Water Deposit....Assured Supply of....Tanker Water

From 'Water Affidavit' to 'Water Deposit':




Big achievement of Credai Pune Metro is the invention of the most popular lie "People move in first; roads, water follow - and your property appreciates!".

Stupid people from other cities, states & countries buy this lie and invest in Pune real estate market.

Naive & young 'first time home buyers' believe in this lie and buy property which is not fit for living.

But there are some builders in Pune, who do not deal in lies. Mr. Sanjay Deshpande. of Sanjeevani Developers is one of them. When Mr. Sanjay launched Sangam, a single stand alone building of 36 units of 2 BHK Flats at Sus Gaon, he decided to take 1 Lakh Rupees as "Water Deposit" from each flat owner.

I was surprised when Mr. Rahul Gandhi, one of my readers who has booked a flat at Sangam, admired the idea of "Water Deposit".

"Don't you think that this is one more 'idea' to hike property prices?," I asked Mr. Rahul Gandhi.

"No. It's a practical solution to the current water crisis in Pune!," said Mr. Rahul Gandhi. Curious to know more, I met Mr. Sanjay Deshpande to talk about "Water Deposit" at Sangam at Sus.

"First, congratulations for selling more than 50 per cent flats in Sangam. I never thought you could sell a single flat. What's the secret of your success?," I asked Sanjay.

"Be true. Be logical." said Sanjay.

"Get out of Pune real estate market," I said.

"You can fool all the people some of the time, and some of the people all the time, but you cannot fool all the people all the time!" said Sanjay.

"Good for updating on Facebook!," I said.

"Sangam is for IT professionals working in Hinjewadi. Out of 36 units, today, only a couple of flats are available for booking. What does this prove? Be true - be logical - works!," said Sanjay and explained how a 2 BHK Flat for around 50 Lakhs at Sangam at Sus is the best buy for those who want to live near Hotel Sadanand on Baner Road.

"Till there is no PMC water supply - till the society is not formed and conveyance deed is not done - supplying adequate quantity of water is the responsibility of a builder. Sus will be merged in Pune Municipal Corporation - but, we don't know when. Even after the merger - no one knows how much time PMC will take to provide water to Sus. So, the society will have no option but 'Tanker Water'. How can society buy 'water tankers' if it doesn't have enough funds? As a builder, I consider it - my responsibility - to see that - the society will have enough funds to buy required quantity of water. So, I came up with this idea", explaining the idea of Water Deposit, Sanjay said.

"Water supply is PMC's job. But water management in a project is builder's responsibility. At Sangam, I am giving water recycling plant. Because of this, Sangam doesn't need to buy water for flushing and gardening. Plus, there are two separate tanks with water meters - so that, the society will know their exact consumption & requirement of drinking & washing cleaning water," said Sanjay.

"Why 1 Lakh? What's the calculation?," I asked.

"Calculation is based on water requirement and average water tanker rate in this part of Pune. Most important is - "water deposit' is the part of agreement - for which you get a home loan - and it will be handed over to the society ," said Sanjay and added that, "I am also curious to see how the idea of 'water deposit' works in real life. However, for sure, it's more realistic that writing '24 hours water supply' in the brochure and doing nothing for providing water!"

Mr. Builder, Show Me Your Money!

Don't Become a "Cash Cow" for a Builder.
Book a Flat Only in a Project Which Has Received "Project Finance"
from the Bank - Preferably, Nationalized Bank!


Instead of completing ongoing project,
why does a builder launch a new project?


Because, to finance the expansion of his business,
a builder is always in search of a new source of cheap funds.
Since, naive property buyers are 'easy kill',
a builder prefers to launch a new project at the new location or
a new phase of the ongoing project.

Plus, it's not that expensive to launch a new project.
What you need is 'an open plot' - on which, in a couple of days, a builder can construct 'a show flat', a couple of 'color ads' in the local news papers and 'a few hoardings' at prime locations in Pune.
Yes, of course, 'way to" boards, at every 10 feet, on the approach road (temporary), to the 'site office'!

