Over 4 lakh Pune flat buyers are victims of the builders

Dream homes turn into a nightmare for flat buyers in Pune:



RITESH Jain (name changed on request) had booked a 2BHK flat in an ongoing project of a prominent builder in Kharadi in 2014. Two years later, he is yet to get possession of his flat.

“The agreement that I had signed with the builder had said I would get possession by the end of 2015. The builder keeps on assuring me that I will get the flat soon, but that soon seems to be far away,” he says.

Jain, who is paying a hefty house rent, is now thinking of taking legal measures against the builder.

Jain’s predicament reflects the situation faced by lakhs of people in the city who are made to run from pillar to post to get possession of their promised flats despite making payments on time. - Click to read more

Sachin Agarwal of Maple Shelters gets interim protection from arrest

No arrest till June 8!


Like the victims of Maple Shelter's Maharashtra Housing Day Scam - the victims of
Bharatiya Jan Ghar Yojana & India Housing Day Scams must get their money back

The Bombay High Court today extended till June 8 the interim protection from arrest given to Maple Group Chairman Sachin Agarwal and MD Naveen Agarwal who were booked for allegedly cheating people by publishing "misleading" advertisements in newspapers promising flats to buyers at cheaper rates.

Defence counsel Aniket Nikam argued that the company belonging to Agarwal was not a fly-by-night entity and they had started refunding money to people who had invested in their project for the one BHK flats.

Nikam said that in the event of any investor failing to apply for refund, the company was willing to deposit the amount due to the people in the high court.

Accepting the affidavit filed by the Agarwal brothers, the court continued till June 8 the interim protection granted to the duo two days ago.

After obtaining interim bail from Bombay High Court on the 3rd of May, absconding scamster Sachin Agarwal of Maple Shelters reported to Economic Offence Wing on the 4th of May - ABP Majha reports.

Since the last 15 days, after Pune police busted Maple Shelters' Pradhan Mantri Awas Yojana Scam, Sachin Agarwal was absconding.

On 5th May, Sachin Agarwal has to submit an affidavit to the court about refund of money collected under the fraudulent offer of 1 BHK Flat for Rs. 5 Lakh - Maharashtra Housing Day.

It seems, ABP Majha reports, the case would be only about Maple Pradhan Mantri Awas Yojana Scam. What about Maple Shelters' Bharatiya Jan Ghar Yojana Scam? What about Maple Shelters India Housing Day scam?

Why is Economic Offence Wing not investigating Maple Shelters' Bharatiya Jan Ghar Yojana & India Housing Day scams?

Maharashtra will have interim RERA by October 2016

Who will be the Real Estate Regulatory Authority (RERA)?:




1) About implementation of Real Estate (Regulation and Development) Act, 2016:


The much awaited and widely acclaimed Real Estate (Regulation and Development) Act, 2016 came into force from May 1, 2016. This has set in motion the process of making necessary operational rules and creation of institutional infrastructure for protecting the interests of consumers and promoting the growth of real estate sector in an environment of trust, confidence, credible transactions and efficient and time bound execution of projects.

Ministry of Housing & Urban Poverty Alleviation has notified 69 of the total 92 sections of the Act on Wednesday this week bringing the Act into force from May 1,2016 culminating the eight year long efforts in this regard. A proposal for a law for Real Estate was first mooted at the National Conference of Housing Ministers of States and Union Territories in January, 2009.

As per the notification announcing the commencement of the Act on May 1,2016, Rules under the Act have to be formulated by the Central and State Governments within a maximum period of six months i.e by October 31,2016 under Section 84 of the Act. Ministry of HUPA would make Rules for Union Territories without legislatures while the Ministry of Urban Development would do so for Delhi.

Section 84 of the Act stipulates that “The appropriate Government shall, within a period of six months of the commencement of this Act, by notification, make rules for carrying out the provisions of this Act.”

Early setting up of Real Estate Regulatory Authorities with whom all real estate projects have to be registered and Appellate Tribunals for adjudication of disputes is the key for providing early relief and protection to the large number of buyers of properties.

