What about VAT?

Have you paid Maharashtra Value Added Tax (MVAT) on Property Bought between June 20, 2006 and March 31, 2010?

Particularly those home buyers who have purchased flats between June 20, 2006 and March 31. 2010.

From the day, deadline of October 31, 2012 was announced, the builders started demanding VAT - Maharashtra Value Added Tax (MVAT). Even today, builders are harassing these flat buyers by sending demand letters about VAT payments. Asking to pay from 1 to 5 per cent of the agreement value of flat. By demanding penalty & interest, builders are threatening for non payment.

Addressing the crowd of brave flat owners who have refused to pay VAT and are fighting against the builders, Mr. Sudhakar Velankar of Grahak Hitwardhini (98 50 75 83 05) said, "Unity! We can protect ourselves from builders - only if - we are united. We can fight against the builder - only if - all flat buyers in the society are united.

There may be a few flat buyers in your society who didn't have guts to fight against builder. There may be a few flat buyers in your society who couldn't stand against threats & harassment. There may be a few flat buyers in your society who didn't know that the builder's demand was illegal. There may be a few flat buyers in your society who innocently obey builder's every order.

Whatever may be the reason, we can't dismiss them. Because, we are neighbors. As a resident of the same society - our destiny is the same. We are connected. They may not be as strong as we are, but all are the members of the same society. We have to invite them to join us!"

Looking at the brave flat buyers, gathered in Perugate Bhave School, on Sunday evening, Mr Velankar asked, "Why we have to help those - weak flat buyers - black sheep in our society - who have already paid VAT to the builder?

Because, it's our duty to help them recover their VAT!

Yes! Demanding VAT without proper Tax Invoice is a crime. And letting someone commit a crime is becoming an accessory to the crime.

Builder has demanded VAT without proper Tax Invoice and your naive neighbor has paid as per builder's demand letter - the crime has been committed in front of your eyes - now, it's your duty to save your neighbor and stop the builder!"

Referring to the complaint letter, Mr. Velankar said, "Whenever builder sends you a demand letter and asks you to pay VAT - without sending proper Tax Invoice - what do you do?

You send complaint letter to Sales Tax Commissioner against the builder for illegal demand of VAT. Right?

The same way, you have to tell your neighbor to write to Sales Tax Commissioner for the illegal recovery of VAT.

Writing to Sales Tax Commissioner about VAT you have paid to the builder - will help the Sales Tax Commissioner to cross check - whether your builder deposits the same amount to the government or not.

Because, as per the law, the builder must deposit the exact amount which he has collected from the flat buyer.

Builder not depositing exact amount collected from the flat buyer is a crime.

And you know well how your builder is!

By helping your neighbor to write to Sales Tax Commissioner, you are confirming that the government has received exact money your neighbor has paid to the builder - so, eventually, you are confirming that your neighbor will be able to demand refund from the government!"

Next step is to demand the exact VAT assessment of your flat! Advocate Govind Patwardhan said.

Tell your neighbor to write to Sales Tax Commissioner for the exact VAT amount liable to your flat after the assessment and demand for the refund if you have paid more.

Mostly, your neighbor must have paid more because the VAT has no relation with the agreement cost. VAT is on the input costs - steel, cement and other materials used in the construction of your flat! Advocate explained.

Point is unity. We all must stand united. Only united flat buyers can fight & win against builders. So, when builder sends only demand letter - without Tax Invoice - you - brave property buyers who have refused to pay VAT - complain to the Sales Tax Commissioner against the builder for illegal demand.

And those who have paid VAT as per demand letter also inform the Sales Tax Commissioner about builder's illegal recovery. In this scenario, who will win? Builders or property buyers? Certainly, property buyers! Mr. Velankar said.

Can we stop builder from - harassing & threatening flat buyers - from demanding VAT?

Mr. Velankar asked.

It looks possible! In the next couple of days, if we could find a way, we may go to court against the builders to prevent them from demanding VAT. Mr. Velankar announced.

Updating about the PIL filed in Bombay High Court, Mr. Velankar said that the next hearing is on the 3rd of January 2013. And wished happy new year to all brave flat buyers who have refused to pay VAT. MLA Girish Bapat, Advocate M. P. Bendre, Chairman, Akhil Bhartiya Grahak Panchayat Pune, Suryakant Pathak, and Vijay Sagar also addressed the meeting.

Fear Over Pune City:


Pune is the capital of fear.

Currently, after the Delhi Gang Rape, DNA reports that, fear psychosis has gripped women in Pune.

Recently, the fear of dreaded gangster Arun Gawli has returned to haunt Pune.

