complaint to Bombay High Court against granting of bail to Ravindra Marathe, CMD of Bank of Maharashtra, in the Pune District Court of Hon. Judge Sardesai:

"What is the urgency to save fraudulent people from law & order?" question DSK F D Holders in their complaint email to Bombay High Court.

"If the courts function like this in doubtful manner, going out of the way, not following the procedure, common man will lose faith in Judiciary." warn DSK F D Holders.

"In view of the foregoing, these proceedings before the Hon'ble Sardesai Court should be suspended & moved to some other place." request DSK F D Holders to Bombay High Court.

Here is the complaint email sent to Bombay High Court:

Respected Sir/s,

Subject: Objection for granting of bail to Bank Of Maharashtra's CMD Mr. Marathe in the Pune District Court of Hon. Judge Sardesai.

D S Kulkarni investment scam is to the tune of 2064 crores. In this fraudulent matter, a criminal case has been registered with Pune Police. During the investigation, Police have arrested several persons. In this matter CMD of Bank Of Maharashtra & others have been arrested.

Earlier bail application was not pressed by thr said Mr. Marathe. Fresh application was moved for bail, at 5.40 p.m.on 23rd June 2018.
Before that, Mr. Marathe was arrested by Pune Police and remanded to Police Custody.

In the said fresh bail application, surprisingly,
Police Custody was converted into Magistrate Custody and it was done only in this case as a special case.

As per our Information, no medical reports issued by any Doctor of Government Hospital for admitting Mr. Marathe in Hospital for Medical Treatment.
Thus, without obtaining any medical report, Mr. Marathe was shifted to a private hospital at 7.00 p.m.

When in the Fresh Bail application of Mr. Marathe was moved, Hon'ble Judge Sardesai passed an order for say of the Public Prosecutor and Investigation Officer on the said bail application.

Government of Maharashtra has appointed Special PP Pravin Chavan in this matter, but he was not present for this matter. Local PP was allowed to represent this matter, who according to us, was not well informed about the facts of this case.

Hon'ble Judge Sardesai asked the PP for filing immediate say in the matter.

Your Honour, travel time in each direction from the District Court to Police Commissioner's office is minimum 20/25 minutes. Preparation of documents, paper work, report etc. takes approximately one hour.

We have no knowledge whether proper say was given and objection taken or not.

After that Hon'ble Judge Sardesai has asked the Advocate representing Mr. Marathe, said that if you ask for bail, only then I will be able to grant it. Hon'ble Judge asked PP for State's NOC to grant the bail to Mr. Marathe.

Now this matter is posted for hearing on 25th June 2018 at 10.30 a.m.

According to our information, Hon'ble District Judge, Pune was also present in the chamber of Hon'ble Judge Sardesai.

All these proceedings were conducted in the chamber of Hon'ble Sardesai.

Surprisingly, the day when these proceedings were conducted, i.e. on 23rd June 2018, it happens to be 4th Saturday, which happens to be a government holiday. Even then proceedings were conducted for reasons not known to us.

We also understand that the bail application was not registered and cannot be traced online on the official website of Courts & still the hearing was conducted by the Hon'ble Judge Sardesai.

If the courts function like this in doubtful manner, going out of the way, not following the procedure, common man will lose faith in Judiciary.

When the courts open at 11.00 a.m. what is the need to keep the matter for hearing at 10.30 a.m. on 25th June 2018, is the biggest question in our minds.

What is the urgency to save fraudulent people from law & order. We feel that, in this matter lots of illegal things are happening & have happened previously.

According to our information, to grant bail to Mr. Marathe, all arrangements are in place & also the order for granting bail is awaiting signature of Hon'ble Judge Sardesai.

In view of the foregoing, these proceedings before the Hon'ble Sardesai Court should be suspended & moved to some other place.

Kindly look into this seriously.