Section 20 of the Act says “The appropriate Government shall, within a period of one year from the date of coming into force of this Act, by notification establish an authority to be known as the Real Estate Regulatory Authority to exercise the powers conferred on it and to perform the functions assigned to it under this Act”. These Authorities decide on the complaints of buyers and developers in 60 days time.

Section 20 of this Act also empowers appropriate Governments to designate any officer preferably Secretary of the Department dealing with Housing, as the interim Regulatory Authority until the establishment of Regulatory Authority under the provisions of the Act.

Regulatory Authorities, upon their constitution get three months time to formulate regulations concerning their day to day functioning under Section 85 of the Act.

Likewise, under Section 43 of the Act, Real Estate Appellate Tribunals shall be formed within a maximum period of one year i.e by April 30,2017. These fast track Tribunals shall decide on the disputes over the orders of Regulatory Authorities in 60 days time.

Under the directions of the Minister of Housing & Urban Poverty Alleviation Shri M.Venkaiah Naidu, a Committee chaired by Secretary (HUPA) has already commenced work on formulation of Model Rules under the Act for the benefit of States and UTs so that they could come out with Rules in quick time besides ensuring uniformity across the country. The Ministry will also will come out with Model Regulations for Regulatory Authorities to save on time.

The time limits of six months for formulation of Rules and one year for setting up Regulatory Authorities and Appellate Tribunals are the outer limit and the States willing to act quickly could do so and the Ministry of Housing & Urban Poverty Alleviation would notify the remaining Sections of the Act to enable relief to the buyers under the Act as quickly as possible, as desired by Shri M.Venkaiah Naidu.

The remaining 22 Sections to be notified relate to functions and duties of promoters, rights and duties of allottees, prior registration of real estate projects with Real Estate Regulatory Authorities, recovery of interest on penalties, enforcement of orders, offences, penalties and adjudication, taking cognizance of offences etc. - Click to read more - Press Information Bureau

पूर्वी अस्तित्वात असलेला ‘मोफा‘ म्हणजे महाराष्ट्र ओनरशीप फ्लॅट ॲक्ट, २०१२ साली रद्द करून राज्याने स्थावर मालमत्ता (विनियमन व विकास) २०१२ स्विकारला. या कायद्यानुसारही राज्यात स्थावर मालमत्ता नियामक प्राधिकरणाची स्थापना होणार होती. परंतु एकूणच राजकीय नेत्यांचे आणि बाबू मंडळीचेही बिल्डरांशी साटेलोटे असल्याने त्याची स्थापना झाली नाही. आता तर तो कायदाच केंद्राने निरस्त केल्याने राज्यात आधीच उल्हास त्यात फाल्गुन मास अशी परिस्थिती निर्माण झाली आहे.त्यामूळे जोपर्यंत केंद्र शासन स्थावर मालमत्ता अधिनियम २०१६ मधील सर्व तरतुदी अधिसुचित करत नाही तोपर्यंत राज्यात स्थावर मालमत्ता घेणा-यांना दिलासा देणारा एकही कायदा अस्तित्वात नाही अशी स्थिती निर्माण झाली आहे . According to ABP Majha, today, Bombay High Court ordered police not to arrest Sachin Agarwal of Maple Shelters till 5th of May 2016. Sachin has to report to police station on 3rd & 4th May. High Court has ordered Sachin to give complete information of the flat buyers who had applied for a 1 BHK Flat for Rs. 5 Lakh under Pradhan Mantri Awas Yojana Scam.

Pune Flat Buyers Declare War on Builder Mafia Raaj

- under the leadership of Akhil Bharatiya Grahak Panchayat, flat buyers in Pune sent an ultimatum to Maharashtra CM Devendra Fadnavis:



A few days ago, in the press conference, Mr. Vijay Sagar, Mr. Vilas Lele & Ms. Seema Bhakare of Akhil Bharatiya Grahak Panchayat Pune published first list of 41 projects which have looted, cheated & exploited around 15,000 flat buyers and declared war on builder mafia raaj in Pune.

Grahak Panchayat gave to the press the copy of an ultimatum letter sent to Chief Minister of Maharashtra Shri Devendra Fadnavis.