A few months ago, North East students & worker in Pune ran away for fear of being attacked.

After the fearful four bomb explosions in Pune entire India was gripped by possibilities of new terrorist attacks.

No one has forgotten how 25,000 North Indians left Pune because of Maharashtra Navnirman Sena (MNS) in 2008.

All these fearful stories were reported in the local newspapers. But there is one story which is never reported in any local newspaper. The story about the fear of property price.

Fear Factories of Pune:


No local newspaper reports how citizens of Pune fear builders. No local newspaper reports how citizens fear rising property prices. No local newspaper reports how citizens fear about not being able to own a home.

No local newspapers ever report about fearful Pune real estate market because these local newspapers themselves are factories of fear.

Builders in Pune have given a contract of creating fear about Pune real estate market to these local newspapers. Mainly because these local newspapers are experts in sugar coating fear with prosperity and distribute it to every home in Pune.

Profiting from Fear:


If run like any business there isn't much profit in real estate. Pune builders know this. So, to earn exorbitant profit, Pune builders borrowed the 'know-how of profiting from fear' from the politicians. Who are 'profiting from fear' for years. And you know what? Nobody knows that! Because the fear is always sugar coated. For example, politicians profit from the fear of neighboring country or state - which they sugar coat with "I Love India" "Jai Shivaji Jai Maharashtra".

In the same way, Pune builders sugar coat fear into property appreciation. Sometimes, fear about property price rise is coated into status of living in a particular location like Wakad or enjoying amenity like floating club house. Some well known personality - like architect or actor - is used for sugar coating fear. Sometimes, hocus pocus plans and projects - D P Road - Ring Road - Pune Metropolitan Region Development Authority (PMRDA) - Pune Metro Rail - are used to sugar coat fear.

Coating may be different but fear about property price rise is common in all offers. Still the results vary. Some projects manage to create more fear than others. So, at the launch, these projects get more number of bookings than others. My blogs on these launches are read more. So, these blogs become most popular blogs on the projects launched in 2012. And these project are considered as most fearful housing projects of 2012.

So on behalf of all builders in Pune, I wish you all very fearful 2013!

Shrinking Size of Your Flat - Are We Getting Poorer?:


When I had a look at the most popular projects launched in 2012, I asked myself - Are we getting poorer?

It looked to me that builders have decided that Pune property buyer deserves to live only in a 2 BHK Flat - Small Size - Compact 2 BHK Flat.

Of course, the builders don't say so openly. They put it in a customer friendly way and announce that demand is more for Small Size - Compact 2 BHK Flats. And add to it - but we, the builders, care for the unfortunate few too and offer 1 BHK Flats. For the 3 BHK Flats - the builders' explanation is - those who have bigger budget are also human beings who need houses.

The enlightened property buyers blame the builders. They don't buy builder's argument. They complain that Pune builders collectively dominate the real estate market. To earn high profits, Pune builders conspire together to hike the property prices and squeeze & deceive Pune property buyers. Result is majority of salaried young Punekars are not able to buy homes. If one can, he has no option but to buy a Small Size - Compact 1 BHK or a 2 BHK Flat.

However, those who buy a home at the current property prices, I am sure, have stopped bothering whether Pune builders are exploiting them or not. Because they know for sure that we all are getting poorer.

Size of our home is shrinking. Our working hours are increasing. High cost of living is affecting our standard of living. High running & maintenance cost of our cars and homes are depreciating their worth. Education & medical expenses have become nightmares. We are not earning to live. We are living to earn. We have stopped thinking about prosperity. We are only managing to survive.

We are not only squeezed & deceived but are abused by all. By the government. By the grocery shop owner at the corner. By the petrol pump owner on the way to work. By our bank. By the politician who is difficult to jail. In this situation how can we expect that a builder will not do the same?

We look rich on paper. But in reality we are poor. And getting poorer every day.

It's called 'artistic impression' of the architectural drawings of the building's elevation. Sometimes digital animation film is also created and screened at the launch.

However, the main attraction of the launch event is the builder himself.

The builder of the project is present at the launch event. To seduce every Chulbul Pandey to book, the builder performs 'item song' in the launch pandal. Pointing at the digital image of the elevation of the building, the builder dances & sings...Mere photo ko seene se yaar chipka le saiyan Fevicol se...



Since the launch of the project is mostly the only occasion when you see the builder of the project, I am sure, you remember his performance for life. You may not book a flat but, for sure, builder's dance has seduced you completely. So you come out of the launch event with a photo of the project glued to you.