Considering that your 'booking amount' and 'own contribution' is 'interest free fund' for a builder,
he doesn't mind spending - 1 to 2 crore - on the launch of a new project.

And you know what? Most of the time, whatever builder spends on launch is all his financial investment in the project! Certainly, besides the initial down payment the builder has made to the land lord.

After the launch, most of the builders know that you will 'finance' the project. Not only the one - in which you have booked the flat - but, all other 'on going' and 'up coming' projects too!

Your 20 per cent 'own contribution' and subsequent 'disbursements of your home loans' will pay the bills of the contractors, steel & cement suppliers and the installments of the landlord - not only of the project in which 'you have booked a flat', but all his other 'on going' and 'up coming' projects!

Some unscrupulous builders took this to the next level by launching 'pre-launch offers' and started collecting cheap funds even without procuring a plot of land and without spending on constructing 'show flat', 'site office' and 'advertising'.

Long ago, for a short period of time, when Pune real estate market was booming, this game worked for some builders as well as for a few property buyers. But, as soon as Pune real estate market slowed down, what we see around is thousands of prisoners of pre-launch offers, thousands of hostages of incomplete projects - waiting for months and years - for the possession of their flats.

Is there any safe way to book a flat on the day of launch?




Other day, when CA. Sujit Dhadphale, Director of Delpha Consultants Pvt. Ltd. asked me, "How is Pune real estate market?"

"Serious slow down - real estate - auto industry - the entire economy is going through slow down - isn't it?," I said.

"But still, only in Pune, new projects are launched, property rates are going up and people are booking!," said Sujit.

"Because builders in Pune know how to play the property buyers! Instead of running away from the fire, Pune builders make property buyers jump in the fire! Particularly, the property buyers from other cities, states and countries - who don't know the reality - are their soft targets!," I said and told him about the games builders play.

After hearing how property buyers are suffering, Sujit asked me, "What's the solution?"

"Simple solution - to avoid being exploited by the builders - is to change the way we buy a property. We should stop booking and start buying only ready for possession flats with completion certificate. Let the builder raise and invest his own funds for the construction. Why should we stake our life and risk our hard earned money?," I said.

"That's too radical! It may happen only when people will realize that there is no scarcity of houses. When the supply of houses will become abundant," said Sujit.

"Then what is the practical solution?," I asked.

"You know what? There are many young builders in Pune who are professionals. They look at real estate as an industry. Like any small scale - medium scale industrialists - they are entrepreneurs - not gold diggers or bounty hunters - or not old time 'Shethjis' - who believed that you can prosper only if you exploit others!," Sujit said.

"Are they doing anything different? Or to earn respectability - they are only corporatising criminal practices?," I asked.

"These builders are not dare devil adventurers or greedy gamblers. These builders are managers - financial managers. Whom nationalize banks are ready to give project finance. Funding for the construction of the project. Banks scrutinize the legal papers of the land. Banks confirm that the project has received required sanctions and approvals. Banks monitor the progress of construction. So, the property buyer is sure about legalities and completion of the project - even in the current slow down. The property buyer can be sure that his installments are used for the construction of his flat and he is not used - exploited - by the builder. So, booking a flat in a project which has received 'project finance' from the nationalized banks is safer - can be a practical solution to buying a ready possession flat," said Sujit.

"How can one know that the builder has received 'project finance' from the bank?," I asked.

"RBI expects that the builder should mention about the name of the bank which has given project finance in the ads, brochures and all promotional literature of the project!," said Sujit.

"What if the Bank is not mentioned?," I asked.

"Ask the builder! After visiting the sample flat - demand to see the builder and ask him - Show me your money!. Besides my installments - how much working capital do you have? As a paymaster - it's property buyer's right to know the financial health of the builder!," said Sujit.

"What about personal health of a builder? Should the property buyer ask the builder to remove his belt and take off his pants?," I asked.

"I am financial health expert. I help the builders to get the project finance from the bank! However, we all know that, as a 'paymaster' - property buyer can take a right decision - safe decision - informed decision - only when he knows all about the construction service provider - builder," said Sujit.

What happens if a lender takes over a housing project?