Along with andolan, Grahak Panchayat also announced that Public Interest Litigation (PIL) will be lodged against the State Government, local bureaucrats & Pune police for non performance of duties.

Here is the first list of projects in which the nexus of builders, bureaucrats, police & politicians have exploited Pune flat buyers:


1) Shalini Lake View Undri - Trishul Builders:


A) 500 Flats: Rs. 8 - 10 Lakhs Each.

B) In 2010 the building was demolished as it was constructed on reserved government land.

C) Money was collected from more than 500 flat buyers. Money not refunded. Hundreds of legal cases ongoing. No action on FRI lodged in 2011.

2) Misty Trails Hadapsar - Bhujbal Brothers Construction Company


A) 178 Flats: Approx Rs. 40 Lakhs Each

B) Construction stalled for years. Bank has attached the project. No action on FIR.

3) Forest Mist Hadapsar - Bhujbal Brothers Construction Company:


A) 80 Flats - Approx Rs. 40 Lakhs Each

B) Construction stalled for years.

4) Valay Hadapsar - Bhujbal Brothers Construction Company:


A) 20 Flats - Approx Rs. 40 Lakhs Each

B) Possession delayed by 2 years. Construction stalled for years.

C) Electricity meter 1,50,000 + Development charges Rs. 2 Lakhs collected from each flat buyer.

5) Vatika Balewadi - Bhujbal Brothers Construction Company:


A) 123 Flats - Rs. 45 - 70 Lakhs Each

B) Illegal floors. Incomplete project. Refund cheques bounced. No completion & occupancy certificate. Delayed possession after Grahak Panchayat Intervention. Amenities - clubhouse, gym, party lawn, garden etc - not provided.

C) Electrical meter Rs. 75,000 collected from the flat buyers.

6) Aura City Shikrapur - Jalan Maple Developers:


A) 1000 Flats - Rs. 14 - 25 Lakhs Each

B) Incomplete project. Construction stalled. Possession of a few flats given. No completion certificate. No basic facilities provided. Ongoing legal cases.

Goodwill Nirmiti Lohegaon Launched!

All those who can afford to own a property in Pune real estate market have already become homeowners. Now, the builder's target is the customer who can not afford to own a flat.

This target customer has not saved money for paying 20% down payment. So, the housing finance companies have launched 0% down payment offer.

Even if he is ready to pay 50% of his monthly income as an EMI - for the next 20 - 25 years - the home loan eligibility of this target customer is small. He can afford to own a 1 BHK - 2 BHK Flat in the price range of 30 - 40 Lakhs. Obviously, the flat sizes are compact - carpet areas are small. 1 BHK 425 for 32.83 Lakhs, 1.5 BHK 523 for 37.71 Lakhs, 2 BHK 654 for 45.45 - 46.28 Lakhs.

Mr. Rakeysh Mishraa of Viable Resource Marcom took me to Navin on the day of the launch. "You will enjoy meeting them. All are young & dynamic," Rakeysh had told me.

I didn't take Rakeysh seriously. Because he is their media & branding consultant. You know? When I was in Pune real estate advertising - even I used to admire my builder clients. Only when I joined my builder clients as a real estate salesman - I realized that they don't treat their clients the way I used to treat them when they were my clients. And I started Ravi Karandeekar's Pune Real Estate Market News Blog!

However, I was curious to meet these guys because you always ask me - How is the builder - good? And you refuse to accept my answer - Be a good flat buyer - don't look for a good builder! Ultimately, I have decided to meet & write about the builders.

Porwal Road, Lohegaon Gram Panchayat

My first impression about Navin Agarwal was positive. When we entered his office - Navin was attending a flat buyer. I liked that! When we were leaving, I noticed - all sales staff had left for the day - but all the directors were at the show flat entertaining the walk in flat buyers! Now, flat buyers, it's your responsibility - never let them become inaccessible - unapproachable!

"You know? Sometimes our sales staff can't communicate the concept - the thought - behind the planning. Since we have conceived it - we are in a better position to explain it to the flat buyer," Sumit Tayal said.

