A developer in dubai has to open a escrow account along with the DLD (Dubai Land Department) for a paticular project. When ever a customer books a apartment or does any payment to the developer- this amount goes into this escrow account. This amount directly does not go to the developer. This developer has to claim the amount at every stage of project completion. If there is a delay in project launch or at any stage of development, the consumer can claim the paid amount along with the penalty charges ( interest), where you need not file a judicial case. This model is very successful in Dubai. Political will very important while imposing such policies.<br />If we can frame similar model in India most of Indian consumer problems can be solved. To make the rules more stringent for the developer. A developer should be made to pay security deposit worth the market value of the project in such escrow account, so that the payment of the penalties can be made from this deposit. The developer who can't make payment of such deposit should not be allowed to sell during pre-launch or underconstruction..