Last month, the State Bank of India took over a housing project in Kolkata because the developer had defaulted on repayment of dues to the tune of Rs 176 crore. The Teen Kanya project was promoted by the Bengal Shelter Housing Development, a joint venture in which the state housing board has 49% stake. Therefore, its repossession by the SBI has come as a shock for the 400-odd families that have invested in the project.


Most of the buyers had put money in the project because the state housing board was involved. The project is only half complete and the investors are now contemplating legal action to safeguard their investments.

The incident brings into focus the RBI's decision to stop builders from offering 80:20 schemes. Under these schemes, the buyer services only 20% of the loan for the property while the developer pays the interest on the balance till the property is ready. The RBI warned that if the developer defaults on the interest payment, the buyer would suffer because the loan was in his name.

How "Grahak Panchayat" Helps Pune Property Buyers to Fight for Their Consumer Rights:


Nowadays, Pune property buyers refuse to be victims of builders. They are fighting against the builders for their consumer rights.

Pune property buyers are fighting for the completion certificate.
For the formation of Co-Operative Housing Society.
For the conveyance deed.
For drinking water.
For incomplete construction.
For not providing promised amenities.
For the water leakage & seepage.
For the defective tiles.
For the inferior construction quality.

Pune property buyers have started demanding compensation for delayed possession.

They are demanding accounts & refund of money collected by the builder
as MSEB charges, open parking, society formation charges etc.

Last year, in 2012, Maharashtra Value Added Tax on the properties bought between June 20, 2006, and March 31, 2010 created awareness among Pune property buyers. The VAT issue united Pune property buyers for the first time. Under the leadership of Akhil Bharatiya Grahak Panchayat Pune City, Grahak Hitvardhini, and Sajag Nagrik Manch united Pune property buyers started their fight against the builders.

This 'fight' against VAT, inspired Pune property buyers who had purchased flats after April 2010. These property buyers have started visiting office of Grahak Panchayat on Monday evenings between 6 pm to 7.30 pm. Mr.Vijay Sagar, Ms. Seema Bhakare, Ms. Veena Dixit and other members of the "Builder Related Problems Cell" of Grahak Panchayat guide these property buyers to solve their issues.

"Fact of the matter is - It's not that difficult to fight against the builder! These proactive property buyers realize in the first meeting," said Ms. Seema Bhakare.

"We are not aware about our consumer rights and don't know how to fight for them - is the main problem," said Mr.Vijay Sagar.

"You wont believe, 90 per cent complaints are solved without going to consumer court! Just by writing a letter to the builder!! At Grahak Panchayat we guide these property buyers to complain in a proper way and to take the appropriate steps to resolve the issue, " said Ms. Seema Bhakare.

"No professional builder can afford to refuse the demand of united property buyers who know their rights and are ready to take proper steps," said Mr. Vijay Sagar.

Of course, Monday evening is enough for the guidance, but to create awareness among all, these assertive property buyers invite Ms. Seema Bhakare, Mr. Vijay Sagar, Ms. Veena Dixit, Mr. Shrikant Joshi and other members of the "Builder Related Problems Cell" to their society. Preferably on weekends, all the members of the society gather together in a club house, parking or in a open space to discuss their issues.

At the end of meeting, angry property buyers become assertive. Frustrated property buyers become proactive. Victims of the builder become fighters. Helpless property buyers realize their power. They are no more frightened of their builder.

Last weekend, I attended one such society meeting and video recorded it. Quality of the video is not satisfactory. Discussion is in Marathi. But still, for sure, the video will inspire you to invite "Builder Related Problems Cell" of Grahak Panchayat to your society.

Homeowners to Own & Professionals to Manage

"Special Township is not a private kingdom of a builder. Special Township means the decentralization of urban infrastructure. Government of Maharashtra itself has given permission to a private builder to develop this infrastructure for the growing urban middle class population. Besides developing - managing this infrastructure is the responsibility of a private developer. As a developer of Nanded City Pune, my job is to mange this infrastructure more efficiently and more democratically". Mr. Satish Magar said.