Some of you know, for sure, that every builder in Pune pays me a few crores of rupees to promote his project. Particularly - when the stakes are high - at the time of launch of the project. Obviously, I do my best and write about every newly launched project. Naturally, my blogs on the recently launched projects in Pune real estate market are more popular than the other blogs. They believe.

Instead of arguing about the most popular belief about me, I prefer to do what I enjoy most and keep on blogging. I avoid defending myself mainly because - I don't want to accept that I am too dumb to encash my talent, knowledge and experience. And I keep on blogging because I don't know how to kill time. Yes, when you are born with a silver spoon in your mouth, don't have to earn bread and butter in your entire life and pay an EMI, how to pass the time is a serious question.

Irrespective of monetary gains, I believe in keeping a check on how I am doing. When I had a look at the most read blogs in 2012, I found out that my blogs on the launch of the project were the most popular ones. Compared to other blogs, these blogs were better too. No wonder, some of you feel that Pune builders must be paying me to write those blogs, I told myself. Otherwise, why should Ravi Karandeekar take trouble to visit Uruli Kanchan & Kanhe to write about some builder? Right?

Pre-Launch or Launched?

How is the builder?

Do you know who is the builder of 'Urban Space' at NIBM? The same builder is developing 'The LandMark' at Undri, 'Urban Balance' at Hadapsar, & 'Urban Life' at Talegaon.

Yes, Urban Nirvana at Kharadi was his first project.

My old friend Bhavin Parekh told me and invited me to meet the builder and visit these projects. I will show you all the sites and then we will have a dinner at our veg restaurant Cream Center at Kalyani Nagar, Bhavin said.

Site visit & dining at Cream Center is a good idea. But I don't see any point in meeting the builder. Because, all builders are one & the same. They look different but act same. When any property buyer asks me - how is the builder - my answer is - as good as any builder.

It's a package. Meet the builder. Visit the site. Eat at Cream Center. Bhavin was firm.

I only travel in Mercedes. I tried to pretend tough. So, that Bhavin should not know that I can do anything for Cream Center. Good! He agreed. Immediately, I clarified that it's a casual meeting and site visit. Not a briefing for writing a blog

Did I ask to write? Consider it as our public relations initiative. Bhavin said.

No blog. Only meet, visit & eat. I confirmed.

Bhavin agreed. I visited the builder. Visited their sites. Not with Bhavin but with his colleague. Sudarshan Arote. At the end of the day, Bhavin's driver dropped me at my home.

We had a late lunch. I know you are not hungry. Bhavin sir said - we will visit Cream Center some other time. When you can eat & enjoy every dish on the menu. Sudarshan said and wished me good night.

Did you take so much trouble for a 'roti and baigan masala' at Toni Da Dhaba? My wife asked.

I am not surprised. Disappointed. Angry. A builder is a builder is a builder. Now, I am going to write a blog and teach a lesson - not only to this builder - but to all builders in Pune. Because, it's not about 'Cream Center'. It's about...

Yes, I know. It's about 'trust'. My wife said.

VTP Group vs Pune Property Buyers:


To present the true picture of this builder, I decided to write a blog.

I started rewinding & dissecting every moment. I went on examining every statement. Started analyzing every project. Had a critical look at every floor plan. Did some more research. Found out that there was no need to invent anything. Facts were enough to make you aware about this builder. Have a look at the facts:

1) V. T. Palresha, father of Bhushan & Nilesh, is known and respected figure in Pune real estate market for many years. So, these two directors of VTP Group are nothing but celebrity kids.

2) Besides Bhushan & Nilesh, lot of other qualified family members are working in VTP Group in the responsible positions. So, Bhushan is free to buy the plots of land. His younger brother, Nilesh has nothing else to do but to sit with architects, plan the next project and launch them one after another. To supervise the day to day construction of these projects, there is one cousin.

3) To take advantage of these young, energetic & educated fellows, many land lords & builders have signed joint ventures with Bhushan & Nilesh. That's why, no wonder, in such a short period of time, VTP Group has ongoing projects at the prime & popular locations in Pune - NIBM, Undri, Hadapsar & Talegaon.

4) If you yourself are one of the biggest suppliers of cement and 70 per cent construction materials, you don't have to waste time in negotiating & procuring raw materials. If the supply is on time and quality of the materials is not an issue - on schedule construction is not a big deal for VTP Group.

5) When you own an infrastructure development company, like other builders, you are not entirely dependent on subcontractors for the cost, quality and timely completion. Means that, like other builders, please, keep in mind, VTP Group is not only a facilitator - organizer but an actual builder.

6) When renowned architect Reza Kabul designs your project - Urban Space - which is in Dorabaji Paradise at NIBM, it ought to get a huge response.