"Do the buyers give importance to the planning? Isn't 0% down payment - discounted launched property rate - 3897 instead of 4200 - not enough?," I asked.

"Competition - options - in Lohegaon compels you to be unique - the concept is the only way to win the property buyers. For the last 5 years - I am developing projects in Lohegaon. 5 years ago there were only 5 options - today there are more than 50 on Porwal Road!," Navin said.

"What is the concept of Goodwill Nirmiti? Love? Our home is the celebration of our love - your ad says!," I asked.

"Love - Happiness - Success is the theme of Goodwill Nirmiti," Summit said.

"See, we are selling to young couples who have come to Pune for a job. Not to those who are born & brought up in Pune. For the migrated people buying a home is more than settling down in life - for them it's a big success - assurance of a happy family life - loving relationship between husband & wife," referring to A3 size colorful brochure of Goodwill Nirmiti, Navin said.

"How does this reflect in the flat - project?," I asked.

"For that you have to see the show flat," Navin said and took me to the show flat.

It's a 2 BHK Flat. It has entrance lobby - for privacy. Kitchen is open with L shape platform & breakfast counter - housewife is the king of a home. Dry balcony is big enough for washing machine as well as dishwasher. Living & dining of a 2 BHK Flat has enough space for the dining table & sofa set. (1.5 BHK & 1 BHK Flat buyers are supposed to enjoy TV lunch & dinner - no space for a dining table). Between living cum dining and 2 bedrooms - there is a minimum size passage - privacy for the bedrooms. In this passage - there is wash basin - no one likes washbasin in the common toilet. (1.5 BHK & 1 BHK Flats have separate WC & Bath. Washbasin is in the bathroom - not outside.) All Bedrooms in all types of flats have a niche for a wardrobe - space saving - efficient use of space. Only one terrace per flat. In a 2 BHK Flat attached to a living or a dining. Navin went on explaining.

"Specification - Modular Kitchen, Water Purifier, Video Door Phone, Fans & Tube Lights, Tata Sky Connection - Amenities like Swimming Pool, Clubhouse, Gym with AC, Security CCTV cameras - reflects success," Summit said.

"Of course, on the rational level - construction has begun & the project is approved by HDFC, LIC, SBI, IDBI, ICICI, AXIS & INDIABULLS - gives confidence to book a flat," said Navin.

"Looks like you enjoy marketing & selling, Navin! Is real estate all about selling - booking flats? How come you became a builder?," I said.

"How can you ask? Don't you know that our community owns real estate business? Of course, since I am pharmacist - my first business was of distribution of pharmaceutical products. But within no time - I became a builder and I am enjoying every aspect of it - from planning to construction," Navin said.

"Your community?," I asked.

"Agarwal community! We dominate Pune real estate market," Navin said.

(Recently - someone told me that CREDAI is not a 'C Company' - It's 'A Company'! No. Builders itself is a community. There is not only one Sachin in this community. There are others who are equally capable of doing what Sachin Agarwal of Maple Shelters did. The builder community has no connection with any social community.)

"Agarwal community dominates many businesses - including ecommerce. Why did you choose real estate? Why did you prefer Lohegaon?," I asked.

"Joined because of a close relative - continued in real estate because - like any Agarwal - I enjoy taking risks - would remain in real estate because it's transforming from unorganized to organized - regulated - business - which is good for my generation," Navin said.

"Oh! You think RERA is good!! Tell me - how can you speak Marathi so fluently?," I asked.

"I am born & brought up in Pune - all my life I am speaking Marathi. In fact, Pune is more dear to me than our native place," Navin said.

"Did you enjoy the meeting?," on the way, Rakeysh asked.

"Yes! Very much!! Tell me - which is your community?," I asked.

"I am from Mithilanchal!," said Rakeysh.

"Means you are from Bihar," I said.

"I am from Mithilanchal!," Rakeysh said.

P. S. - This blog is about meeting the developers of Goodwill Nirmiti Lohegaon. Because of lack of basic civic urban infrastructure, I don't recommend Goodwill Nirmiti or any project in Lohegaon Gram Panchayat. I am against 0% down payment offer. It's nothing but a trap set by the bank to make you a slave for life.