After the recent 97th amendment to the Constitution of India, formation of a Co-operative Society has become a fundamental right of any Indian citizen. It means that no builder can refuse or avoid to form a co-operative housing society.

As it is, generally, good builders in Pune form a co-operative housing society, do the conveyance and get out of that project. Are the developers of special townships - Nanded City Pune, Blue Ridge, Life Republic - going to do the same? I was curious to know.

As usual, the flat agreements of these special townships have given all decision making powers - about formation of co-operative society and conveyance of ownership rights - to the developers. Now, nearly after a year, though the developers of Nanded City Pune & Blue Ridge Hinjewadi have given possession of a few thousand / hundred flats, they haven't taken a decision or any action. So, there is a confusion. Are these unit holders - 'property owners' or tenants of builder?

Besides the status of a unit holder - I was also curious about the future of these townships. So, I requested Mr. Satish Magar to share his plans about management of Nanded City Pune (www.nandedcitypune.com).

Infrastructure Management:


First, Mr. Satish Magar told me the difference between a general housing project and the special township -

When a housing project is in a municipal corporation limit, infrastructure services are owned and supplied by the local government - PMC / PCMC. So, the responsibility of a co-operative society of a housing project in municipal limits is limited - the houses, buildings, open spaces & their plot of land.

Whereas, a special township is not a housing project. A special township is an infrastructure project. The ownership & responsibility is not only limited to houses. You also own infrastructural services. You own water, power, safety - security, fire fighting, drainage - waste management systems and other essential & basic civic services like medical, education, shopping.

"So, as a developer of Nanded City Pune, my job is to see that this infrastructure is managed more efficiently and more democratically," said Mr. Satish Magar.

Infrastructure Management System:


We all know Mr. Satish Magar for 'Farmers Direct Investment - FDI'. A revolutionary concept developed by Mr. Satish Magar. Because of Mr. Satish Magar, instead of selling their land to the builders, the farmers themselves became developers & builders and Magarpatta City was born. Which became a pattern of urban development - on which Government of Maharashtra formulated 'Special Township Act'. Now, Mr. Satish Magar was telling me his ideas about the management of his special township Nanded City Pune.

"To manage infrastructure spread over 700 acre - you need a system. Proven infrastructure management system. Which I am developing and fine-tuning for the last 10 years at Magarpatta City. The same infrastructure management system will manage Nanded City Pune," pointing at his laptop Mr. Satish Magar said.

Some 2,000 people work in different divisions which look after property management, safety - security, water, power, waste management services of Magarpatta City. In 'real time' the status of these services are available to Mr. Satish Magar.

At a frequent intervals," Mr. Satish Magar said, "the meetings are held - basically to reevaluate policies, otherwise, the system runs on it's own! This infrastructure management system is my creation & asset - which will be implemented at Nanded City Pune"

Nanded City Pune will have proven infrastructure management system - plus lot more systems will be automated. For example, paid water and power meters will help Nanded City Pune to mange water & power supply more efficiently. The management will have actual data of consumption and requirement of water & power.

"To manage these infrastructure services - you need professionals. Which we are training in house - at Magarpatta. Who will manage the infrastructure of Nanded City Pune," Mr. Satish Magar said.

Infrastructure Management Company:


"Professional management performs well in the corporate culture. So, I am going to form a company to look after the management of infrastructure of Nanded City Pune!," said Mr. Satish Magar.

"Company Raj!," words came out my mouth.

"Yes! To manage infrastructure of this size - you need impersonal - professional corporate management. Which will assure that the township will run well for the next 100 years. Even if Satish Magar is not there. My job is to establish an efficient management system which will offer good quality of life not only to the present residents but also to their next generations," said Mr. Satish Magar.

"Management is fine - but what about the ownership of township? This is not an animal farm!," I said.

"Of course, the residents will own this company! The professional management will be answerable to the owners - the residents of Nanded City Pune. It will be governed as per company law. Each unit holder - flat owner - will get one share in this company. This is the best way to manage infrastructure of this size democratically and efficiently," said Mr. Satish Magar.

"You also need funds to manage the infrastructure of this size. What will be source of funds? Only one time maintenance given by the property buyers?," I asked.

"No. One time maintenance is not enough. I call it cross subsidy - besides one time maintenance - the company will get revenue from commercial lease rentals. As I do at Magarpatta," said Mr. Satish Magar.

"You mean to say that like Magarpatta - the company will be the owner of residential as well as commercial part of the township?," I asked.

"You can't divide a special township into two pieces - commercial & residential. It's one - integrated - infrastructure project. So, this company will develop it's own streams of revenue. Developing streams - sources - of revenue is very essential for the survival - sustainability - of the township. Because supplying water, power and other essential services can't be your source of income. If you sell these services at profit - homeowners can't afford to live in your township. So - 'Revenue Generation Engine' is essential to run this train," said Mr. Satish Magar.

"I know a couple of trains - but I don't know anything about their 'revenue generation engine' or about their 'engine driver'! Some times, I fear what will happen if any train is derailed?," I said.

"Don't worry. Every builder who ventures into this kind of development must have some business model which will help the township to sustain and prosper. If any township fails - don't worry - state government will take over the management of this infrastructure - because special township is just 'decentralization' of urban infrastructure - it's not a private kingdom!," said Mr. Satish Magar.

Please, help me find this road. You know what? I have started feeling that KUL Nation is an Island Nation!

Owner or Tenant?

Are you an "Owner" or the "Kirayedar - भाडेकरू" of Special Township?




"I don't understand why property buyers pay such a huge amount to become a tenant of Blue Ridge, Nanded City Pune, Life Republic, Amanora!," said Mr. Vijay Kumbhar, RTI Activist and an authority on Special Township Act.

"Tenant? No! Mr. Kumbhar, only Amanora gives their flats on 999 years lease. So, those who pay for a flat at Amanora can be called "Lessee" - "Renter" - "Tenant". At Blue Ridge, Nanded City Pune & Life Republic - you own a flat. So you are a "owner". Not a Tenant!," I said.

"Owner of what?," Mr. Kumbhar asked.

"Owner of a flat," I said.

"Owner of a flat - means - exactly what? Owner of the cubic space inside the 4 walls, floor & roof of his flat?," Mr. Kumbhar asked.

"This is a temporary phase, Mr. Kumbhar! No developer has - yet - formed 'Co-Operative Housing Society' and has not - yet - done the conveyance deed in the name of society. So, at present, those who live in these flats - do not own the building and the plot of land on which the building is constructed. But eventually - I hope - the developers of these townships will form the Co-Operative Housing Society and will do the conveyance," I said.

"Why 'Hope'? - Aren't you sure?," Mr. Kumbhar asked.

"No. Not sure. Because, there is no clarity - all depends upon the builder's wish," I said.

"You know what? After the 97th Amendment to The Constitution of India - forming a co-operative society has become a fundamental right of every Indian citizen. And, now, co-operative society has received the status of Panchayat - local self government - Gram Panchayat - Municipal Corporation. So, no builder can stop the property buyers from becoming the owner of entire township!," Mr. Kumbhar said.

"As the builders do in the small projects - form society - do conveyance - and get out of the project?," I asked.

"Yes! The builder has no option but to handover the special township to the co-operative housing society of the property buyers. No builder can go against the constitution of India. Constitution believes that Indian citizens are capable of looking after themselves. Indian citizens didn't want - East India Company - then or don't want - any company - by any other name - now!," Mr. Kumbhar said.

7. Is he delivering the cylinder at home?

8. Is he delivering at your convenient date and time? Is he asking for extra charges for that?

9. Distance between home and dealer's shop

10. Is he weighing the cylinder in front of you?

11. Is seal of cylinder broken?

12. Do you know that expiry of cylinder manufacturing date is printed on the top side plate of the cylinder? Or below the circular ring?

13. Are you getting SMS from the gas agency about gas cylinder booking?

14. Is the dealer intimating about subsidized charges and non subsidized charges?

15. Do you know that online status of cylinder is available?

16. Is the dealer forcing you to take cylinder from the shop?

17. If you collect cylinder from shop - Does the dealer give back some amount which was suppose to be used for home delivery?

Location of KUL Nation is "Just 3.5 km from Kharadi, a destination emerging into the next real estate hotspot" the launch ads said. The claim of 3.5 km from Kharadi was based on the "Proposed 30 Meter Wide River-side Road from Kharadi".

And you know what? At the site of KUL Nation special arrangement was made to show the "Proposed 30 Meter Wide River-side Road from Kharadi" to every visiting property buyer!

Not only that! In every one to one interaction, visiting property buyer to KUL Nation was told that - by the time you get the possession of your flat - "Proposed 30 Meter Wide River-side Road from Kharadi" would be ready!

Yesterday, I fell in love of Nirman Brookefiled Willows at Pisoli.

In fact it was 'love at first sight'. Ready for possession fourteen 4 BHK Bungalows, cement concrete entrance road, well maintained landscape gardens, ready to use children's play area and the under construction 12 story residential tower of 2 BHK & 3 BHK Flats - stole my heart.

"Are bungalows available?," I asked Rahul.

"A few! But, on 9th we are launching that residential tower of 2 BHK & 3 BHK Flats - and I want to show you the actual 2 BHK Sample Flat!," pointing at an under construction building, Rahul said.

"Oh! Half of the building is ready? And, now, you are opening booking? I like that!," I said.

"Yes! 2 levels of parking and RCC of 4 floors is almost ready!," Rahul said.

At the main door of the sample flat, Rahul introduced me to Mr. Praful Rode, the project in-charge of Nirman Brookefiled Willows. Mr. Praful said, "Except furniture in the flat - what you see - is what you get!"

"Yes! I know. You are well known for giving tube lights in every room, exhaust fan in kitchen & toilet, safety door for main door, color video door phone, loft for inverter, solar water heating system, water recycling plant & even arrangement for drying clothes in the dry balcony! I have seen all this at Nirman Viva at Ambegaon. Now, please, tell me what is so great about this project!," I said.

"Of course, I will tell you. But not now. First, you have a look. See whether you can feel something unique about this flat!," Mr. Praful said.

"OK. Done!," I said and entered the sample flat. After visiting living cum dining, kitchen with dry balcony, common toilet, children's bedroom and master bedroom with attached toilet we came to the terrace. Looking at it's steel railing, I said, "This flat looks very smart and trendy! Of course, it's compact 2 BHK Flat. But that's only physical description - about size. About square feet. I am talking about the spirit - smart & trendy. Why? What makes it so smart & trendy?," I asked Praful.

"Detailing - planning - construction material - fittings & fixtures - smart & trendy is the total effect!," Mr. Praful said.

A few things about planning & detailing anybody can notice. Even if one doesn't know much about architecture and civil engineering. Mr. Praful said.

For example, there are 10 flats on each floor - 8 units of 2 BHK Flats + 2 units of 3 BHK Flats - but the connecting passage at Brookefield Willows is quite wide and well-lit. The ducts on both the sides of the connecting passage are wide enough - so the toilet windows do not bother much. Plus, there is a floor lobby for every flat.

You may not have noticed '8 feet' lintel level - but you liked the height of the main and bedroom doors and sizes of the windows. Right? Asked Praful.

You appreciated the color scheme of marble door frames. You liked the granite on the parapet wall of the dry balcony. Though you don't know about plumbing, you liked the false ceiling in the bathroom. Why? Because all these details - innovations - make this flat better. Right? Praful said.

"But, why does this flat looks so trendy? Certainly, not because of the paint!," I said.

"That's because we are not using conventional or fly ash bricks. We are using Autoclaved Aerated Concrete - AAC - Blocks! Smooth finish is a result of gypsum on these blocks. But finish is not the only intention behind using AAC blocks. Less cracks, long life, less water seepage, better temperature, convenience of use are the main reasons for using AAC Blocks," Praful said.

"It means that at Brookefield Willows one can get what one can see - as well as - one can't see!," Praful said.

"Thanks for sharing the secret recipe of the real estate cocktail!," I said.
